NAME/TITLE: _____________________________________________________________

COMPANY NAME/BUSINESS UNIT: ___________________________________________

CAGE/DUNS: _____________________________________________________________

I certify that:

1. Pursuant to DoDM 5200.01-V4, dated 24 February 2012, and DoDD 5230.25, dated 06 November 1984, my business unit understands access to controlled unclassified information (CUI) and possibly classified information is limited, but may be disseminated within the DoD Components and between officials of the DoD Components and qualified U.S. contractors, consultants, and grantees as necessary in the conduct of official business. Unauthorized dissemination of this information is prohibited and may result in disqualification as a qualified U.S. contractor, and may be considered in determining eligibility for future contracts with the Department of Defense.

2. My business unit intends to compete for the LPRD contract award (at either the Prime or Subcontract level). All CUI and classified documents provided by the U.S. Government will only be shared/discussed with individuals who are: 1) U.S. Citizens; and 2) part of the LPRD proposal team from my business unit; or 3) other potential LPRD participants (Prime or Subcontractor) who were directly provided this information by the U.S. Government; or 4) are part of the U.S. Government LPRD acquisition team. My business unit accepts this data “as is” without any Government representation as to suitability for intended use. MY BUSINESS UNIT WILL NOT DISCLOSE CUI

OR CLASSIFIED INFORMATION TO ANY OTHER INDIVIDUALS OR BUSINESS UNITS.

3. My business unit agrees to indemnify and hold harmless the Government, its agents, and employees from every claim or liability, including attorney fees, court costs, and expenses arising out of, or in any way related to, the misuse or unauthorized modification, reproduction, release, performance, display, or disclosure of Data (with restrictive legends) received from the Government by the Recipient or any person to whom the Recipient has released or disclosed the data.

4. My business unit will not divulge, publish, or reveal by word, conduct, or any other means, such information or knowledge, except as necessary to do so in the performance of duties directly related to the LPRD proposal preparation process and in accordance with the laws of the United States. I take this obligation freely, without any mental reservation or purpose of evasion and in the absence of duress.

5. My business unit acknowledges the information received will be given only to persons specifically granted access to the CUI and/or classified information and may not be further divulged or used for any purpose not directly related to the LPRD proposal preparation process.

6. My business unit will not duplicate or copy to a networked computer any CUI or classified information viewed or downloaded from the LPRD Bidder’s Library disk(s). If my business unit’s proposal team does incorporate CUI into its proposal, this information will be marked accordingly.

My business unit will not incorporate any classified information into its proposal. Any classified addendum will be submitted to the technical team ONLY and WILL NOT be submitted with the LPRD proposal.

7. My business unit will properly safeguard the information, in accordance with appropriate procedures (CUI/NISPOM), from unauthorized disclosure at all times. This includes destroying it by a method preventing disclosure of its contents or its reconstruction as soon as it is no longer needed for the authorized purpose stated above. UNCLASSIFIED DESTRUCTION NOTICE:

Destroy by any method that will prevent disclosure of contents or reconstruction of the document.

CLASSIFIED DESTRUCTION NOTICE: Follow the Procedures in DoD 5220.00-M, National Industrial Security Program Operating Manual (NISPOM), Section 5-705, or DoD 5200.1-R, Information Security Program, Chapter VI.

8. My business unit will refer to and comply with DoDI 5230.24 (Aug 2012) “Distribution Statements on Technical Documents” in order to ensure documents are properly marked and secured.

9. I have the authority to sign on the behalf of the business unit identified above, and assert this NDA is hereby duly signed for and on behalf of the said business unit by authority of its governing body.
