About this file
This is a Maryland Living Wage Requirements Affidavit of Agreement document related to the Maryland Insurance Administration's Financial Examination Assistance Services contract solicitation (MIA/FR-26-002). The affidavit establishes living wage compliance requirements for contractors providing financial examination assistance across four functional areas: Staff Examiner Assistance, Senior Examiner Assistance, Examiner-In-Charge Assistance, and Senior Manager Assistance. The contract involves a five-year term with the potential for award to up to six contractors to support the MIA Financial Regulation Division's examination of Maryland domiciled insurers. The affidavit is effective as of July 2024 and must be submitted with the bid or proposal.
The affidavit provides exemptions from Maryland's Living Wage Law for contractors meeting specific criteria, including nonprofit organizations, public service companies, contractors with ten or fewer employees proposing contracts valued under $500,000, or contractors with more than ten employees proposing contracts valued under $100,000. For contracts subject to living wage requirements, contractors must commit to complying with Title 18 of the Maryland State Finance and Procurement Article and pay covered employees the established living wage rate for hours spent on state contract activities. Contractors must ensure subcontractors also comply with wage rate requirements, including any increases established by the Commissioner of Labor and Industry, and submit payroll reports as required. The Commissioner of Labor and Industry reserves the right to request payroll records and other documentation to verify contractor compliance at any time.
