About this file

Attachment G is a Certification of Drug Free Workplace form for a state procurement process in Florida, specifically related to a competitive proposal submission. The document outlines a required certification that the respondent (vendor) has implemented a comprehensive drug-free workplace program, which includes six key provisions such as publishing employee statements prohibiting controlled substance use, informing employees about drug abuse dangers, providing written policy statements, requiring employee notification of drug-related convictions, imposing sanctions for violations, and maintaining ongoing drug-free workplace efforts.

The form serves as a potential tie-breaker mechanism for equal proposals, where vendors who have signed and submitted this certification may receive preference in accordance with Section 287.087 of Florida Statutes. If multiple proposals are deemed equal in price, quality, and service, the department will prioritize the respondent with a documented drug-free workplace program. The certification requires an authorized representative to sign, affirming compliance with the specified requirements, with an explicit warning that false statements are punishable under law.

When the Department receives equal Proposals eligible for award, with respect to price, quality and service, the Department will apply a preference in accordance with Section 287.087, F.S., to the Respondent that has signed and submitted this form with its Proposal certifying it has implemented a drug-free workforce program in accordance with the provisions below.

I certify that the Respondent has implemented a drug-free workplace program that includes the following:

(1) Publishing a statement notifying employees that the unlawful manufacture, distribution, dispensing, possession or use of a controlled substance is prohibited in the workplace and specifies the actions that will be taken against employees for violations of such prohibition.

(2) Informing employees about the dangers of drug abuse in the workplace, the business's policy of maintaining a drug-free workplace, any available drug counseling, rehabilitation and employee assistance programs, and the penalties that may be imposed upon employees for drug abuse violations.

(3) Giving each employee engaged in providing the commodities or contractual services that are provided under the Proposal a copy of the statement specified in (1) above.

(4) In the statement specified in (1), above, notifying the employees that, as a condition of working on the commodities or contractual services that are being competitively procured, the employees will abide by the terms of the statement and will notify the employer of any conviction of, or plea of guilty or nolo contendere to, any violation of Chapter 893 or of any controlled substance law of the United States or any State, for a violation occurring in the workplace no later than five days after such conviction.

(5) Imposing a sanction on or requiring the satisfactory participation in a drug abuse assistance or rehabilitation program if such is available in the employee's community, by any employee who is so convicted.

(6) Making a good faith effort to continuing to maintain a drug-free workplace through implementation of these provisions.

As the person authorized by the Respondent to sign the attachment, I certify that the Respondent complies fully with the above requirements. False statements are punishable under law.
