About this file

This is a Special Conditions document for Sarasota County, Florida, amending the general contract conditions for the Honore Avenue Reclaimed Water Main Extension Phase 2B project. The special conditions establish the contractor's responsibility regarding wastewater discharge control and containment during construction activities related to the reclaimed water transmission main installation. The contractor is required to immediately control, contain, and stop any discharge of wastewater, promptly repair any damage to county facilities, and immediately notify the county project manager of any discharges that occur. The contract duration is 300 calendar days, with work located in Osprey, Florida.

The special conditions establish a financial penalty structure for unpermitted discharges under the Florida Department of Environmental Protection Consent Order (OGC No. 19-0255) and the Stipulated Order with Suncoast Waterkeepers regarding the Bee Ridge Water Reclamation Facility. The contractor is liable for reimbursement of any penalties incurred by the county attributable to the contractor's actions, with daily penalty amounts ranging from $600 for discharges up to 5,000 gallons to $12,000 per day for discharges exceeding 100,000 gallons. This financial accountability structure underscores the critical importance of environmental compliance and wastewater management throughout the project execution.
