About this file

This is an administrative disclosure form (Attachment 5) for the New York State Office of Information Technology Services' Competitive Procurement IFB #C001029 related to hosting services for the New York State Liquor Authority's Division of Alcoholic Beverage Control Wholesale Platform. The form requires bidders to address two key administrative requirements: disclosure of any proprietary or trade secret information that meets New York State Freedom of Information Law (Article 6 of the Public Officers Law) definitions, and complete disclosure of any legal proceedings or investigations involving the firm over the preceding five years, with specific emphasis on any pending or prior litigation between the bidder and any New York State department, agency, board, or commission.

The disclosure form mandates that bidders complete all designated yellow fields in their Administrative Proposal and provide detailed responses indicating whether each statement applies to their organization. For litigation disclosures, bidders must describe the nature and outcome of completed lawsuits, while FOIL redaction requests require submission of a separate letter outlining concerns regarding disclosure of proprietary information. The form contains pre-populated fields and prohibits any modification to the column or row structure, ensuring standardized submission across all bidders competing for the contract to develop and host a comprehensive platform supporting price postings, brand appointment letters, limited availability item submissions, and delinquent credit management for over 50,000 licensed wholesalers, manufacturers, retailers, and the general public.
