About this file
This is Amendment 003 to RFP 00027273 issued by the University of Maryland College Park for on-call emergency cleanup and restoration services. The amendment modifies the original solicitation for one or more on-call contractors to provide labor, materials, equipment, and supervision for emergency cleanup projects on an as-needed basis at UMCP and USM Service Center locations within the University of Maryland College Park and its service center areas. The scope of work encompasses emergency restoration and cleanup services requiring responsive contractor availability and mobilization capabilities. The amendment updates specific terms, conditions, or requirements from the original RFP and its previous amendments to clarify contractor obligations, project specifications, or contract administration procedures.
The amendment establishes the revised framework for contractor selection and ongoing performance under the on-call contract structure. Key modifications contained in this amendment address changes to contractual terms, performance requirements, or other administrative provisions necessary to ensure clear understanding between the University and responding contractors. Interested bidders should carefully review this amendment in conjunction with the original RFP 00027273 and Amendment 001 and Amendment 002 to understand the complete and current contract requirements. The on-call nature of the contract requires contractors to maintain availability for rapid deployment to emergency sites as requested by the University, with pricing and performance terms established through the competitive procurement process outlined in the complete solicitation documents.

Questions & Responses
RFP # 00027273
Q1. In Section 00300, Technical Proposal Evaluation Factors, the RFP requires that one of the three submitted experience projects be a “scientific research project, preferably in a higher education setting.”
Given that this solicitation is for on-call emergency clean up and restoration services, including fire, flood, mold remediation, sewage, and trauma response, we respectfully request clarification regarding the University’s intent with this requirement.
Specifically, does the University consider emergency mitigation, remediation, or restoration work performed within laboratory, research, or scientific facilities to satisfy this criterion, even if the scope was emergency response rather than planned research construction? Alternatively, please advise if this requirement was included inadvertently from a different procurement and, if so, whether proposers may substitute another occupied institutional emergency response project of similar complexity.
A1. The intention of this requirement was that one (1) of the three (3) submitted experience projects will have taken place in a scientific, or research setting, preferably in a higher education setting. Yes, an example project of emergency mitigation, remediation, or restoration work performed within laboratory, research, or scientific facilities would satisfy this criterion.
Q2. Is this a new contract?
A2. No, this is a re-solicitation of the existing services.
Q3. Who is the incumbent contractor?
A3. Two awards were generated from the previous solicitation of these services, Infinity
Services and M&S Enterprises.
Q4. Is the previous bid tabulation available?
A4. A Public Information Act request must be submitted to obtain pricing and/costs as
UMCP Procurement is not permitted to provide that information. A formal request must be submitted to the following: https://umd.edu/maryland-public-information-act-request-form.
Q5. How much was spent during the last contract period?
A5. See response to Q4.
Q6. What is the anticipated budget for the next contract period?
A6. As this is solicitation is for emergency/urgent services, there is not a dedicated budget for these services.
Q7. Is this contract fully funded?
A7. See response to Q6.
Q8. Is bonding necessary for the bid/proposal?
A8. No, there is no payment, performance, or proposal bonding requirement. The insurance requirements can be found in Section 0200 of the RFP.
Q9. What is the expected start date?
A9. The projected award date is July 18, 2026.
Q10. What are the liquidation rates?
A10. There are not liquidation rates are not applicable to this solicitation.
Q11. Are there MBE/DBE requirements? If so, what percentage? Subcategories? Percentage that can be self-performed?
A11. MBE requirements will be required if/when the costs are expected over $ 100,000 and is a planned project.
Q12. Do we have to fulfill all categories of services for the contract?
A12. This is a qualifications based solicitation. A successful awardee will likely be able to fulfill all required services.
Q13. Can you please confirm the last contract price?
A13. See response to Q4.
Q14. Can you please confirm if any prevailing wage will be required under this contract?
MD minimum wage is acceptable?
A14. Prevailing wages do not apply to this solicitation, and Maryland’s minimum wage is required.
Q15. RFP Section 0300, F -Technical Proposal Evaluation Factors, # 2 - Experience on
Similar or Relevant Projects. What is meant by scientific research projects?
A15. See response to Q1
Q16. RFP Section 0200 - 12B. We do not understand this paragraph -please explain.
A16. Suppliers who invoice the University shall not owe the State of Maryland before resolving issue(s). Debts to the State may result in liability offset(s) to the supplier.
Q17. RFP Section 0200, 14A. Is it beneficial and or necessary to submit Insurance certificates in the bid before being awarded the bid?
A17. A successful contractor will be requested to submit a blanket certification of insurance with limits that equal to or greater than those listed in the Section 0200 previous to award of contract.
Q18. RFP Section 0200, -.29 Century compliance warranty. We do not understand this paragraph. Please explain.
A18. This language states that installed material(s) and/or equipment must be manufactured in the current century. This language likely does not apply to this solicitation.
Q19. Division 1, Section 0500 includes requirements that appear to align with both planned construction activities (e.g., work initiation conferences, staging plans, schedules, daily reporting, supervision, as-builts) and immediate emergency response services requiring rapid mobilization.
To ensure consistent compliance and accurate pricing, please clarify how Division 1 /
Section 0500 requirements are intended to apply during the initial emergency response and mitigation phase (e.g., active water intrusion, fire, biohazard events) versus post-stabilization or follow-on corrective work performed under a Task Order.
Specifically, please confirm:
1. Which Division 1 / Section 0500 requirements are mandatory at the time of initial emergency mobilization, and which apply after stabilization or under scheduled
Task Orders.
2. Whether emergency mitigation work may proceed under verbal authorization with written Task Order documentation to follow.
3. At what point emergency work is considered complete and subject to full construction administration requirements (WICs, schedules, supervision staffing, as-builts, etc.).
A19. See “Section 0400 – Part IV, Division 1, A, 3 - Implementation” for additional details.
Q20. Section 0100 references milestone schedules that appear to assume a defined scope, fixed start, and predictable completion timeline. Emergency response and mitigation services, however, are often condition-driven and subject to factors outside the contractor’s control (e.g., ongoing water sources, access restrictions, drying verification, University-directed pauses). Please clarify whether the milestone schedule in Section 0100 is intended to apply to:
1. Initial emergency response and mitigation activities, or
2. Only to post-stabilization or follow-on work performed under a Task Order with a defined scope and duration.
A20. The milestone schedules are evaluated on parameters that are within the reasonable control of the contractor such as (initial response time, availability of workers, availability of equipment, timeliness of equipment/drying monitoring (not the actual speed of the drying process).
Q21. Additionally, please confirm how schedule milestones are evaluated when emergency work duration is dependent on drying conditions, environmental readings, or
University-directed delays.
A21. The milestone schedules will be evaluated on the contractor's ability to have adequate staffing and equipment needed for the specific flood type. It will be expected that they follow industry standard best practices such as those laid out in ANSI/IICRC
S500 Standard for Professional Water Damage Restoration. The evaluation will not be determined on the timeliness of the drying process but rather that ability to follow best practices.
Q22. The RFP states that contractors must have field supervision on site whenever staff are present/working. For emergency restoration services, many incidents involve small crews, short durations, or routine monitoring activities where continuous on-site supervision is not typical industry practice.
Please clarify the University’s expectations regarding site supervision for restoration work, including:
A. Whether on-site supervision is required for all emergency response incidents regardless of size or duration, or only for incidents exceeding certain thresholds (e.g., crew size, duration, scope, or risk level).
B. Whether a foreman or lead technician may serve as the designated on-site supervisor for smaller incidents.
C. Whether remote supervision with periodic site visits is acceptable for routine mitigation or monitoring activities.
A22. See Section 0400 “Part IV”, DIVISION II – GENERAL SPECIFICATONS, 1.13.
SUPERVISION OF THE WORK.
Q23. The RFP describes multiple pricing and procurement approaches, including lump sum bids, time and material (T&M), and not-to-exceed task orders. To ensure consistent compliance and accurate pricing, please clarify the University’s intended application of these pricing methodologies. Specifically, please confirm:
A. Which pricing methodology is intended for initial emergency response and mitigation activities (e.g., water, fire, mold, biohazard incidents).
B. Whether the pricing methodology for a given incident is established at the time of activation or task order issuance, and whether it may change once work has begun.
C. Under what circumstances emergency work would be expected to be priced as a lump sum versus T&M or not-to-exceed.
D. Whether competitively bid lump sum pricing is intended only for post-stabilization or follow-on corrective work with a defined scope.
A23. Use Section 0500 for requested labor costs. Whether emergency and/or lump sum, the labor costs provided in Section 0500 will become the contracted rates the successful awardee will bill on projects.
Q24. Please confirm if emergency work can begin upon University authorization
(call/email) and that NTP/Task Order can follow without putting costs “at contractor risk.”
A24. Yes, typically emergency work is coordinated with University personnel and assigned contractor, performed, then the task order is issued for payment reference.
Q25. Are bonds required at the master on-call award level, or only on individual task orders that exceed the threshold?
A25. See response to Q8.
Q26. The Terms say rental rates must be agreed and reference AED rates, and also state reimbursement won’t be authorized if contractor-owned equipment is used. Please confirm how contractor-owned equipment is billed (daily/weekly rates vs actual cost basis) and what documentation is required.
A26. The labor costs provided in Section 0500 will become the contracted rates the successful awardee will bill on projects. University personnel will verify contractor-owned equipment and will approve at submission of invoice(s).
Q27. It says daily reports must be submitted into your online system daily. Please identify the system/platform, access process, required format, and whether our internal tools can be used if provide equivalent reporting.
A.27 Daily reports can be submitted in writing or email to the appropriate responsible
UMD project manager.
Q28. Could you please provide the last contract price?
A28. See response to Q4.
Q29. Could you confirm whether this contract is subject to prevailing wage, minimum wage, or if there is a specific wage rate applicable to all labor?
A29. See response to Q14. Use Section 0500 for requested labor costs.
