THE ABOVE CONTRACT IS AMENDED TO INCLUDE THE FOLLOWING CHANGE(s)
AWARD DETERMINATION (REV 01) :
In response to this solicitation, the Forest Service intends on awarding multiple contracts. The Forest Service’s proposal evaluation will be based on best-value principles. Accordingly, award will be made to those responsible offerors whose proposals provide the greatest overall value to the Government, price and other non-price (technical) factors considered. The critical factor in making any cost/quality tradeoff is not the numerical spread between the technical scores, but what the significance of the difference might mean in terms of performance and what it would cost the Government to take advantage of it. This means that award may not necessarily be made to that offeror submitting the lowest priced technically acceptable offer. Every proposal received will be carefully considered and all information submitted will be kept in strict confidence. Sufficient data must accompany each proposal.
The technical evaluation will be accomplished by first reviewing each offeror’s technical submission against the technical factors listed below. After evaluating each technical proposal, the technical proposals will then be ranked.
Offers shall be evaluated in terms of price and other technical factors. The technical evaluation criteria are listed in descending order of importance, Technical Capability (Capability to Perform, Project Management and Control, Safe work performance, project experience), Past Performance (Project experience), and Price. Technical capability is significantly more important that Past Performance which is more important than price.
Only offerors that submit a proposal in accordance with Section L of this solicitation (including any amendments) may be considered for award. In accordance with FAR 52.215-1, it is the intent to award contract(s) without further discussion. Therefore, the offeror’s initial proposal should contain the offeror’s best terms from a technical, as well as a price standpoint.
A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.
Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
EVALUATION FACTORS, Page 72, add the following to paragraph (b)
Technical Evaluation: It is true that a majority of the task orders will be Phase I projects. However, Phase II and III should also be addressed and discussed in the technical proposal. Offers should include samples of recent Phase II and Phase III proposals as part of the technical proposal package. Offers should also include copies of resume’s for employees that the offeror intends to have perform work.
PRICE EVALUATION, Page 77, remove page 77, this information should have been cited in Section L.
SN 7540-01-152-8067 *USCGPO 1986-491-248/40008 50336-101 OPTIONAL FORM 336(4-86)
THE ABOVE CONTRACT IS AMENDED TO INCLUDE THE FOLLOWING CHANGE(s)
Section L, Page 75. Insert the following after “SUMMARY OF PROPOSAL PREPARATION AND SUBMISSION REQUIREMENTS, Sub-Paragraph 5. Signed copies of any amendment issued.”, and before the facsimile notice.
(a) Price evaluation will include both the base year and all optional years. The offered pricing is also considered by the Forest Service as contractually binding unit ceiling pricing. Price evaluation does not include pricing for Phase II or Phase III requirements, these items will be negotiated on an as-needed basis after contract award.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
Only offerors that submit a proposal in accordance with Section L of this solicitation (to include amendments thereof) will be considered for award.
The Forest Service also recognizes that an offerors may have minimal experience. For those offerors, the Forest Service will rate PAST PERFORMANCE as neutral. In this instance, it is advised that the offeror address how they intend on insuring successful completion of the work, for example: subcontracting certain aspects of the project.
In accordance with FAR 52.215-1, it is the intent to award contract(s) without discussions. Therefore, the offeror's initial proposal should contain the offeror's best terms from a price and technical standpoint.
Award of a contract will be made to that offeror (or offerors) 1) whose proposal is technically acceptable, and 2) whose technical/cost relationship is the most advantageous to the Government. While cost is secondary, it will be a factor in the award decision. Award of the contract may be made on the basis of initial offers received, without discussion of such offers. Each initial offer should be submitted on the most favorable terms from a price and technical standpoint, which the offeror can submit. Every proposal received will be carefully considered and all information submitted will be kept in strict confidence. Sufficient data must accompany each proposal to allow the Technical Evaluation Board to evaluate each of the Evaluation Factors for Award.
