STATEMENT OF WORK
Construct and Install Intake Structure Improvements, Fish Ladder Structure Improvements, And All Associated Appurtenances

1.0. GENERAL INFORMATION.
1.1 Contractor shall provide Construction and Installation of Intake Structure Improvements, Fish Ladder Structure Improvements, and All Associated Appurtenances as shown in the 100% Final Draft Construction Documents (Drawings and Technical Specifications) provided as a separate attachment to this Statement of Work. The Project / Contract is located at the Abernathy Fish Technology Center in Longview, Cowlitz County, Washington.
1.2 Contractor�s Qualifications: Contractors shall be experienced and have demonstrated positive past performance with Construction and Installation of New Intake Structures, Rehabilitation of Existing Intake Structures, Construction and Installation of New Fish Ladders, and Rehabilitation of Existing Fish Ladders, and All Associated Appurtenances.
Contractors shall demonstrate extensive knowledge, ability, and skill in Design and Construction of New and Modified Intake Structures and Fish Ladder Structures.
Contractors shall demonstrate knowledge of All Relevant State and Federal Laws, Codes, Regulations, Standards, and Provisions.
Furthermore, Contractors shall demonstrate extensive experience applying this knowledge in Construction.
1.3 Refer to Section L and M of the Solicitation for Evaluation Factors. Bidding Contractors shall provide five (5) specific example intake structure / fish ladder structure and/or Similar Scope Projects as part of their Recent Relevant Experience and Past Performance Narrative, which have occurred over the last 5 years. In addition to Past Experience (Recent Relevant Experience) and Past Performance Evaluation Factors, the Contractor shall be required to submit on Technical Capability and Technical Approach Evaluation Factors.
1.4 Regulatory Requirements: It is the Contractor�s responsibility to construct the Project in compliance with applicable requirements of federal and state laws, codes, rules, regulations, ordinances, and standards, including, but not limited to, those outlined below. Contractor shall have copies available of applicable codes and regulations for ready reference. These shall include, but are not limited to:

In the event of a conflict, the most stringent laws, codes, regulations, standards, and provisions shall apply.
Contractor shall construct the project as shown in the 100% Final Draft Construction Documents (Drawings and Technical Specifications) included as part of the Solicitation Documents in a separate attachment.
2.0. PLACE OF PERFORMANCE AND PERIOD OF PERFORMANCE.
2.1 Work Location: Abernathy Fish Technology Center (AFTC), 1440 Abernathy Creek Road, Longview, Washington 98632+9764.
2.2 Period of Performance:
Contract Award Date: August 30, 2022.
(Contract Award Date Differs from the Notice to Proceed Date. The Notice to Proceed and established date is to be delivered to the Contractor and is estimated at 12 Months from the date of Contract Award)
End Date: September 30, 2024.
Site Conditions of the area of interest consist of the Abernathy Creek System, riparian areas, and low-lying wetlands. The approximate Construction Work Window for the Project will be July 15 through September 15 of each year Unless Otherwise Noted.

In the event of damage to government property resulting from demolition and/or construction, the contractor shall return the damaged area to its original condition or �better� condition. The contractor will also be instructed where to access the Construction Site to minimize potential damage to the existing resources.
The Period of Performance for this Contract is 2-years and 1-month from the actual date of Contract Award. Above dates shown are tentative and subject to change. Actual Construction Duration will not exceed a 2-Month Construction Work Window. Contractor shall coordinate with the AFTC Manager and/or Project Leader for a Proposed Construction Work Window. The Final Accepted Construction Work Window will be mutually agreed to between the Contractor and USFWS AFTC prior to Construction.
Conditional Letter of Map Revision (CLOMR) and Letter of Map Revision (LOMR).
The USFWS is in the process of obtaining Construction Authorization and Approval from the Federal Emergency Management Agency (FEMA) and Cowlitz County as part of FEMA�s Floodplain Management Permit.
Please note, the Contract Notice to Proceed with On-Site Work will not be provided at Contract Award. It is estimated, the FEMA Floodplain Management Permit will be acquired in 12 months from the date of Contract Award with a Notice to Proceed estimated to be provided at the end of the 12 months period and after receipt of the Permit Conditional Approval Letter and Authorization for Construction Start.
2.3 Normal duty hours Monday thru Friday 7:00 a.m. - 4:00 p.m. In the event of emergencies, Contractor shall provide contact information.
2.4 Non-duty hours include week nights, weekends, and Government holidays (New Year�s Day, Martin Luther King JR.s�s Birthday, Memorial Day, Independence Day, Labor Day, Columbus Day, Veteran�s Day, Thanksgiving Day, Christmas Day).

4.0. BACKGROUNDS.
The Abernathy Fish Technology Center (AFTC) is owned and operated by the U.S. Fish and Wildlife Service (USFWS). It is located approximately 16.2 miles northwest of Longview, Washington. The nearest major city / town is Longview, Washington. The AFTC has identified the requirement for Rehabilitation of the Existing Intake Structure and Fish Ladder Structure and All Associated Appurtenances as noted in the 100% Final Draft Construction Documents.
The Rehabilitate and New Construction Work includes but is not limited to the following Elements:
Permitting.
Development, Preparation, and Submittal of Any Remaining Construction Operating Permit Applications and Supporting Documents for:
County and Local Building Permits (If Required).
Structural, Mechanical, Plumbing, and Electrical Permits and Inspections. Permits (If Required).
Inspections (Required).
Storm Water Pollution Prevention Plan (SWPPP) Permits.
Refer to Specific Conditions and Requirements for the Construction General Permit (CGP) administered by the EPA and the Construction Storm Water Permit (CSWP) administered by the Washington Department of Ecology and implement those specific conditions and requirements.
Mobilization and De-Mobilization.
De-watering and Construction Staging.
Establishment of Lay Down / Storage Areas and Work Areas.
Installation of Site, Sediment, and Erosion Control Measures.
Demolition, Removal, Recycling, and/or Disposal of Items Selected for Demolition.
Re-grading and Site Restoration.

5.0. SCOPE OF WORK.
Remaining Permits and Construction Operating Permits.
Pre-Demolition and Pre-Construction Permitting. Development, Preparation, and Submittal of Remaining Permit Applications and Supporting Documents to the Permit Agencies / Permit Authorities for Review and Approval / Disapproval and Follow-up Inspections for In-Progress and Completed Work. Contractor shall be responsible for Identification of Remaining Permits and Construction Operating Permits through a Permit Registry. After identifying Remaining Permits and Construction Operating Permits, the Contractor shall apply for, Pay, and Secure the Permits to result in successful project delivery.
Washington Department of Fish and Wildlife (WDFW) Hydraulic Project Approval (HPA) Permit Status and Conditional Approvals.
At this point in time, the U.S. Fish and Wildlife Service has developed, prepared, and submitted an HPA Application and Supporting Documents to the Washington Department of Fish and Wildlife (WDFW). The WDFW has submitted in response, the HPA and Conditional Approval Letter on December 15, 2021. The Conditions noted in the HPA Conditional Approval Letter apply to the Awardee Contractor selected for Contract Award. The Awardee Contractor selected for Contract Award shall factor in the Permit Conditions and Requirements into their Scope of Work and Proposal. The HPA is valid through December 14, 2026, at which point if it is expired before Construction Finish, an HPA Permit renewal maybe required or Application for a New HPA Permit maybe required and as determined by WDFW.
State Environmental Policy Act (SEPA) Determination of Non-Significance.
The Abernathy FTC � Intake Structure and Fish Ladder Structure Improvements Project has had a SEPA Application submitted and the Project went through the SEPA review process. As a result of the review process, the Cowlitz County Department of Building and Planning has determined that the Proposed Project Action does not have a probable significant adverse impact on the environment. Additionally, an Environmental Impact Statement (EIS) is not required.
Biological Assessment.
The USFWS has previously contracted for Permitting Assistance Services and had a Biological Assessment Completed for the Abernathy FTC � Intake Structure and Fish Ladder Structure Improvements Project. Refer to Biological Assessment for specific findings and specific requirements to be adhered to during Project Construction.

USACE and JARPA Permit Status and Conditional Approvals.
At this point in time, the U.S. Fish and Wildlife Service has developed, prepared, and submitted the Joint Aquatic Resources Permit Application (JARPA) and Detailed Project Description (DPD). U.S. Army Corps of Engineers (USACE) has submitted in response, the Nationwide Permit (NWP) 3 Terms and Conditions, Certificate of Compliance Form with the Department of the Army Permit, and Nationwide Permit Authorization Conditional Approval Letter. The Conditions noted in the Conditional Approval Letter apply to the Awardee Contractor selected for Contract Award. The Awardee Contractor selected for Contract Award shall factor in the Permit Conditions and Requirements into their Scope of Work and Proposal.
Specifically, the Awardee Contractor selected for Contract Award shall assist the U.S. Fish and Wildlife Service with editing the Certificate of Compliance Form with the Department of the Army Permit. Editing includes but is not limited to inserting Project Work Notes when construction and restoration work is in the pre-construction status, in-progress work status, and work complete status.
Editing additionally includes developing and submitting photographs of pre-, in-progress, and post permit authorized work performed or to be performed, and development, preparation, and submittal of As-Build Drawings and Mark-Up Specifications for the Work Authorized by the Permits.
Cultural Resources.
A Cultural Resource Survey and Report were previously prepared for the Abernathy FTC � Intake Structure and Fish Ladder Structure Improvements Project. From the report, no surface or subsurface archeological resources were identified. Three historic resources were identified, but two of the three resources were previously determined to be not eligible for listing in the National Register of Historic Places (NRHP). The third resource is recommended to be not eligible for listing in the NRHP.
Endangered Species Act and Essential Fish Habitat.
A Consultation was performed for the Endangered Species Act (ESA) and for the Essential Fish Habitat (EFH) provisions of the Magnuson-Stevens Fishery Conservation and Management Act for the Proposed Action. Refer to NOAA Fisheries Letter for specific requirements including reasonable and prudent measures (RPMs) the NMFS considers necessary or appropriate to minimize the incidental take associated with this action, and sets forth terms and conditions that the USFWS must comply with to meet those RPMs.

The Conditions noted in the NOAA Fisheries Conditional Approval Letter apply to the Awardee Contractor selected for Contract Award. The Awardee Contractor selected for Contract Award shall factor in the Permit Conditions and Requirements into their Scope of Work and Proposal.
Specifically, the Awardee Contractor selected for Contract Award shall assist the U.S. Fish and Wildlife Service with meeting the RPMs for the Full Duration of the Project On-Site Work Activities.
The Contractor shall accomplish the following Tasks if awarded this Contract:
5.1. TASK 1. Field Verification Site Visit. Review of Existing Site Features and Existing Site Conditions. Document Review, Planning, Development, Preparation, and Submittal of Project Documents (Base).
Review Drawing Pages 1.0 through 32.0 and All Associated Contract Documents.
Perform a Field Verification Site Visit and Review Existing Site Features and Existing Site Conditions. [The General Contractor Management Team shall be required to Attend this Field Verification Site with USFWS.]
After Performing a Field Verification Site Visit, Develop, Prepare, and Submit General Requirement Specification Submittals under Division 01.
Develop, Prepare, and Submit Technical Specification Submittals under All Remaining Division Sections.
Deliverables:
(1) Electronic Copy of the Contractor�s Field Verification Site Visit Notes.
Submit as PDF and DOCX File Extensions.
Electronic Drawing Deliverables shall be submitted in DWG and PDF File Extensions and include the Color Table (CTB) File Extension for accurate plotting of the line weights in CAD. Deliverables other than Drawing Deliverables shall be submitted in PDF File Extensions and DOCX File Extensions when available.

5.4. TASK 4. Construct and Install De-watering System and determine locations for Construction Staging Areas (Base).
The Contractor shall perform De-watering of the Project Site as detailed on Construction Drawing Page C-200. After De-watering of the Project Site, the Contractor shall determine locations for Construction Staging.

Refer to 100% Final Draft Construction Documents for specific requirements, which may require adjustment to be performed by the Contractor before, during, and after on-site Work Activities.
Proposed Coffer Dam Dewatering System to be designed and installed by the Contractor according to recommendations outlined in the Contractor�s Geotechnical Report to be prepared by the Contractor�s Geotechnical Consultant either in-house or under subcontract to the Contractor under this project / contract.
Preliminary Minimum Coffer Dam Height is 218 Feet Elevation. Final Design Height of Coffer Dam System to be determined by Contractor's Dewatering System Designer / Professional Engineer either In-House or under Subcontract.
5.5. TASK 5. Provide and Install Site, Sediment, and Erosion Control Measures (Base).
The Contractor is responsible for complying with the National Pollutant Discharge Elimination System (NPDES) General Permit Waste Discharge Requirements for Discharges of Storm Water Runoff associated with Construction Activity.
Refer to 100% Final Draft Construction Documents (Drawings and Technical Specifications) for Initial Specific Requirements for Site, Sediment, and Erosion Control Measures, which may require Adjustment by the Contractor before, during, and after performance of On-Site Work Activities. The Contractor is responsible for providing All Necessary Ancillary and Design- Build Services for Installation of Project Site, Sediment, and Erosion Control Measures to be provided and installed under this Contract.
5.6. TASK 6. Perform Selective Demolition and Protect Existing Site Features and Structures (Base).

Demolish, Remove, and Dispose of Existing 14.45 Feet of Existing Weir Structure nearest the Fish Ladder.
Remove and Dispose of Existing Fish Ladder Stoplogs.
Recycle and Re-Use Stoplogs where able to and if the Stoplogs have not become rotted out or warped.
Remove and Dispose of Concrete Dividing Walls. Sawcut and grind smooth outside walls.

Provide and Install (2) New 30-Inch Diameter Supply Lines. Terminate Inlet of New 30- Inch Diameter Supply Lines at proposed location of Cone Screen Assembly Inlets and Pipe Connection Points. Terminate Inlets of New 30-Inch Diameter Supply Lines at New Transition Chamber Wall Penetration.
Provide and Install New Reinforced Concrete Topping Slab and Provide and Install New House Keeping Pad located above the New Reinforced Concrete Topping Slab and the (2) New 30-Inch Diameter Supply Lines.
Provide and Install Intake Structure Full Height Reinforced Concrete Retaining Walls as detailed on the Construction Drawings and Specifications.
Provide and Install 10-Inch Thick Reinforced Concrete Slab Walkway (Perimeter Slab) to allow for Access to the Intake Structure and Trash Rack and Cone Screen Structures.
Provide and Install Slide Gates at Supply Line Locations.
Provide and Install Structural Steel Framing and Grating Infill for Intake Structure Access.
Provide and Install All Associated Electrical and Mechanical Equipment to allow for operating the Cone Screen Assemblies, Lighting, and Flow Meter.
Provide and Install All Necessary Work to result in a 100% Contractor Turnkey Installation whether detailed or not detailed in the Construction Drawings and Specifications.
Constructed Permanent Works to be fully functional and operable.

5.7. TASK 7. Perform Site Restoration (Base).
Perform Site Restoration.
Construction of the New Intake Structure shall occur during the In-Water Work period noted on the drawings.
Stockpile Topsoil and Replace on surface 12 Inches Thick as part of Backfill Operation.
Rake smooth and provide hydro-seed cover drought tolerant seed mix on all new and disturbed soil areas.
Protect Existing Bank during Construction.
Integrate New Rip Rap Bank Sections smoothly into existing Bank Lines at interface.
Individually place Rip Rap Protective Armor on All Disturbed Banks during Construction.
Provide and Install New 2-Inch Layer of Crushed Rock in Existing Access Road from Intake to Abernathy Creek Road.
5.8. TASK 8. Construct and Install Electrical Service Connections for Controls Cabling, Power Cabling, and New Flow Meter (Base).
Refer to 100% Final Draft Construction Documents, Electrical Pages, for Specific Requirements.
5.9. TASK 9. Perform Special Inspections and Tests for the Full Duration of the Project (Base).
Perform Special Inspections and Tests for the Full Duration of the Project / Contract and as part of the Contractor's Quality Assurance and Quality Control Program and Plan (QA-QCPP).
Contractor shall Engage and Subcontract with a Third Party Materials Testing Company.

6.0. GENERAL REQUIREMENTS.
Contractor shall provide supervision, labor, materials, equipment, tools, construction equipment, machinery, inspection, testing, start-up, water, heat, utilities, transportation, and other facilities and services necessary for proper execution and completion of the Work, whether temporary or permanent and whether or not incorporated or to be incorporated in the Work.
6.1 Quality Assurance:
a. Contractor shall implement a Quality Assurance/Quality Control (QA/QC) Plan to verify products and services are free of errors or omissions. Use of Contractor�s internal QA/QC plan and procedures is OK; however, they shall be adapted to the specifics of this contract.

6.2 Submittal Reviews:
a. Contractor shall provide electronic submittals indicating Professional Engineer of Record and Contractor Approval. Distribute the response via email to the USFWS.
6.3 Communications:
a. Contractor shall direct contracting related inquiries in writing or electronically to the CO during the pre-solicitation, solicitation, and contract period of performance. Contractor shall direct technical-related inquiries in writing or electronically to the COR.
6.4 Initial Field Visit
a. After issuance of Contract Award, the USFWS shall arrange for an Initial Conference Call Project Kick-Off Meeting.

6.5 Subcontractors:
a. Contractor shall utilize general contractors and specialty subcontractors who are duly-licensed and well-qualified to perform the work, consistent with the contract documents.
Contracting officer may remove from the work any employee they deem incompetent, careless or otherwise objectionable. Refer to FAR Clause 52.236-5 for additional information.
b. Within fourteen (14) days after award of the contract, Contractor shall submit to the CO completed Standard Form (SF) 1413s for each subcontractor. Refer to FAR Clause 52.222- 11 for additional information.
c. Contractor shall obtain written approval from the SBA and USFWS Contracting Officer prior

6.6 Progress Schedules:
a. Prior to the pre-construction meeting, Contractor shall submit to the Fish Technology Center and COR for review and approval, a preliminary project schedule, in .pdf format. At a minimum, schedule shall consider the periods of performance of each task stated within the bid schedule.
b. Contractor shall update the schedule every two weeks. Progress schedules shall be submitted to the Fish Technology Center, CO, and COR. If at any time the contractor�s schedule shows any slippage in critical tasks or completion past the construction completion date, contractor shall narrate the reasoning for slippage and/or late completion.
6.7 Pre-construction Meeting:
a. After contract award and prior to commencement of work, the Fish Technology Center and COR will arrange for a pre-construction meeting at the Makah NFH Office. Contractor, along with their major subcontractors, shall attend the face-to-face meeting. Meeting is expected to take place within fourteen (14) days after issuance of the contract award and take no longer than two (2) hours.
b. Meeting will address the contract requirements and identify and resolve any ambiguities or discrepancies. In accordance with FAR 36.212 and FAR Clause 52.236-26, the conference shall discuss statutory matters such as labor standards (refer to FAR Subpart 22.4). Other topics include matters of significant interest, including who has authority to decide matters such as contractual, administrative (e.g. security, safety, and fire and environmental protection) and construction responsibilities.
6.8 Temporary Facilities and Utilities:
a. Contractor shall furnish all temporary utilities needed, except as noted otherwise. Facilities and utilities include but are not limited to: Heating, lighting, non-potable water, telephone, material handling equipment, temporary construction aids and storage enclosures. Refer to FAR Clause 52.236-10 for additional information.

b. No electrical power is available to the Contractor.
6.9 Diligence: Contractor shall perform all construction activities efficiently and with the requisite expertise, skill and competence to satisfy the requirements of the contract documents.
Contractor shall at all times exercise complete and exclusive control over the means, methods, sequences and techniques of construction. Refer to FAR Clause 52.236-5 for additional information.
6.10 Supervision: Contractor shall provide a Project Manager or Project Superintendent on-site at all times while work is underway. Manager or Superintendent shall have a good working knowledge of the project work. Refer to FAR Clause 52.236-6 for additional information.
6.11 USFWS Operations: USFWS operations have precedence over construction activities.
Contractor shall schedule and coordinate all construction and demolition activities so as not to unduly impact ongoing facility operations. Refer to FAR Clause 52.236-8 for additional information.
6.12 Security: Contractor shall effectively secure the worksite, staging areas and materials storage areas. The Government shall be held harmless from any liability resulting from the contractor�s negligence to provide effective security.
6.13 Construction Safety:
a. Contractor shall be ultimately responsible for health and safety on the worksite at all times.
Refer to FAR Clause 52.236-13 for additional information.
b. Contractor shall ensure that all onsite activities, equipment and facilities constructed by the contractor, subcontractor or supplier conform fully to the safety standards in Section 8.2 of the SOW.
c. Contractor shall provide barricades and warning devices as necessary to safeguard the public, workers and Government personnel. Where project work affects public roads, Contractor shall provide signage in accordance with the current edition of the Manual on Uniform Traffic Control Devices (MUTCD), as published by the U.S. Department of Transportation (USDOT) Federal Highway Administration (FHWA).

d. Contractor shall initiate and maintain, throughout the performance of this contract, an effective health and safety program that provides adequate policies, procedures, and practices to protect workers from (and allow them to recognize) job-related health and safety hazards.
e. The program shall include provisions for the identification, evaluation, prevention and control of general work site hazards, specific job hazards, and potential hazards that may arise from foreseeable construction methods and conditions, as well as providing a competent person to conduct frequent and regular inspections.
f. Each employee (Contractor or subcontractor) must be instructed in the recognition and avoidance of unsafe conditions and the regulations applicable to the work environment.
g. The contractor shall adopt the USACE Safety and Occupational Health (SOH) Program as a starting point for Safety Program requirements. In the event a more stringent Safety Program exists, the more stringent Safety Program shall be applied to the Contract / Project by the Contractor.
6.14 Site Cleanup: Contractor shall remove construction debris from the worksite daily, including debris within temporary facilities and storage areas. Before completing the work, Contractor shall remove from the worksite any rubbish, tools, scaffolding, equipment and materials that are not the property of the Government. Upon completion of work, Contractor shall leave the work area in a clean, neat and orderly condition. Refer to FAR Clause 52.236-12 for additional information.
6.15 Material, Equipment, Transportation, Handling and Storage:
a. Government-owned equipment will not be made available to the Contractor for use within this contract. Government buildings and other facilities are not available for storage of the Contractor�s materials, equipment and tools.
b. Contractor shall have a representative onsite to receive material deliveries. Contractor shall be responsible for all material deliveries, whether or not their representative is on-site at the time of delivery or not.
c. Contractor shall transport, handle and store materials and equipment in a secure manner and in accordance with the manufacturer�s written instructions.

d. Contractor shall promptly remove from the worksite any material(s) and equipment which are damaged or are otherwise unsuitable. Refer to FAR Clause 52.236-5 for additional information.
6.16 Construction Waste:
a. Minimize creation of construction, deconstruction, and demolition waste.
b. Minimize factors that contribute to waste such as over-packaging, improper storage, ordering error, poor planning, breakage, mishandling, and contamination.
c. Develop a Waste Management Plan to ensure any existing or new materials/equipment/substances are properly characterized, reused, salvaged, recycled, and/or disposed of properly.
d. Any regulated quantities of hazardous materials shall be disposed of at disposal facilities specifically licensed to accept hazardous waste.
e. Dispose of any materials (not salvaged, reused, or recycled) in a legal manner off-site, in licensed disposal facilities.
f. Contractor shall actively protect the natural environment and human health by using environmentally preferable products in their activities.
g. The Contractor wherever possible shall divert solid waste from disposal in landfills through recycling and reuse of materials to lower greenhouse gas emissions.
7.0. GOVERNMENT FURNISHED ITEMS.
No Government Furnished Material or Government Furnished Equipment will be provided.
7.1. General: The Contractor shall furnish all supplies, equipment, facilities and services required to perform work under this contract.
7.2. Materials: The Contractor shall furnish all materials, supplies, and equipment necessary to meet the requirements of this contract.

7.3. Equipment: The Contractor shall furnish all required equipment to meet the requirements to perform work under this contract.
Government Furnished Information:
7.4 Construction Drawing Number 1F-WA-X-X provided as part of the Solicitation.
7.5 Construction General and Technical Specifications provided as part of the Solicitation and as a Project Manual to be used in close coordination with Construction Drawings.
8.0. CODES AND STANDARDS.
8.1 Technical Standards: All work shall be done in accordance with all applicable International Code Council (ICC) Codes (e.g. International Building Code (IBC), International Plumbing Code (IPC)), NFPA 70 (National Electrical Code®) and NFPA 101 (Life Safety Code®), as well as other applicable State or local regulations. In the event of a conflict, the most stringent laws, codes, regulations, standards, and provisions shall apply.
8.2 Safety Standards: Contractor shall adhere to Occupational Safety and Health Administration (OSHA) 29 CFR 1910 and 1926, as well as other applicable DOI, USFWS, State and local regulations. In the event of a conflict, the most stringent laws, codes, regulations, standards, and provisions shall apply. Refer to FAR Clause 52.236-13 for additional information.
9.0. INSPECTION AND ACCEPTANCE.
9.1 Inspection and acceptance will be determined by the USFWS. Refer to FAR Clause 52.246- 12 for additional information.
9.2 The Work is subject to observation and inspection by the USFWS and other authorities with jurisdiction.
9.3 Acceptance of the work is contingent on compliance with the requirements set forth in the specifications, drawings, and other documents awarded with (or referenced by) the contract for this project.

10.0. FINAL WALK THROUGH.
10.1 Submit a preliminary list of unfinished work and notify the USFWS at least ten (10) calendar days prior to the anticipated date of completion of unfinished work.
10.2 The USFWS will perform the final walk through as promptly as practicable.
10.3 The time required for such walk through and for making any corrections as a result thereof shall be included in the contract performance time.
10.4 The Contractor�s representative responsible for the work shall be present at the final walk through.
11.0 CLOSEOUT DOCUMENTS.
11.1 Submit any requested regulatory-agency clearance documents indicating the work complies with their requirements such as finalized plumbing/gas/electrical inspections.
11.2 After completion of the work and prior to final payment, submit a Release of Claims (Form
DI-137 provided by the Contracting Officer), properly executed by the Contractor, releasing claims against the United States arising out of this contract, other than claims specifically excepted from the operation of the release.
12.0. INVOICE AND PAYMENT.
12.1 General: Contractor shall not invoice between September 20th and October 20th, due to the seasonal financial system closure.
12.2 Progress Payments: Monthly progress payments shall be invoiced and submitted in accordance with Clause 52.232-70. Invoices shall reflect the actual work performed at the time of submission. Prior to submitting invoices, they shall be sent to the COR for review and approval / disapproval.
12.3 Final Payment: Final payment shall be invoiced and submitted in accordance with Clause 52.232-70. Prior to submitting the final invoice, Contractor shall have submitted all

13.0. GOVERNMENT AVAILABILITY.
13.1 Government is available Monday thru Friday from 7:30 AM to 5:00 PM (Pacific Daylight Time), excluding Federal Holidays. Availability outside those dates / hours shall be coordinated with the Hatchery at least two business days in advance.
13.2 Work shall be performed during work hours agreed to by the Fish Technology Center and
Contractor.
14.0. WORK HOURS.
14.1 Work shall be performed between Monday thru Friday, 7:30 AM to 4:00 PM (Pacific
Time), excluding Federal Holidays. Work outside those dates / hours shall be coordinated with the Refuge Manager at least two business days in advance.
14.2 Weekend work shall be approved by the Hatchery Manager.
14.3 USFWS escort required unless previously arranged with the Service.
