GXI Instrument Implementation Draft RFP Q&A
Additionally, section H.10 states: “The default clause under this contract is FAR 52.227-14 Rights in Data- General-Alternate II and Alternate III as modified by NASA FAR Supplement 1852.227-14 and GSFC 52.227-90. Any exceptions to this clause will be covered by FAR 52.227-17 RIGHTS IN DATA— SPECIAL WORKS, if applicable, and GSFC 52.227- 93.”
With respect to H.10 quoted above, please advise in what circumstance an exception to the default data rights clause (identified as FAR 52.227-14) would apply (where FAR 52.227-17 RIGHTS IN DATA- SPECIAL WORKS would apply rather than FAR 52.227-14)? Exceptions are mentioned, however, not described or defined. For instance, if the contractor asserts certain data is Limited Rights Data, in what circumstance would an “exception” apply which would impact the contractor’s Limited Rights Data assertion?
7 GXI Draft RFP 80GSFC22R0044
The immediate procurement does not qualify as a Special Works Contract per the guidance under FAR 27.409(e) and 27.405-1. We respectfully request that FAR 52.227-17 and references thereto be removed from the solicitation.
We cannot agree to this clause without additional understanding of its applicability and discussion with our subcontractors (once its applicability is understood), given the possible impact of 52.227-17 which restricts use of program data.
Please provide guidance on the applicability of FAR 52.227-17, specifically the release and use restrictions referenced in subsection (d). In what circumstances would use, release, reproduction, distribution or publication of data first produced in the performance of this contract be restricted?
The removal of FAR clause 52.227-17 and corresponding clause 52.227-93 will be reflected in the final RFP.
GXI Draft RFP 80GSFC22R0044 Section L.14
Please clarify the term "total estimated value" in paragraph 3 on page 110.
Is this the n estimated value of subcontracts or total estimated value of the entire GXI contract?
Is value equivalent to price or cost?
It is the total estimated value of subcontractors which is equivalent to cost.
9 GXI Draft RFP 80GSFC22R0044 Section L.14
States in paragraph 1 on page 109: “It is expected that adequate price competition will be obtained under this solicitation so that submission of certified cost or pricing data is not required pursuant to FAR 52.215-20…”.
Given the solicitation states that adequate price competition is expected at the prime level and cost and pricing data will not be required, please provide explanation as to why Exhibits 1 through 4, 8A/B, and 9A/B/C are still required for each subcontractor?
Insight into major subcontractor work is needed for the government to do a proper evaluation.
10 GXI Draft RFP 80GSFC22R0044 Section L.14
Given the expedited nature of this proposal, in lieu of Exhibits 1 through 4, 8A/B, and 9A/B/C being submitted in the proposal phase for Significant Subcontractors, can simplified supplier proposals be provided during the proposal phase?
No, simplified supplier proposals cannot be provided during the proposal phase.
11 Attachment A – SOW Regarding GXISOW489 and SOW743, for non-recallable door opening mechanisms, is a single plateau operation demonstration acceptable?
Re-closable door openings need to be demonstrated at both cold and hot.
12 Attachment B - PORD GXIPORD710 – 712 provide new requirements for fracture analysis. Do these new requirements apply to TRL9 hardware?
Yes, however; applicable previous analysis is acceptable.
13 Attachment E - IMAR Please provide “GPR 8730.5 Safety and Mission Assurance Acceptance of Inherited and Build-to- Print Products” for review.
GPR 8730.5 is a reference document, attached to this Q&A.
14 Attachment O – CWBS and Cost Exhibits
The CWBS and WBS elements in Attachment O and the Cost Exhibits are different. Attachment O has “Special Tasks” and “Long Term Support” elements and the Cost Exhibits have a Mission Ops element but not the Special Tasks and Long Term Support.
Can the Government provide final clarification as to the naming preference (Mission Ops vs Long Term Support) and inclusion of the elements between the documents (include Special Tasks in the Cost Exhibits)?
The consistent naming conventions update will be reflected in the final RFP.
15 Attachment P - Radiance Upwelling Document
Please provide the underlying data file supporting 417-R-RPT-0076 plot in Attachment P.
The data file will be added to the Radiance upwelling and will be posted with the Final RFP.
16 GXI Draft RFP 80GSFC22R0044 Section E.5
Request the Government clarify/define when acceptance will occur for deliverable items.
For example, below the table in Section E.5 annotate “Acceptance of FM 1-5 will occur after the successful completion of PSR.”
Acceptance of the FM1-FM2 will occur after successful benchmark test at the spacecraft factory. The same will apply for FM3-FM4, if Option 1 and Option 2 are exercised. Acceptance of FM5 will occur after the successful completion of pre-storage review.
17 Attachment A – SOW In GXISOW98, there appears to be an incorrect reference. GXISOW98 currently refers to "Contract Clause H.13" and we believe it should reference “Contract clause H.14”. Please clarify.
The correct reference will be reflected in the Final
RFP.
18 Attachment A – SOW There appears to be repeat guidance/information between GXISOW165 and GXISOW168, as well as GXISOW166 and GXISOW169. Please clarify.
GXISOW165 and GXISOW166 are for pre storage, as applicable for the respective Flight Model. GXISOW168 and GXISOW169 are for pre-ship review.
19 Attachment B - PORD There appears to be an incorrect reference in GXIPORD179. The requirement for the 0.64 micron low light channel currently references GXIPORD101, which is specific to channels greater than 3 microns.
This was in error. The correction will be made in the Final RFP.
20 Attachment B – PORD During Phase A the acceptable lossless compression methods were updated with CCR-X00036A to include the possibility of using either CCSDS122.0-
B-2 or CCSDS 121.0-B-3. The Draft RFP GXIPORD292 now excludes the use of CCSDS 121.0-B-3. Please clarify if the intent is to change away from the requirements that were provided during Phase A.
21 Attachment D – UIID
In GXIUIID5, there appears to be a typo and that "GXIy" should be "imagery". Please clarify.
22 Attachment F – CDRL Section 3.4.5.3
The CDRL definition GXICDRL1032 for SE5-3 specifies to measure polarization sensitivity for all channels less than 3 microns. PORD284 only specifies a polarization sensitivity requirement for channels with wavelength less than 2 microns (no requirement specified for 2.25 micron band). Do we need a polarization sensitivity test for the 2.25 micron band that has no specified requirement, or should the CDRL say "shall provide measure polarization sensitivity for all channels less than 2 microns"?
CDRL is correct, measured data is needed for channels under 3 microns.
23 Attachment A – SOW Section 1.0-4a
GXI Draft RFP 80GSFC22R0044 Section H.13
The material for the first 4 flights will be procured on the base contract (procurement start in 2023/2024 which covers the material for Option 1 and 2) and Option 3 ATP will be exercised on 9/2032. Material for the Option 3 (Flight 5) could be at risk if not procured with the bulk material buy with flights F1 thru F4. This will create a procurement gap of approximately 10 years. This can introduce an obsolescence, redesign risk, co-mingled lots, cost and schedule impacts. With the current industry, it will be tough to getting quotes 10 years out.
Recommend all material to be purchased on the base on contract for EDU, F1 thru F5.
Acknowledged. No change required.
GXI Draft RFP 80GSFC22R0044 Section G.2
"Provisional award fee payments will not be made under this contract pending each interim evaluation."
Provisional payments will not be made during the award fee period. Interim payments will be made at the end of each evaluation period. Therefore, Enclosure A – Draft PEP
Attachment H – Financial Reporting Requirements Sections 10 and 11
"The amount of the interim award fee payment is limited to the lesser of the interim evaluation score or 80 percent of the fee allocated to that period less any provisional payments made during the period."
and "In accordance with G.2, Award Fee for End Item Contracts, provisionally paid fee will be the lesser of the interim evaluation score or 80% of the fee available for that period."
Please clarify the provisional award fee terminology in the referenced sections.
section 10 of Attachment H, Financial Reporting Requirements does not apply since we do not authorize provisional payments. Section 11 of Attachment H does apply. The PEP will be updated to reflect that no provisional fee payments will be made under this contract.
25 Attachment O – CWBS and Cost Exhibits
Where does Flight model 05 fit into the CWBS structure?
The update will be reflected in the final RFP.
26 GXI Draft RFP 80GSFC22R0044 Section H.14
How is the reservation of $35M of task order activity scored with the total evaluated price?
The special studies are part of the overall price and not scored separately. It has no impact on the evaluated price.
27 Attachment F – CDRL Section:
GXICDRL1329
3.8.1.1.0-7
Two sets of alpha-numeric call-outs (a thru f and a thru h). First set appears to be in error and not associated with Mission Assurance Implementation Plan (MAIP).
Correction to the CDRL will be reflected in the final RFP. No change in due dates.
28 Enclosure A – Draft PEP Why was PDS identified as a separate fee pool? Is it due to the fact that the final evaluations are being conducted at successful completion of the Pre- Storage/Pre-Ship Review?
PDS is separate because there is no look-back option. PDS fee is final at each fee period as opposed to the flight model fee which is interim at each fee period until the final evaluation is complete (for each FM unit).
29 Attachment F – CDRL Section 3.2.5
The IMS is already provided as part of RM-03 IPMR Format 6. Why is a duplicate CDRL identified?
Only one IMS delivery per month is expected.
CDRL RM-05 specifies in detail the requirements for the IMS that will be delivered as part of RM-
03. Note, the reference to RM-06 in RM-03 format 6 is incorrect and should refer instead to RM-05.
Correction will be reflected in the final RFP.
30 Attachment B – PORD Section:
GXIPORD164
3.2.2.1.0-3
Performance requirements for SNR have been degraded significantly from ABI for channels 470nm, 640nm, 865nm. What is the rationale for reducing SNR while improving the GSD requirement in these bands?
These relaxations were developed in close consultation with the GeoXO Requirements Working Group (XORWG) and data products user groups. They are considered acceptable for long-term user community needs for the duration of the GeoXO mission.
31 Attachment B – PORD Section:
GXIPORD164
3.2.2.1.0-3
Would the government consider both threshold and objective requirements, with the objective requirements being the heritage ABI SNR/NEdT?
The NEDT requirements were developed in consultation with the XORWG and user community and represent the priorities of the user community needs.
32 Attachment F – CDRL Section GXICDRL783
There are multiple CDRLs that reference a scanning instrument architecture.
GXICDRL783 error will be corrected in the final
RFP.
33 Attachment A – SOW Section GXISOW320
Is there existing hardware/MSTE/OSTE/ESTE available for use on the GXI program that could be used for an EDM?
The Government does not intend to provide any GFP. The Vendors should assess the need for an EDM based on the inherent risk in their design.
34 Attachment D – UIID Section GXIUIID77
Can this exported acceleration curve be modified to accommodate multiple cooler offerings?
Exported acceleration tables in GXIUIID77 will be amended with a TBR in the final RFP.
35 DRFP Cover Letter A proposal this large and along with the current COVID conditions we request the Government to extend from 30 days to 60 days.
Any extension considered will be reflected in the final RFP.
36 GXI Draft RFP 80GSFC22R0044 Section L.15
Regarding Exhibit 10 (Past Performance Questionnaire Instructions), please clarify the limitations and intent around the term “customers” in the following sentence:
“If possible, the Offeror and any proposed significant subcontractor(s) shall provide questionnaires to customers from NASA contracts, other Government contracts, and commercial contracts.”
The term “customers” refers to any Government or commercial entity with direct knowledge of the firm's performance under the affiliated contract.
37 Section L.14 Can DCMA assist audits be requested to support pre-award negotiations for fair and reasonable price justification?
Any necessary audit request will be requested by the Government.
