GXI Instrument Implementation Final RFP 80GSFC22R0044

Questions and Answers

7 Final RFP, Section L.10(b) includes a table summarizing proposal component page limitations. The Cost Volume Page Limitation is identified as “Mixed”, however, all identified subsections have Page Limitations identified as “None”. Was one of these subsections intended to have a Page Limitation?

The identified subsections were not intended to have a page limitation.

Final RFP, Section L.15(a) – Can the Government please confirm the timeframe of interest for past/current contract references is seven (7) years of the RFP release date? If this is not the case, can the Government please identify the desired timeframe?

In accordance with Section L.15(a), Prime Offerors shall furnish the information requested for all of your most recent contracts (completed and ongoing) for similar efforts that your company has had within the last 7 years of the RFP release date.

9 Final RFP, Section H.13 – Should the $35,000,000 for Special Task Support Requirements be submitted as part of the Cost Volume?

Yes, the $35M for Special Task Support Requirements should be submitted as part of the Cost Volume, but for Exhibit 3 only. The cost exhibit and section L.14(b)(4) will be updated to reflect this change.

Amendment 1 will reflect this update.

10 Final RFP Section C.3 and Section H.4 – is the Final Report due within 30 days or 90 days after completion of the contract?

The Final Report is due within 30 days after completion of the contract.

Section H.4 will be updated to reflect this change.

Amendment 1 will reflect this update.

11 Why is NFS 1852.227-84 PATENT RIGHT CLAUSES (APR 2015) included in Final RFP, Section L.1 when FAR 52.227-11 is not included in the Final RFP (see NFS 1827.303(a) prescription)?

Based on the prescription, NFS 1852.227-84 applies to a small business or non-profit organization. Therefore, this clause will be removed from the solicitation.

Amendment 1 will reflect this update.

12 The Government’s responses to the Draft RFP Q&A provided 12 Aug 2022, specifically numbers 6 and 7, stated “The removal of FAR clause 52.227-17 and corresponding clause 52.227-93 will be reflected in the final RFP.”

Therefore, why is the following sentence included in the Final RFP, Section H.9 GSFC 52.227-99 RIGHTS IN DATA (NOV 2018)?

“Any exceptions to this clause will be covered by FAR 52.227-17 RIGHTS IN DATA--SPECIAL WORKS, if applicable, and GSFC 52.227-93.”

The following sentence in section H.9, GSFC 52.227-99 RIGHTS IN DATA will be removed from the solicitation:

“Any exceptions to this clause will be covered by FAR 52.227-17 RIGHTS IN DATA--SPECIAL WORKS, if applicable, and GSFC 52.227-93.”

Amendment 1 will reflect this update.

We respectfully request the above sentence be removed from the Final RFP, Section H.9 GSFC 52.227-99 RIGHTS IN DATA (NOV 2018)

13 Why is FAR 52.227-11 referenced in Final RFP, Section B.1, Item 32 (Reporting of Inventions) when this clause is no longer included in the Final RFP?

FAR 52.227-11 will be removed from Section, B.l, Item 32 (Reporting of Inventions).

Amendment 1 will reflect this update.

14 Can the Government include FAR 52.243-7 NOTIFICATION OF CHANGES (JAN 2017) in the Final RFP? If not, why?

Based on the prescription, clause 52.243-7 is applicable to this procurement.

Therefore, clause 52.243-7 will be incorporated into the solicitation.

15 Final RFP, Section L.15(a) instructs the Offeror to provide a “Statement of contract past safety performance and a record of your company’s OSHA recordable injuries and illnesses for the past 3 years.”

What is considered as included in the term “safety performance”?

Are the “OSHA recordable injuries and illnesses” related only to either

(1) the contracts that are required in the Past Performance Volume or (2) our specific company location / CAGE Code?

What is considered a “recordable illness”?

Please review OSHA’s guidance as to what constitutes a reportable illness and the term safety performance.

16 In regards to Final RFP, Section H. 8 requirements:

Planned System Safety CDRLs for the GXI program include MA 3-1 which has a reporting requirement within the document of 24 hrs for notification of a type C or D incident (depending on the severity of the incident A or B is specified as prompt and within 1 hr of incident) as specified in IMAR Attachment E and NPR 8621.1. The Final RFP, Section H. 8 requirement is over and above that reporting requirement. Where and why is this necessary for the System Safety

The NASA FAR Supplement requires verbal notification and written communication within 24 hours in addition to the IMAR requirements.

Code 360 requiring immediate notification of incidents by phone and then follow up by inputting data into the NASA Mishap Reporting System? In addition, per the CDRL MA 3-1 reporting of incidents will take place utilizing NASA form NF-1627.

In addition, subsection B submitting a monthly report for incidents we believe is already being reported during MSR and man hrs worked is more a business management reporting than System Safety.

What is the necessity for the additional information requested in Final RFP, Section H.8?

Final RFP, Section L.14:

The GXI Final Solicitation confirms that certified cost or pricing data is not required due to adequate price competition.

With respect to the requirement for significant subcontractors to submit completed Exhibits 1 through 4, 8A/B, and 9A/B/C, please advise if significant subcontractors who are competitively sourced by the prime contractor will be held to a different standard, while considering the following FAR reference:

FAR 15.403-3(b): When adequate price competition exists (see 15.403- 1(c)(1)), generally no additional data are necessary to determine the reasonableness of price.

The nature of the competitive procurement (between potential significant subcontractors) does not give rise to “unusual circumstances” that would drive the need to obtain any additional cost/price data to determine price reasonableness, because the item procured is the same product.

What data in lieu of Exhibits 1 through 4, 8A/B, and 9A/B/C would be acceptable for a competitively sourced subcontractor?

In accordance with Section L.14, a proposed Significant Subcontractor shall complete Exhibits 1 through 4, 8A/B, and 9A/B/C and provide the same supporting information that is requested from the Prime Offeror regardless of how it is sourced.

Insight into major subcontractor work is needed for the Government to do a proper evaluation.

18 Final RFP, Section L.14:

The GXI Final solicitation confirms that certified cost or pricing data is not required due to adequate price competition.

With respect to the requirement for significant subcontractors to submit completed Exhibits 1 through 4, 8A/B, and 9A/B/C, please advise if significant subcontractors supplying commercial products will be held to a different standard, while considering the following FAR references.

Per 15.403-3(b) When adequate price competition exists (see 15.403- 1(c)(1)), generally no additional data are necessary to determine the reasonableness of price.

Per 15.403-3(c)(1) At a minimum, the contracting officer must use price analysis to determine whether the price is fair and reasonable whenever the contracting officer acquires a commercial product or commercial service (see 15.404-1(b)).

Per 15.404-1(b)(1) Price analysis is the process of examining and evaluating a proposed price without evaluating its separate cost elements and proposed profit.

15.403-3(c)(2)(i) The contracting officer shall limit requests for sales data relating to commercial products or commercial services to data for the same or similar items during a relevant time period.

15.403-3(c)(2)(i) The contracting officer shall, to the maximum extent practicable, limit the scope of the request for data relating to commercial products or commercial services to include only data that are in the form regularly maintained by the offeror as part of its commercial operations.

The nature of a commercial procurement from a significant subcontractor does not give rise to “unusual circumstances” that would drive the need to obtain any additional cost/price data to determine price reasonableness, because the item procured is commercially offered for sale.

What data in lieu of Exhibits 1 through 4, 8A/B, and 9A/B/C would be acceptable for a supplier offering commercial products?

19 If a program similar in scope and complexity is a classified program, can the offeror submit a classified Past Performance addendum at Sensitive Compartmented Information (SCI) level? If approved, please provide a NASA point of contact and the process for submitting the classified addendum.

The Government will not accept classified past performance references.

20 If classified Past Performance addendum(s) are not permitted, would past performance information for unclassified programs, with similar scope and complexity, with a total cost/fee incurred between $200M and $375M be acceptable?

Amendment 1 will reflect an update to the threshold for prime offerors contract references. The new threshold will be $200M.

21 The award fee for Pool 7 is associated with Option 2. How is the final evaluation conducted should Option 2 not be awarded?

Pool 7 will be finalized at Critical Design Review (CDR) regardless of which options are on contract.

22 How is the fee managed within the PEP regarding G.0 Special Tasks and H.0 Long Term Support?

Special task fee will be included in the FM pools for which the work is done. If Special task orders are worked on after all FM pools are finalized, it will become part of Post Delivery Support.

Inconsistencies in the Attachment O:

Page 3 notes Systems Engineering as X.02 yet page 4 example assigned X.02 to Mission Assurance. Page 3 notes Mission Assurance as X.03 yet page 4 example assigned X.03 to Systems Engineering. How does NASA want us to bid?

Page 2 notes Mission Operations as H yet page 4 example shows H.0 as Long Term Support. Which terminology should be used for CWBS Level 2 (H)? Please advise as this will change our pricing structure.

Attachment O will be updated to correct the inconsistencies.

Amendment 1 will reflect this update.

24 Section C.3(d) and Section H.4(c), indicate a conflicting number of days (30 and 90, respectively) for submission of the Final Report after contract completion

The Final Report is due within 30 days after completion of the contract.

Section H.4(c) will be updated to reflect this change.

25 Section L.14(b) the following two sub paragraphs are marked (11):

BASIS OF ESTIMATES (BOE)

PRIME OFFOROR AND SIGNIFICANT SUBCONTRACTOR DCAA

AND DCMA INFORMATION

Section L.14(b) will be updated to correct the typo.
