About this file
This is a Buy America Certification form issued by the Federal Transit Administration (FTA) for use by Broward County, Florida in connection with FTA-funded procurement contracts. The certification applies to the acquisition of steel, iron, and manufactured products for transit shelters and amenities. Bidders and offerors are required to submit the completed certification form with all bids or proposals on FTA-funded contracts unless a general waiver has been granted by the FTA or the product is subject to an existing general waiver. The form is not applicable to rolling stock procurements. Bids or offers that are not accompanied by a completed Buy America Certification will be rejected as nonresponsive.
The certification provides two options for bidders: certification of compliance with Buy America requirements under 49 USC 5323(j)(1) and 49 CFR part 661, or certification of non-compliance with a statement that the bidder may qualify for an exception pursuant to 49 USC 5323(j)(2) and 49 CFR 661.7. Each certification option requires the authorized signature, printed name, title, and company name of the bidder's representative, along with the date of submission. General waivers applicable to Buy America requirements are listed in 49 CFR 661.7, and additional information regarding FTA's Buy America regulations is available at https://www.transit.dot.gov/buyamerica.
