About this file

This is a Justification for Other Than Full and Open Competition (JOFOC) document issued by the Department of Transportation, Federal Highway Administration, Central Federal Lands Highway Division (CFLHD) in Lakewood, Colorado for a contract to procure concrete colorants, trash receptacles, delineators, and benches for a National Park.

The solicitation requires four categories of single-source products that must match existing park infrastructure. For concrete colorants, the agency specifies Davis #641 Sequoia Sand (manufactured by Davis Paint in North Kansas City, Missouri) for the majority of work and Solomon Color, Color Flo #920 Onyx (manufactured by Solomon Colors in Springfield, Illinois) for remaining portions. Trash receptacles must be Bear Saver Model HB1G-UP in Forest Brown (manufactured by Bear Saver in Guasti, California), which is identified as the only manufacturer of this specific model. Benches comprise two types: limestone benches consisting of Kasota Stone Seat Blocks, Kasota Blend (manufactured by Kasota Stone in Mankato, Minnesota) and steel benches identified as Lemars Series Ribbed park bench #LB72, 6'0" in Rapid Tan (manufactured by Petersen Manufacturing Company in Denison, Iowa). The justification cites that competition is not possible because these products are only available from their respective single manufacturers and are necessary to maintain visual consistency and the historic and cultural landscape of the park. The JOFOC will be posted on SAM.gov for a minimum of 30 days alongside the solicitation, and the contracting officer certifies fair and reasonable pricing will be confirmed through thorough bid analysis.

FEDERAL HIGHWAY ADMINISTRATION

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

1. Identification of the agency and the contracting activity

Department of Transportation, Federal Highway Administration, Central Federal Lands Highway Division (CFLHD), 12300 Dakota Avenue, Lakewood, Colorado.

2. Nature and/or description of the action being approved

Justification and approval to use other than full and open competition to award a contract for concrete colorants, trash receptacles, delineators and benches.

The National Park Services (NPS) has requested that all color for concrete match the two existing colors within the Park. The majority will be Davis #641 Sequoia Sand and the rest will be Solomon Color, Color Flo # 920 Onyx. The NPS has used these colors on other portions of the Park and require the new concrete to match the existing conditions exactly.

6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized

The Justification for Other than Full and Open Competition will be posted with the solicitation as required by FAR 5.102(a)(6). The solicitation will be posted on the Government Point of Entry, SAM.gov, for a minimum of 30 days. It will also be solicited as full and open competition, allowing maximum competition.

7. Determination that the anticipated cost to the Government will be fair and reasonable

The FHWA will ensure that all costs associated with the proposed contract are fair and reasonable. The FHWA will perform a thorough analysis of the Offeror’s bid and/or proposal to substantiate this determination.

8. Description of the market research conducted and the results or a statement of the reason market research was not conducted

The above requested items are currently in use within the Park and are the only items that will match the existing features.

9. Other facts supporting the use of other than full and open competition

The Park is concerned that if other types of benches, delineators and trash receptacles are allowed it will have an impact to the visitors and to the historic and cultural landscape. In addition, existing concrete within this unit of the park is colored with the two colors included above. Not using these curb and gutter/sidewalk and curb ramp colors would have visual impacts to the park.

10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.

None.

11. Statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

None.

I certify that the information provided in this justification is complete and accurate to the best of my knowledge and belief.
