Re: Notice of Intent – Sea Street Corridor Improvements Sea Street, Quincy, MA

Dear Mr. Graeber and Commissioners:

On behalf of the City of Quincy Department of Public Works, in conjunction with the Massachusetts Department of Transportation Highway Division (MassDOT), BETA Group, Inc. (BETA) is submitting a Notice of Intent (NOI) for the work associated with corridor improvements along an approximately 0.82-mile segment of Sea Street (the Project) between Samoset Avenue and Pequot Road in Quincy, Massachusetts (the Site). The Sea Street corridor and its intersections with Samoset Avenue, Narragansett Road, Norton Road, Moffat Road, Curlew Road, and Palmer Street have safety and operational deficiencies which require improvements for safe and efficient operation for all users, including motorists, bicyclists and pedestrians. Proposed work will generally involve reconstruction of existing sidewalks, construction of new sidewalks, inclusion of bicycle accommodations, implementation of traffic signalization and intersection geometry improvements, construction of municipal stormwater management system improvements, and both mill and overlay and full depth construction of pavement.

Work associated with the Project will take place within Areas Subject to Protection and Jurisdiction under the Massachusetts Wetlands Protection Act (M.G.L. ch.131 s.40) and its regulations at 310 CMR 10.00 (the Act), as well as the City of Quincy Wetlands Protection Ordinance (Chapter 349 – the Ordinance) including Land Subject to Coastal Storm Flowage (LSCSF). The Project has been designed to support the interests of the Act and the Ordinance as they relate to LSCSF. Proposed work constitutes review as a Redevelopment Project under the Stormwater Management Standards.

This NOI has been concurrently submitted to the Massachusetts Department of Environmental Protection (MassDEP) Northeast Regional Office and Project abutters have been notified in accordance with State and Local requirements. As a municipal project, this NOI filing is not subject to fees under the Act or Bylaw.

We trust that the following application provides adequate information to facilitate the issuance of an Order of Conditions. Should you have any additional questions, please do not hesitate to contact us.

Very truly yours, BETA Group, Inc.

1.0 INTRODUCTION

On behalf of the City of Quincy Department of Public Works in conjunction with the Massachusetts Department of Transportation Highway Division (MassDOT), BETA Group, Inc. Deficient conditions present at the Site include uneven and damaged sections of pavement, faded roadway markings, substandard traffic signalization, and inadequate sidewalks. The proposed improvements were designed to address the existing deficiencies and are based on an examination of existing conditions, known deficiencies, future traffic volumes, and discussions with MassDOT and City of Quincy officials.

Corridor improvements being proposed to accomplish the goals of the Project generally include the following:

• Reconstruction of existing cement concrete sidewalks;

• Replacement of existing bituminous concrete sidewalks with cement concrete sidewalks;

• Construction of new cement concrete and hot mix asphalt (HMA) sidewalks;

• Construction of wheelchair ramps;

• Installation of traffic signalization improvements;

• Alteration of roadway geometry to correct substandard intersections;

• Mill and overlay and full depth construction of pavement;

• Pavement striping;

• Implementation of roadway shoulders to incorporate bicycle accommodations;

• Median improvements;

• Landscaping; and

• Improvements to the municipal stormwater management system.

Pedestrian accommodations will be improved through reconstruction of existing sidewalks along both sides of the corridor. Accommodations will provide five (5)-foot-wide minimum sidewalks with a minimum of a four (4)-foot clearance around obstructions and cement concrete wheelchair ramps at each intersection. Crosswalks will be painted at all signalized intersections to supplement the new pedestrian signals and exclusive pedestrian phases. Bicycle accommodations consisting of a five (5)-foot-wide shoulder along each side of Sea Street are also proposed.

2.0 SITE DESCRIPTION

2.1 PROJECT LOCUS

Sea Street generally follows an east-west alignment through the eastern portion of the City and serves as a connector from Route 3A and Quincy Center to the peninsulas of Hough’s Neck and Germantown (Figure 1 – Site Locus). Since Hough’s Neck and Germantown are peninsulas, Sea Street is the only major roadway into and out of these communities, and as such is classified as an evacuation route. The Project is located in a High-Density Residential area and is surrounded by a mix of residential, commercial, and educational properties. Several condominium buildings are located along the south side of Sea Street.

Broad Meadows Marsh, also known as Passangageset Park, is a restored salt marsh with public hiking trails located south of Sea Street and abuts the Project between 261 and 279 Sea Street. Broad Meadows Middle School is also located to the south of Sea Street and is accessed by Homer and Moffat Roads.

Adams Shore Branch public library is located within the Project limits on the south side of Sea Street, west of the Palmer Street intersection.

2.2 WETLAND RESOURCE AREAS

Field reconnaissance has been conducted by BETA to verify existing conditions and Resource Areas within and in the immediate vicinity of the Project limits. BETA observed Salt Marshe to the north and south of the Project; however, they are located over 100 feet away from proposed work. A review of the Federal Emergency Management Agency (FEMA) National Flood Hazard Layer indicates that a Zone AE Flood Hazard, with base flood elevations (BFE) of 11 and 12 feet, is present at the Site (Figure 3 – NFHL Map and Figure 4 – FEMA FIRMette). The Flood Hazard at the Site is subject to coastal storm surges and is therefore meets the definition of LSCSF under the Act and the Ordinance.

2.2.1 LAND SUBJECT TO COASTAL STORM FLOWAGE (FEMA AE AND VE ZONES 310 CMR 10.04)

LSCSF is defined as land subject to any inundation caused by coastal storms up to and including that caused by the 100-year storm, surge of record, or storm of record, whichever is greater. The LSCSF boundary at the Site was determined by reviewing FEMA Flood Insurance Rate Map (FIRM) community panel number 25021C0088F, dated June 9, 2014 (Figure 4 – FEMA FIRMette). The Site is located within Zone AE, which is defined as an area subject to inundation by the 1% annual chance flood (100-year flood) and has associated BFEs of 11 and 12 feet. The boundary of LSCSF shown on the Project Plans is depicted by elevation at the BFE contours; LSCSF constrains the Site at the following locations:

• North of Station 30+00 to 32+00;

• Between Station 37+00 and 39+50; and

• North of Station 41+00.

There are no Zone VE Flood Hazards located onsite.

2.3 BUFFER ZONES

In accordance with the provisions of the Act and the Ordinance, there is no Buffer Zone associated with LSCSF. The Buffer Zone associated with the offsite Salt Marshe does not extend into the limits of work (as shown on the Project Plans); therefore, no work is proposed within Buffer Zone.

2.4 NHESP-MAPPED HABITAT AND OTHER SENSITIVE AREAS

According to the latest MassGIS data, the Site is not located within Natural Heritage and Endangered Species Program (NHESP) Priority Habitat of Rare Species or Estimated Habitat of Rare Wildlife. The Site

A00860 - 24 is also not located within an Areas of Critical Environmental Concern (ACEC), within 200 feet of mapped Certified or Potential Vernal Pool, or within groundwater or surface water protection zones associated with a public water supply.

3.0 WORK DESCRIPTION

The proposed Project includes reconstruction of Sea Street within the existing roadway footprint and construction of new concrete sidewalks with Americans with Disabilities Act (ADA)-accessible ramps and crosswalks. Pavement markings, signage, and traffic improvements will also be incorporated as part of the Project. Intersection geometry and utility pole locations will be adjusted, as needed, to ensure that the accessibility and safety improvement goals of the Project are met.

The following specific activities will be undertaken as part of the Project:

• Replace the existing traffic signals at the Sea Street/Norton Road/Moffat Road and the Sea Street/Palmer Street intersections, including full actuation with video detection for vehicles and bicycles, pedestrian indications, pushbuttons, and emergency pre-emption. Backplates with reflective strip and LED lenses will be provided for all proposed signal heads. Pedestrian phase timing and vehicle clearance times will be based on the latest MassDOT guidance. Intersection geometry modifications will be made as necessary in order to feasibly accommodate the new traffic infrastructure and pedestrian accommodations.

• Provide new pavement markings and roadway signage. All signage will comply with the Manual on Uniform Traffic Control Devices (MUTCD).

• Provide five (5)-foot-wide painted shoulders on both sides of Sea Street to meet MassDOT’s Healthy Transportation Policy guidelines for bicycle accommodations.

• Install new cement concrete and HMA sidewalks and new wheelchair ramps with detectable warning panels at all signalized and unsignalized intersections. Proposed ramps and sidewalks will meet MassDOT and ADA requirements.

• Rehabilitate pavement via pavement milling and overlay in addition to full depth pavement construction/box widening in various locations. Bituminous driveway aprons will be rehabilitated where required.

• Relocate utility poles to provide a minimum four (4)-foot clearance for City sidewalk snowplows.

• Provide a center median on Sea Street, where feasible, to create a safety buffer for traffic moving in opposing directions.

• Improve the existing municipal drainage system. This will involve adjusting existing structures (e.g., catch basins and manholes) as necessary to address any existing drainage concerns. In addition, stormwater best management practices (BMPs) to be implemented include the replacement of existing catch basins with deep sump catch basins, installation of new deep sump catch basins, and installation of gutter inlets.

• Provide parking bays for the “Our Lady of Good Counsel” church and other small businesses.

Portions of work are proposed with Areas Subject to Protection and Jurisdiction under the Act and the Ordinance including LSCSF.

A00860 - 25

3.1 WORK WITHIN JURISDICTIONAL RESOURCE AREAS

3.1.1 LAND SUBJECT TO COASTAL STORM FLOWAGE – 310 CMR 10.04

Given the location of LSCSF within the Site, impacts to LSCSF are required to accomplish the Project goals.

Work proposed within LSCSF includes a majority of the activities described in Section 3.0. However, as depicted on the sections included in in Appendix B, fill within LSCSF will be primarily limited to ten (10) inches of curbing reveal and adjacent landscape areas associated with the new medians. Work associated with the Project will occur over 27,970 square feet of LSCSF and is broken down as follows:

IMPACT DESCRIPTION IMPACTED AREA (SF) IMPACT TYPE

Impact to Degraded LSCSF 27,740 Temporary

Impact to Vegetated LSCSF 2,950 Temporary

Impact to Vegetated LSCSF 130 Permanent

LSCSF Restoration 150 Restoration

Impacts to degraded LSCSF (i.e. paving of roadways and reconstruction of sidewalks) are temporary in nature, will result in proposed conditions similar to existing conditions, and will not entail significant volumes of fill. Permanent impacts to vegetated LSCSF are limited to what is required to widen sidewalks and driveway aprons to improve accessibility. Any vegetated areas within LSCSF that are temporarily impacted by the Project will be restored with loam and the approved seed mixture prior to Project completion. Areas of LSCSF restoration are primarily attributed to the creation of landscape medians along portions of the centerline of Sea Street as discussed further in Section 4.2.

3.2 WORK IN BUFFER ZONE

The Project will be constructed over 100 feet away from the offsite Salt Marshe; therefore, no work within Buffer Zone will occur. There is no Buffer Zone associated with LSCSF under the Act or the Ordinance.

4.0 MITIGATION MEASURES

The Project was designed to avoid, minimize and mitigate impacts to Resource Areas; specifically, LSCSF.

Construction period erosion and sedimentation controls, stormwater management system improvements, and long-term stabilization will ensure the continued ability of LSCSF to support the interests of the Act.

4.1 EROSION AND SEDIMENTATION CONTROLS

The Project plans enclosed in Appendix B provide details and descriptions of the proposed erosion and sedimentation control measures. Erosion and sedimentation controls will be installed and maintained by the contractor along the length of the Project. Erosion and sedimentation controls, consisting of 12-inch compost filter tubes and catch basin inlet protection measures, will primarily be installed to prevent silt and sediments from entering the drainage system and migrating into or towards offsite Resource Areas.

No hay bales will be used at any time on this Project.

Due to the Project involving ground-disturbing activities exceeding one (1) acre in size, the contractor will be responsible for obtaining coverage under the NPDES CGP, which includes the preparation and implementation of a SWPPP.

A00860 - 26

4.2 LSCSF RESTORATION

As noted in Section 3.1.1, impacts to LSCSF are primarily associated with work within areas previously degraded by pavement. While the Project will require permanent alteration of 130 square feet of vegetated LSCSF for the purposes of sidewalk and driveway construction, the proposed 150 square feet of LSCSF restoration exceeds a 1:1 ratio of restoration to impacts.

LSCSF restoration will occur between Station 37+00 and 40+00. Restoration will primarily consist of the establishment of landscaped medians that will result in the removal of bituminous concrete and the installation of plantings within new areas of clean loam. A species list is provided on the plans in Appendix B. In addition, impervious surfaces will be removed from two (2) areas along the northern sideline of Sea Street between Station 37+00 and 40+00 and replaced with clean loam and stabilized with the approved seed mixture. The reduction in impervious areas, albeit minor, will support groundwater recharge and sustainable stormwater management practices.

4.3 STORMWATER MANAGEMENT

The Stormwater Checklist and a Stormwater Report have been completed and submitted with this NOI as Appendix A. Stormwater management will be accomplished through modifications to the existing closed drainage system to address general age and condition concerns. Existing inlets will be replaced with deep-sump catch basins and gutter inlets. Additional deep-sump catch basins will be installed throughout the corridor to provide more effective stormwater collection and treatment. The proposed stormwater BMP improvements will result in a Project-wide total suspended solids (TSS) removal rate of 7.21%, which is equivalent to an 80% TSS removal rate across 34,458 square feet. In addition, the Project will result in a net decrease of 4,580 square feet of impervious area

According to the Stormwater Management Standards (310 CMR 10.05(6)(k-q)), the proposed work constitutes a Redevelopment Project because the work will substantially occur within an existing paved roadway. Redevelopment projects are required to meet Standards 1 and 7 through 10 fully; and Standards 2 through 6 only to the maximum extent practicable. Appendix A provides a summary of compliance with the Stormwater Standards.

4.4 WATER CONTROL AND DEWATERING

During the installation of new drainage structures within excavated trenches, dewatering may be required to establish a dry work area. The contractor will be required to develop a dewatering plan that adequately lowers the groundwater level within the trench while ensuring that any discharges are free of sediment and directed to appropriate areas. It is anticipated that the contractor will pump groundwater from a sump placed in the trench and direct the discharge to a sediment-filtering bag placed in an upland area and surrounded by the approved erosion controls. A copy of the dewatering plan can be provided to the Conservation Commission should the need arise.

5.0 REGULATORY COMPLIANCE

The Project will involve work within LSCSF and has been designed to support the interests of the Act and the Ordinance accordingly.

A00860 - 27

5.1 MASSACHUSETTS WETLANDS PROTECTION ACT REGULATIONS – 310 CMR 10.00

5.1.1 LAND SUBJECT TO COASTAL STORM FLOWAGE – 310 CMR 10.04

There are no performance standards for LSCSF under the Act. However, Conservation Commissions have the authority to determine the significance of this Resource Areas to the interests of storm damage prevention and flood control and assess any functions and/or characteristics that require protection.

A majority of the Project that is proposed within LSCSF will occur within areas degraded by impervious surfaces; however, the presence of the municipal drainage system provides the degraded LSCSF with a level of function related to storm damage prevention and flood control. The Project proposes to replace existing catch basins with deep sump catch basins, as well as install new gutter inlets and deep sump catch basins. Project impacts to vegetated LSCSF will be mitigated in exceedance of a 1:1 ratio as described in Section 4.2. Mitigation will result in a net increase of pervious areas and woody vegetation, thereby further supporting the storm damage prevention and flood control interests of the Act.

5.2 CITY OF QUINCY WETLANDS PROTECTION ORDINANCE – CHAPTER 349

The Project will occur within LSCSF, which is protected under the Ordinance in addition to the Act. Specific Performance Standards for LSCSF are not defined by the Ordinance; therefore, it is anticipated that the Project supporting the interests of the Act for LSCSF will support compliance with the Ordinance.

6.0 OTHER REQUIRED PERMITS / APPROVALS

In addition to an Order of Conditions approving the Project under the Act and the Bylaw, the Project requires the following permits/approvals:

• Approval under the NPDES CGP: The Project will result in the disturbance of over one (1) acre of land; therefore, an NOI must be filed with the EPA to obtain coverage under the CGP. This will also require the preparation of a SWPPP.

• Massachusetts Public Waterfront Act (Chapter 91) Minor Modification: The portion of the Project along the frontage of 346 and 360 Sea Street will occur within Filled Tidelands and is therefore subject to jurisdiction under Chapter 91. No existing Chapter 91 License was located on record for the Site, and the proposed work is considered exempt from the requirement to obtain a License per provisions of the regulations at 310 CMR 9.00. Therefore, a Minor Modification request letter will be submitted to MassDEP in order to comply with Chapter 91.

• Categorical Exclusion under the National Environmental Policy Act (NEPA): In order to comply with NEPA requirements, the Project will require the submission of documentation sufficient to justify the determination that the Project is a Categorical Exclusion and does not require the submission of an Environmental Assessment or an Environmental Impact Report.

7.0 SUMMARY

The Project will improve traffic management and safety for all users along Sea Street within the Project limits, including all associated intersections. Improvements are required to upgrade deficient conditions that include uneven and damaged sections of pavement, faded roadway markings, substandard traffic signalization, and inadequate sidewalks. Stormwater collection and treatment facilities within the Project limits will also be improved to better attenuate and treat runoff from impervious areas.

The Project will support the interests of the Act and the Ordinance as it relates to LSCSF by conducting the proposed work and mitigation as described in this NOI. The City of Quincy in conjunction with MassDOT

A00860 - 28 respectfully request that the Quincy Conservation Commission issue an Order of Conditions finding this NOI sufficient in describing the work, the Site, and the effects of the work on the interests identified in the Act and the Ordinance, and approving the work as proposed.
