About this file

This document is a request for a Minor Project Modification submitted by BETA Group, Inc. on behalf of the City of Quincy Department of Public Works and the Massachusetts Department of Transportation (MassDOT) Highway Division to the Massachusetts Department of Environmental Protection's Division of Wetlands and Waterways. The proposed project involves modifications to the existing Sea Street corridor in Quincy, Massachusetts to correct roadway deficiencies and improve traffic management and safety. The work is located within Filled Tidelands and is subject to Chapter 91 Jurisdiction. BETA is requesting MassDEP's approval for the project as a Minor Modification pursuant to the Waterways Regulations, as the proposed improvements are limited to reconstruction of existing public infrastructure within the existing developed area and will not result in a change to public access of the Massachusetts Bay waterfront.

The document provides background on the project, details the proposed improvements, identifies Chapter 91 exemptions, and outlines the rationale for classifying the project as a Minor Modification. There is no information provided on pricing, set asides, incumbents, funding sources, or contract terms. The focus of the document is to obtain regulatory approval for the proposed infrastructure modifications from the Massachusetts Department of Environmental Protection.

Re: Sea Street Corridor Improvements Sea Street, Quincy

MassDOT Project No. 608707 Request for Minor Project Modification

Dear Mr. Padien:

On behalf of the City of Quincy Department of Public Works, in conjunction with the Massachusetts Department of Transportation – Highway Division (MassDOT), BETA Group, Inc. (BETA) requests that the Massachusetts Department of Environmental Protection’s Division of Wetlands and Waterways (MassDEP) review the proposed work along the Sea Street corridor (the Project) located between Samoset Avenue and Pequot Road in Quincy, Massachusetts (the Site). Based on the information and proposal provided below, we also respectfully request MassDEP’s approval for improvements to the existing Sea Street Corridor in Quincy as a Minor Modification to the existing unlicensed infrastructure within Filled Tidelands.

Background

MassDOT is proposing to modify the existing Sea Street corridor from Samoset Avenue and Pequot Road.

The purpose of this Project is to correct roadway deficiencies along the Project Area while improving traffic management and safety for the benefit of all users of Sea Street including motorists, bicyclists, and pedestrians. While all proposed improvements are located entirely outside the limits of Flowed Tidelands, the portion of the Project along the frontage of 346 & 360 Sea Street is located within Filled Tidelands and is subject to Chapter 91 Jurisdiction per 310 CMR 9.04(2). Generally, the existing bituminous concrete sidewalks at this location will be replaced with cement concrete sidewalks within the existing sidewalk footprint, and a temporary construction easement will extend approximately five (5) feet into the parcels at 346 & 360 Sea Street.

BETA performed Registry of Deeds research on behalf of MassDOT to identify records of existing Chapter 91 Licenses associated with the Site, particularly at 346 & 360 Sea Street. Although no Licenses were found, a subdivision plan entitled “Revised General Plan of Merrymount Quincy, Mass.”, revised November 17, 1922, is recorded at the Norfolk County Registry of Deeds as Plan 623 of 1922. This plan depicts the parcels now identified as 346 & 360 Sea Street as being located within what was formerly Flowed Tidelands (referenced as the “Historic High-Water Mark” on the attached Project Plan sheets), with a ten (10)-foot-wide section of land bisecting the parcels and providing access along the shoreline of the Massachusetts Bay. A plan entitled “Plan of Land in Quincy Mass.” dated December 1977 and recorded as Plan 116 of 1978 refers to this ten (10)-foot-wide section of land as a “passageway”. These plans are enclosed with this letter for reference.

A00880 - 3

Mr. Daniel Padien, Waterways Program Director January 13, 2023

Proposed Improvements

The Project has been designed to maintain public infrastructure within existing developed areas and will not infringe on the current ability of this portion of the Site to provide access to public waterfront. At this particular location, the Project consists of the following:

Construction of cement concrete sidewalks within the footprint of existing bituminous concrete sidewalks;

Construction of a hot mix asphalt (HMA) driveway; and Establishment of five (5)-foot-wide temporary construction easement measured off the back of the sidewalk.

Horizontal and vertical alignments of the proposed work will remain essentially unchanged when compared to existing conditions. Areas disturbed within the temporary construction easement will be restored to existing conditions following completion of the Project. Sheets 20 and 28 of the Project Plans depict work subject to Chapter 91 Jurisdiction and are enclosed.

Chapter 91 Exemptions

The Waterways Regulations at 310 CMR 9.05(3) (b – h) defines certain structures as exempt from licensing under Chapter 91, including:

(c) continuation of any existing, unauthorized public service project, provided that no unauthorized structural alteration or change in use has occurred subsequent to January 1, 1984, unless the Department determines, upon notice and opportunity for public comment, that licensing is essential to prevent significant harm to an overriding water-related public interest.

Sea Street is an existing unauthorized public service project and no unauthorized structural alteration or change in use has occurred since January 1, 1984.

Proposed Minor Modifications

This Project is proposed in accordance with the provisions of 310 CMR 9.05 (3) (a) – Activities Not Requiring a License or Permit pursuant to 310 CMR 9.22(3)(c).

The provisions at 310 CMR 9.22(3) allow for a Minor Modification to a Project exempt from licensing per the criteria of 310 9.05(3)(b) through (h) (e.g., the Project) without filing an application for a License or License amendment. The Project would qualify for a Minor Modification under the criteria identified at 310 CMR 9.22(3)(a):

“Structural alterations which are confined to the existing footprint of the fill or structures being altered and which represent an insignificant deviation from the original specifications of the license, in terms of size, configuration, materials, or other relevant design or fabrication parameters.”

Although no license could be located on record for the Site, the Project involves work that will maintain existing public infrastructure and will not result in the expansion or substantial reconfiguration of the infrastructure. Work within the existing ten (10)-foot-wide “passageway”, as show on the attached Sheets 20 and 36 of the Project plans, is limited to tying grades into the existing concrete pad.

Summary

On behalf of the City of Quincy and MassDOT, BETA respectfully requests that MassDEP approve the Project as a Minor Modification pursuant to 310 CMR 9.22(3)(a) and not require the filing of a Chapter 91

License Application. The Project is limited to reconstruction of existing public infrastructure within existing developed areas and will not result in a change in the public’s ability to access the Massachusetts Bay public waterfront when compared to existing conditions.
