About this file
This is a Scope of Work document for the State of Utah Division of Purchasing establishing a cooperative contract (RM27-2) for HVAC Air Filters intended for use by all eligible state entities, including government departments, institutions, agencies, political subdivisions, colleges, school districts, counties, cities, and authorized nonprofit and federal agencies. The contract will supply new OEM HVAC filters, filter media, and in-house and on-demand manufactured filters to be purchased from the contractor's published price list at a negotiated discount. The contract term is five years, with the State of Utah currently operating six existing cooperative contracts for these services that generated $4,890,429.22 in total usage over the previous five-year contract term. Minimum orders are one individual filter at storefront locations or one case if shipping from the plant location. Each eligible user is treated as an individual customer responsible for their own charges and liabilities.
Pricing will be provided by the contractor with all associated fees detailed in Attachment C, with shipments on an F.O.B. destination basis and shipping charges listed separately without additional profit markup. The contractor must guarantee pricing for 12 months and provide percentage discounts from MSRP or public pricing for the life of the contract, with these discounts considered minimum rates and verified through accessible catalogs or public websites. An administrative fee of 0.25 percent applies to the contract. The contractor must maintain an authorized representative available during business hours Monday through Friday to respond to inquiries within one business day and handle all concerns related to returns, quality, and ordering. After the price guarantee period expires, price adjustment requests require 30 days' advance notice, documentation of market analysis data, and confirmation that profit margins do not exceed original contract levels. New products or services with associated pricing may be added once per calendar year upon approval by the Division of Purchasing's Contract Manager.
