About this file

This is a Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman in connection with Request for Proposal (RFP) RM27-2 for HVAC Air Filters, conducted by the State of Utah Division of Purchasing. The RFP is structured to potentially result in multiple awards based on vendors meeting both technical score thresholds and total score thresholds. The contract term is five years, with vendors required to guarantee pricing for the initial 12-month period and maintain percentage discounts for the life of the contract.

The confidentiality claim form allows vendors submitting proposals to request protection of trade secrets and commercial financial information under Utah Code 63G-2-305. Claimants must submit both redacted and non-redacted versions of their proposals, with the entire proposal prohibited from redaction. The form requires vendors to provide detailed justification for each confidential section, specifying the page number, paragraph, and specific reason for the confidentiality request. An administrative fee of 0.25 percent applies to the contract. Submission of a confidentiality claim does not guarantee protected classification if the government receives subsequent public records requests under GRAMA (Government Records Access and Management Act).

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
