About this file

This is a Criminal Background Check Certification form issued by the Amarillo Independent School District (AISD) in Texas, designed to ensure compliance with Texas Education Code Chapter 22 requirements for service contractors. The certification requires contractors and their covered employees—defined as those with continuing duties related to contracted services and direct contact with students—to obtain criminal history record information through the Texas Department of Public Safety's Finger-based Applicant Clearinghouse of Texas (FACT). Contractors must certify that neither they nor their covered employees have disqualifying convictions, which include felony offenses under Title 5 of the Texas Penal Code, sex offender registration requirements, or equivalent federal or state offenses involving victims under 18 or enrolled in public school. The certification must be completed and returned to AISD's Human Resources Office before any contractor or employee may provide services; noncompliance or misrepresentation is grounds for contract termination without penalty to AISD.

The form provides three certification options for contractors: individual contractors certifying their own criminal history clearance; contractors with covered employees certifying that all such employees have been cleared; or contractors certifying that no employees are covered employees due to lacking continuing duties or direct student contact. Contractors unable to obtain criminal histories through their own FACT account must submit employees through AISD's account and authorize AISD to subscribe to their criminal history records. Any contractor receiving notification of a disqualifying criminal history for a covered employee must immediately remove that employee from contract duties and notify the District within three business days. Contact information for obtaining criminal history records is available through the Texas Department of Public Safety Crime Records Service at (512) 424-2474 or AISD Human Resources at (806) 326-1490.

Criminal Background Check Certification for Contractors

Introduction: Texas Education Code Chapter 22 requires service contractors to obtain criminal history record information on covered employees. Contractors must certify to the school district that they have done so. Covered employees with disqualifying convictions are prohibited from serving at a school district. For more information on how to obtain criminal histories for covered employees, contact the

Texas Department of Public Safety’s Crime Records Service at (512) 424-2474.

If you do not have or are unable to obtain a DPS account, contact Human Resources at (806) 326-

1490.

Definitions:

Covered employee: Employee of a contractor who has or will have continuing duties related to the contracted services and has or will have direct contact with students. The school district will be the final arbiter of what constitutes direct contact with students.

Continuing duties related to contracted services: Work duties that are performed pursuant to a contract to provide services to a school entity on a regular, repeated basis rather than infrequently or one-time only.

Direct contact with students: The contact that results from activities that provide substantial opportunity for verbal or physical interaction with students that is not supervised by a certified educator or other professional district employee. Contact with students that results from services that do not provide substantial opportunity for unsupervised interaction with a student or students, such as addressing an assembly, officiating a sports contest, or judging an extracurricular event, is not, by itself, direct contact with students. However, direct contact with students does result from any activity that provides substantial opportunity for unsupervised contact with students, which might include, without limitation, the provision of coaching, tutoring, or other services to students. If it is unclear whether you or your employees will have direct contact with students, contact the Amarillo Independent School District.

Disqualifying conviction: One of the following offenses, if at the time of the offense, the victim was under 18 or enrolled in a public school: (a) a felony offense under Title 5, Texas Penal Code; (b) an offense for which a defendant is required to register as a sex offender under Chapter 62, Texas Code of

Criminal Procedure; or (c) an equivalent offense under federal law or the laws of another state.

Service Contractor: An entity, including a government entity and an individual independent contractor, that contracts or agrees with a school entity by written agreement or verbal understanding to provide services through individuals who receive compensation.

THIS CERTIFICATION MUST BE COMPLETED AND

RETURNED TO THE HUMAN RESOURCES OFFICE

BEFORE A CONTRACTOR OR CONTRACTOR’S

EMPLOYEES MAY PROVIDE SERVICES FOR AISD.

NONCOMPLIANCE OR MISREPRESENTATION

REGARDING THIS CERTIFICATION IS GROUNDS FOR

CONTRACT TERMINATION WITHOUT PENALTY TO

AISD.
