About this file
This file contains Virginia statutory provisions from the Code of Virginia Title 40.1 regarding minimum wage requirements applicable to employers within the Commonwealth, including public institutions of higher education such as George Mason University, which is the contracting entity for the landscape maintenance services opportunity. The statute establishes a tiered minimum wage schedule with specific hourly rates that employers must observe when compensating employees. Prior to May 1, 2021, employers were required to pay at least the federal minimum wage. Beginning May 1, 2021, employers must pay employees the greater of the federal minimum wage or 75 percent of the Virginia minimum wage for trainees in approved programs not exceeding 90 days. From January 1, 2026 through January 1, 2027, the minimum wage floor is $12.77 per hour; from January 1, 2027 through January 1, 2028, it increases to $13.75 per hour; and from January 1, 2028 through January 1, 2029, it reaches $15.00 per hour, with all amounts subject to the greater of the stated rate or federal minimum wage.
Effective January 1, 2029, and thereafter, Virginia employers must pay an adjusted state hourly minimum wage established annually by the Commissioner of Labor no later than October 1 of the preceding year. The adjusted minimum wage is calculated by adding the current state minimum wage rate to a percentage increase equal to the annual inflation rate reflected in the United States Average Consumer Price Index for all items, all urban consumers (CPI-U), with the annual adjustment floor set at zero percent. As George Mason University is a public institution and agency of the Commonwealth of Virginia, any contractor awarded the landscape maintenance services contract across the University's multiple campuses must ensure compliance with these Virginia minimum wage requirements for all employees performing work under the contract.
