About this file
This file is a legislative bill (Assembly Bill No. 4618) from the New Jersey State Legislature addressing employment requirements at official inspection facilities operated under contracts with the State. The bill amends P.L.1995, c.112 and establishes requirements for the operation and maintenance of official motor vehicle inspection facilities. The State Treasurer is authorized to assign full responsibility to the State, contract with private contractors, or split responsibility between the State and private contractors for the design, construction, renovation, equipment, establishment, maintenance, and operation of official inspection facilities. Prior to awarding any contract that includes operation or maintenance of an inspection facility, the State Treasurer must issue a notice of intent to award and submit to the Legislature a report including an economic analysis of all three operational options. Contracts must comply with the Public Contracts Law (P.L.1954, c.48) and are subject to oversight by the Chief Administrator of the New Jersey Motor Vehicle Commission, who establishes standards designed to achieve average wait times of 30 minutes or less and develops incentive systems to achieve 15-minute average wait times.
The bill establishes significant employment protections requiring that during any contract renewal or award of a new contract, existing qualified employees covered by a collective bargaining agreement shall be the first offered employment to meet staffing requirements. Offers of employment to both existing and new qualified employees must include compensation and economic benefits, including health benefits and paid time off, that are the same as or comparable to benefits contained in any existing collective bargaining agreement. Additionally, compensation and economic benefits delineated in a collective bargaining agreement in effect at the time of a sale, transfer of assets, or merger shall be binding on successors and assigns. The bill also provides that employees whose employment is terminated as a result of contracting may be eligible for workforce development training grants. For solicitations issued on or before the effective date of this act or within six months thereafter, the commission may alter terms and conditions through addenda without reissuing the solicitation, and existing bidders must be afforded the opportunity to amend their bids to conform to the new requirements.
