About this file

This is a Claim of Business Confidentiality document submitted to the State of Utah Division of Purchasing in connection with the RM27-1 Vehicles request for proposals. The document pertains to a five-year vehicle procurement contract that may result in multiple awards based on vendors meeting both technical score and total score thresholds. Vendors are required to guarantee their pricing for 12 months and maintain percentage discounts throughout the contract term. The RFP seeks to establish a framework agreement with qualified vehicle providers to supply vehicles to the State of Utah.

The contract includes an administrative fee of 0.50% (one-half of one percent) applied to awarded amounts. As a claim of business confidentiality document, this filing typically indicates that the submitting vendor has requested confidential treatment for specific proprietary information, pricing data, trade secrets, or other sensitive business details included in their proposal response. This document serves as formal notice to the procuring agency that certain portions of the vendor's submission contain confidential or proprietary information that should be withheld from public disclosure pursuant to applicable public records exemptions and procurement regulations.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
