About this file

This is a Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman in conjunction with the State of Utah Division of Purchasing and Division of State Parks for the AS27-1 Adaptive Mobility Devices for State Parks procurement. The RFP seeks to establish multiple contract awards for the provision of mobility devices to state parks, with awards determined by the highest score for each line item. The contract term is five years, with vendors required to guarantee pricing for a minimum of one year, after which negotiated discounts will apply for the remainder of the contract term.

The confidentiality claim form allows bidders to protect trade secrets and commercial financial information in their proposals under Utah Code provisions 63G-2-305 and 63G-2-309. Claimants must submit both redacted and non-redacted versions of their proposals, with the Division of Purchasing declining to perform redactions on behalf of vendors who fail to provide a redacted copy. While submission of a confidentiality claim does not guarantee protected classification in the event of a public records request, the form provides bidders the opportunity to identify specific pages, paragraphs, and information they seek to protect along with detailed reasoning for such protection requests.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
