About this file
This document is the Statewide Contract Terms attachment for the State of Oklahoma, specifically applicable to the SW1043M-LIVESCAN contract administered by the Office of Management and Enterprise Services (OMES) Central Purchasing division. The contract is a firm, fixed-price agreement for indefinite delivery and quantity, permitting use by state agencies, political subdivisions as defined under the Governmental Tort Claims Act, county and local governmental entities, and other entities authorized by the state to access multistate or multigovernmental contracts. The contract is designated as mandatory for statewide use and applies to the procurement of Livescan fingerprint capture devices, biometric scanners, mugshot capture stations, and associated hardware and software to support standardized criminal biometric intake across city, county, and state agencies.
The contract terms establish a 1% contract management fee assessed on all transactions under the statewide contract, which must be included in supplier pricing and cannot be reflected as a separate line item. Suppliers are required to submit quarterly Contract Usage Reports within 45 days following each calendar quarter, with payment of the contract management fee due within 45 calendar days after each quarterly reporting period. Reports must document all procurement entities, order dates, purchase order numbers or purchase card transactions, delivery locations, product descriptions and manufacturers, quantities, unit list prices, and unit prices charged to purchasing entities. Individual late reports do not constitute a breach; however, repeated failure to submit accurate reports and timely fee payments may result in contract suspension or termination. The state reserves the right to adjust the contract management fee with 60 calendar days' written notice and maintains no obligation to guarantee minimum or maximum product or service volumes. Individual ordering documents are effective only between the supplier and customer and do not amend the master contract or apply to other customers' acquisitions.

Contract Management Fee and Usage Report
1.7 Pursuant to 74 O.S. § 85.33A, the state assesses a contract management fee on all transactions under a statewide contract. Supplier acknowledges and agrees that all prices quoted under any statewide contract shall include the contract management fee and the contract management fee shall not be reflected as a separate line item in supplier’s billing. The state reserves the right to change this fee upward or downward upon 60 calendar days’ written notice to supplier without further requirement for an amendment.
