About this opportunity

Alpine School District (ASD), located in Utah County, issued a Notice of Intent to Award a Contract Without Engaging in a Standard Procurement Process for the continuation of TalkingPoints, a districtwide two-way communication platform providing human- and machine-learning-enhanced translation services. The platform delivers two-way translation capabilities in 150+ languages and includes family-friendly glossaries designed for educational contexts, meeting compliance requirements under Utah HB302 Educational Language Services. Key deliverables include maintaining continuous access to the translation platform to support communication and engagement among staff, parents, and students throughout the transition period. The district proposes to prepay for two years of service covering fiscal year 2027 (ASD's final operational year) and fiscal year 2028 (the first year following the planned district reorganization on July 1, 2027) to ensure service continuity as ASD dissolves and creates three independent school districts: Lake Mountain, Aspen Peaks, and Timpanogos. The public notice period for contest submissions extends until March 6, 2026, with vendors able to challenge the non-competitive award determination by submitting documentation demonstrating comparable or equivalent products and services along with cost comparisons. The current contract was originally awarded through a Notice of Intent to Award process (reference number ASD11272020WKT) with expiration on June 30, 2026, and the district justified the non-competitive renewal based on the impracticality of conducting a new competitive solicitation, system implementation, data migration, and staff training during the limited operational period before reorganization.

TalkingPoints is identified as the incumbent vendor and the sole current contractor providing these specialized translation services to ASD. No specific set-aside designations or restrictions limiting organizational types are indicated in the procurement documents. The contract renewal approach was selected to avoid unnecessary disruption and resource strain on the three successor districts that will emerge from the planned reorganization. The Department of Student Education Access & Opportunity currently maintains available funding to support the two-year service prepayment arrangement. While specific contract values are not explicitly stated in the procurement notice, the award covers two full fiscal years of service for a districtwide platform serving the entire ASD community across multiple schools and departments. The justification emphasizes that TalkingPoints is the only platform offering the dual human- and machine-learning-enhanced translation capability combined with educational context-specific features and existing system integration with current ASD infrastructure, making replacement during the transition period impracticable without significant administrative burden.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS Issuing and Conducting Procurement Unit: Alpine School District Alpine School District Purchasing Department has received a request to make the following award without engaging in a standard procurement process: Alpine School District (ASD) currently maintains a contract with TalkingPoints, a districtwide two-way communication platform that builds communication, community, and engagement among staff, parents, and students. It is the only platform offering both human- and machine-learning-enhanced translation, with family-friendly glossaries that ensure conversations make sense in an educational context. It supports 2-way translation in 150+ languages. This platform meets the requirements for compliance with Bill Utah HB302 Educational Language Services. The contract was awarded through a Notice of Intent to Award a Contract Without Engaging in a Standard Procurement Process (posted on SciQuest; no contest, ASD11272020WKT) and is scheduled to expire on June 30, 2026. ASD is preparing for a planned reorganization that will dissolve the district and create three independent school districts (Lake Mountain, Aspen Peaks, and Timpanogos), effective July 1, 2027. Conducting a new competitive solicitation and implementing a replacement system at this time would require significant time and resources, including procurement, contract award, system configuration, data migration, staff and parent training. Given the limited remaining operational period prior to the reorganization, pursuing a new procurement would create unnecessary disruption, strain limited resources, and would not reasonably serve the needs of the future districts. ASD, Department of Student Education Access & Opportunity, currently has available funds and proposes to prepay for two years of service-FY27 (ASD's remaining year) and FY28 (the first year following the split)-to maintain continuity and reduce the administrative burden during reconfiguration. The total cost for the two-year term is $56,828.66. ASD also requests that the three new districts have the option to continue using TalkingPoints for up to three additional years (at the same pricing and terms, subject to vendor agreement) to allow each district time to conduct its own procurement process. This procurement qualifies as a sole source under Utah Code 63G-6a-802(1)(c) and Administrative Rule R33-108-102, which allow a sole source procurement when a standard competitive process is not practicable or is not in the best interest of the district. Public Notice and Contest Period This Notice of Intent to Award a Sole Source Contract is published in accordance with Utah Code 63G-6a-406 and 63G-6a-802. Any vendor that believes this procurement does not qualify as a sole source procurement must submit a written contest, including specific evidence demonstrating the ability to fulfill the legally mandated requirements of the settlement agreement, no later than seven (7) calendar days from the date of this posting. Protests must be submitted to: Kimberly Richards Purchasing Director kwrichards@alpinedistrict.org
