About this opportunity

The State of Utah Department of Agriculture and Food is conducting a non-competitive sole source procurement for a Weight & Measurement and Bedding Software Contract (NC26-38-1) with a posted date of January 30, 2026, and a due date of February 6, 2026. The procuring agency is the Division of Purchasing on behalf of the Agriculture and Food Division's Weights and Measures Program. The State seeks a comprehensive software system to serve as a recording and tracking platform for inspector activities and weighing and measuring device management, which must receive field inspector data and calculate and record results of weighing, measuring, packaging, and price verification activities in accordance with National Institute of Standards and Technology (NIST) Handbooks 44, 130, and 133. Key deliverables include generation of inspector daily, monthly, and yearly activity reports; establishment inspection reports with type categorization; active device tracking by type and last inspection date; synchronization capabilities with other Weights and Measures officials and a host system capable of downloading all data to the Utah Department of Agriculture and Food Regulatory Services for establishment registration purposes; and ongoing helpline support for user questions, system updates, and new inspector training. All software products without existing FedRAMP or verified GovRAMP status must be enrolled in the GovRAMP Progressing Snapshot Program at contract execution and must achieve verified GovRAMP Core status within 12 months of contract execution, with failure to meet these security requirements potentially resulting in liquidated damages and contract termination. The contract transition must be completed by August 15, 2026, when the current Win Wam contract expires, and the vendor must provide data transfer, software setup and configuration, and three half-day training sessions during Year 1. The procurement is being conducted without engaging in a standard competitive process based on a sole source justification, with the Division of Purchasing accepting public challenges from any interested and qualified vendor during a challenge period if they can demonstrate comparable or superior products or services.

This non-competitive procurement is restricted to the identified sole source vendor, Win Wam Software, which has been operational with the Utah Department of Agriculture and Food since 2005 and is currently loaded with customizations implemented by program inspectors to meet specific operational needs. The State's justification for sole source award acknowledges incomplete market research, noting that it has not conducted research on existing state cooperative contracts or contacted alternative vendors; however, the procurement documentation indicates that 37 states utilize Win Wam for their weights and measures programs, while other states such as Missouri, Nevada, and Alaska have attempted to develop or modify their own systems with mixed results and significant additional costs. The contract must comply with the State of Utah Standard Information Technology Terms and Conditions, which require contractors to maintain cyber security insurance with minimum aggregate limits of $2 million for low-risk data, $5 million for moderate-risk data, and $10 million for high-risk data, and to comply with NIST 800-53 Rev. 5 standards and maintain data encryption in transit and at rest using current TLS standards. The anticipated five-year contract term runs from November 1, 2026, through October 31, 2031, with no renewal options, and the estimated contract value is $174,298, with Year 1 professional services and licensing costs of $26,039 and recurring annual software maintenance and support costs ranging from $22,219 to $38,765 in subsequent years. All vendors responding to this procurement must certify compliance with Utah Code 63G-27 et seq., confirming they are not engaged in economic boycotts or boycotts of the State of Israel and will not engage in such boycotts during the contract term.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
