About this file
This is a Scope of Work document for the State of Utah's Department of Agriculture and Food Regulatory Services, Division of Purchasing, regarding a Weight & Measurement and Bedding Software Contract (NC26-38). The Utah Weights and Measures Program seeks a software system to serve as a recording and tracking platform for inspector activities and weighing and measuring device management. The software must receive data from field inspectors, calculate and record results of weighing, measuring, packaging, and price verification activities in accordance with National Institute of Standards and Technology (NIST) Handbooks 44, 130, and 133. The current provider, Win Wam, has a contract expiring August 15, 2026, at which time the selected vendor's installation and training must be completed. Required functionality includes generation of inspector daily, monthly, and yearly activity reports; establishment inspection reports; establishment type categorization; and active device tracking by type and last inspection date. The software must synchronize with other Weights and Measures officials and a host system capable of downloading all data to the Utah Department of Agriculture and Food Regulatory Services for establishment registration purposes.
The vendor must provide ongoing helpline support for user questions, system updates, and new inspector training. Products without existing FedRAMP or verified GovRAMP status must be enrolled in the GovRAMP Progressing Snapshot Program at contract execution and must achieve verified GovRAMP Core status within 12 months of contract execution, maintaining that certification thereafter. Failure to meet these security requirements may result in liquidated damages and potential contract termination. The Notice of Intent to Award indicates the State intends to award this contract without engaging in a standard competitive procurement process, citing either a single source justification, transitional costs as a significant consideration, or other circumstances making competitive procurement impractical.

Weight & Measurement and Bedding Software Contract
In compliance with the Utah terms and conditions, where the product does not already have a FedRAMP or verified GovRAMP status, the following provisions apply:
· At the time of contract execution, the product must be enrolled in the GovRAMP Progressing Snapshot Program and remain in the program until a verified status is achieved.
· The product must achieve a verified status of GovRAMP Core no later than 12 months after the date of contract execution and maintain that status.
· If the Contractor fails to maintain or achieve the security requirements outlined above, the Contractor may be subject to liquidated damages and/or the State of Utah may reevaluate the terms of the contract and determine whether the failure to comply justifies contract termination.
