Note: Executive Order (EO) 13706, Establishing Paid Sick Leave
Page 19 of 24beta.SAM.gov for Federal Contractors applies to all contracts subject to the
Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses
(29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate
(weighted union average rate).
Union Rate Identifiers
Page 20 of 24beta.SAM.gov
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or
""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Page 21 of 24beta.SAM.gov
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010
08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour
Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the
Page 22 of 24beta.SAM.gov
Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the
Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations
Wage and Hour Division
U.S. Department of Labor
200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator
(See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator
U.S. Department of Labor
200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative
Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board

W912P619B0007 – CHICAGO LOCK NORTH PIER REPAIRS SOLICITATION QUESTIONS & USACE RESPONSES
IMPORTANT NOTE:
THE USACE’S RESPONSES ARE PROVIDED IN RED AND GREEN TEXT
1) Please reference detail A/SS-501, specifically the armored plate. Is this plate continuous, or located at proposed bollard locations only? As shown on SS-301, typical cross section, the armor plate is continuous, except at expansion joints.
2) The tunnel wall removal limits indicate a straight line - is the Government requiring a clean sawcut, or can this be removed via breakers to the approximate removal limit? As indicated on SD-301, Contractor is required to remove concrete only as required to install new slab. As per Specification Section 02 41 00 concrete removal technique is to avoid damage to existing to remain. Concrete removal method is to be determined by the Contractor to accomplish these requirements.
3) Can the A-stone being cleared for the lakeside drive line be stockpiled within the work limits in the lake itself? As long as the turbidity level is controlled per Specs section 01 57 19.10 03 and storage location is within the work limits.
4) Spec Section 31 00 00 Part 1.7 references geotechnical reports are available upon request. Can those reports please be provided prior to bid time? Yes, they will be provided with AMD_002 as standalone document.
5) Item 0005AA “Clear Drive line FFP”, Item 0006AA “Toe Stone Placement in Water FFP”, and Item 0006AB “Re-Use Balance of Driveline Clearing Mat FFP” are all Lump Sum bid items. Please indicate, for pricing purposes, if contractors are to assume all the material excavated in item 0005AA is suitable to be placed in Items 0006AA and 0006AB and that no disposal of existing red granite Lakeside Sheet pile stone is to be included. Or is the stone in item 0006AA to be all new imported stone. It is a little unclear whether new Type A stone needs to be imported or not for this contract.
Current contract does not specify removal off site any stone recovered when clearing the drive line.
Specs section 35 31 19.45 03 para 2.3.2 says that existing granite “Red Stone” on site meets the requirements of this contract for A-Stone. Sheet CS502 note 2 says, the existing toe stone shall be filled up to 1 ft below new tie-rods. Stone removed during clearing the drive line, based on the specification Section 35 31 20.00 03 can be used as a Toe Berm Stone as well.
6) Are soil borings for this site available, and if so, can they be provided? Yes, they will be provided with AMD_002 as standalone document.
7) The drawings indicate the elevation of the tie rods to be 581.25. The current Lake levels per the USACE weekly levels is 581.92. The forecast predicts higher water level, above this tie rod elevation could be for the rest of this year. (see attached pdf scans of charts) Installing the waler bolts & tie rods below the lake level would require making holes in the sheets and concrete tunnel walls that would open the river side to the lake. Sheet G-02 was changed, note added to General Notes.
8) Would it be possible to provide for possibly a higher tie rod/waler &/or sheeting top elevation if the high water condition continues? Sheet G-02 was changed, note added to General Notes.
9) The indicated work limits are only about 15’ outside the new sheeting on the Lakeside. The floating equipment will be wider than that, and the amount of excavation of the existing toe stone will extend beyond those limits. Can the work limits be expanded to allow for this required work beyond? Work limits adjusted to 50 feet, Civil Sheets were revised.
10) Can the bid date be extended?
11) Please confirm that the Contractor is to submit their bid based on the lake and river elevations provided in the drawings. Sheet G-02 was changed, note added to General Notes.
12) Please advise if PZC18 sheet piling will be an acceptable alternative to PZ27 (detail attached) Please see paragraph 2.1.2 of specification section, 31 41 16.
13) For the CA-1 and CA-6 materials, will clean recycled concrete meeting this gradation be acceptable?
Based on the specifications section 35 31 20.00 03 and 35 31 19.45 03, recycled concrete can be used as indicated on typical cross-sections, check areas with a note “FILL”.
14) Please advise on the bid date status. At the Pre-Bid meeting, it was suggested that the bid date may be postponed.
15) Please provide the bottom elevation of the PZ 27 sheet piling for the parking lot area. Plan sheet CS302 refers to the structural drawings, while S302 states ‘EL 567.5 or EL 562.5, see PLAN.’
Sheet pile tip elevations are shown on S-100 and S-101.
16) Is there a required pour sequence (e.g. "checkboarding") for the proposed structural slab?
Can it be placed continuously?
There are no Checkerboarding requirements, however, Contractor is required to install expansion joints as shown in the plans.
17) Does the Government have a jointing plan for construction/contraction joints and respective details?
Please see sheets SS-101, SS-102, and SS-103 for joint locations and types. Construction joints are per Specification section 03 30 00, paragraph 3.9.
18) Do all joints require sealing/caulking? If so, please provide material requirements.
Please refer to specification section 03 30 00, paragraph 2.0 and joint details on sheet S-503.
19) Sheet G-002, Note 15 indicates a 10-foot wide access road be provided for emergency vehicles and pedestrian access. What are the allowable windows to temporarily shut down access in order to perform project work? If there is an accident at the lock, emergency vehicle needs to be able to assist. Based on the note 2 on sheet V-002, the lock crew (and MWRD employees) will need to access the lock by foot 24-hours a day.
20) What is the proposed thickness of the Parking Lot Aggregate Surface Layer CA-6?
Note 1 on Sheet CS302 will be revised to say 1’ layer of CA-6.
21) Has the material for pay items 6AG Disposal Off Site Clean Fill and 7AA Excavate Parking Lot Surface been pre-classified for disposal? If so, are the test reports used for classification available?
Based on the Measurement and payment section 01 22 00.00 10 clin 0006AG refers to clean material, no testing other than what is included in 01 57 20 .01 03 was completed. Provide bid accordingly.
22) What is the initial material being used for fill inside the retaining wall?
The question is unclear, see typical cross section CS302 for fill details behind the retaining wall.
23) What are the existing elevations for the fresh water and sanitary sewer tie-ins in the gravel lot?
Refer to Sheet V002 to see notes about the sewer and water tie-ins. No other information will be provided.
24) The following notes appear on various plan sheets dictating work to be done that is not tied to obvious bid item numbers, please advise what Item Numbers the following work is associated with.
• Sheet CS-102 in the middle of the page, a note reads “CCTV CAMERA #4 TO BE RELOCATED”
• Sheet SD-103 in the middle of the page the note reads “REMOVE AND REPLACE IN KIND WITH
NEW CHECKER PLATE”
• Sheet SD-103 to the right of the page the note reads “REMOVE AND REPLACE VEHICLE BARRIERS
WITH NEW & IN KIND”
Specs Section 01 22 00 was revised, clin 0014 was revised
25) Section 31 00 00 paragraph 3.6 of the specifications reads: “Use satisfactory material removed from excavations, insofar as practicable, in the construction of fills, embankments, subgrades, shoulders, bedding (as backfill), and for similar purposes.
