AMENDMENT 0001
W912GB-13-R-0022 Erosion Prevention / Dust Control and Natural Resource Protection Services, Germany MATOC Questions and Answers
1. Question: Are call ins acceptable for the prebid, If I do not get my passport renewed in time?
Answer: No, the Government does not have that technical capability at the off-site meeting room.
2. Question: Are you looking for local companies or companies from the US?
Answer: The Government is looking for companies with experience performing contracts in Germany.
Those companies could be local or from the US.
3. Question: The scope of work is right down our alley, however, we have no experience working oversees. I am of Polish decent and still have family in Poland, speak Polish, etc., so I am familiar with some of the European ways. I know that does not matter when it comes to getting work done and Poland is not Germany, but I thought I would throw it out there to see if you think that would weigh in on evaluations.
Answer: The Government is looking for companies with experience performing contracts in Germany.
4. Question: If we plan to submit for all three geographical locations, do we have to mention it on the cover of the Volume I Technical Proposal only, or do we have to submit three separate Volume I Technical Proposals for each geographical location?
Answer: If your firm plans to submit technical proposals for each of the three (3) geographical locations, the content of the proposal can be the same; however, you need to specify which geographical location is being proposed. Therefore, your firm can submit the same technical proposal for all three (3) geographical locations, but you must specify which location is being proposed. Regarding the Price Proposal, each Price Schedule has a slight variation of line items. Therefore, if your firm plans to submit a price proposal for each of the three (3) geographical locations, your firm must submit separate price proposal for each location.
5. Question: On page 129 of the SOW under Submission Requirements: is mentioned: “2. The Offer
(SF 1442) duly executed with an original signature by an official authorized to bind the company.”
There is no SF1442 attached, only the SF 33. Which one will apply?
Answer: The solicitation will be corrected to state, “2. The Offer (SF 33) duly executed with an original signature by an official authorized to bind the company.”
6. Question: The BLA provided with the solicitation didn’t show a blank for the amount of the BLA.
German Bank’s do not provide a BLA without an amount in it. Therefore would you please be so kind to provide a BLA with an amount in it or a blank for the amount.
Answer: The Government added the amount required for the Bank letters of Assurance (BLA) which is $450,000. The BLA is required to be submitted with your firm’s proposal submission.
7. Question: Do we need three separate BLA’s if submitting for all three geographical locations?
Answer: A separate contract will be awarded for each geographical location. Therefore, your firm is required to submit a separate BLA for each geographical location if you propose for each geographical location.
8. Question: On Page 123 of the SOW under g, is mentioned: “associated Seed Project bid schedule (s) as applicable”. We couldn’t find any Seed project in the solicitation. Would you please clarify.
Answer: This is an error. An associated seed project bid schedule will not be applicable to this solicitation.
9. Question: Regarding Section C: Contract Price Table Line Item Description: The price table includes more than 70 line items and many more sub items for which we need to obtain competitive bids from local subcontractors. The solicitation period of 4 weeks is very short considering the number of line items that we need to obtain pricing for. The line item descriptions are very detailed (which is good) but only in English (which is a problem for the local contractors that regularly do this work).
9a. Would it be possible for the Government to provide a courtesy German translation of the Price Table?
9b. Would it be possible for the Government to provide a courtesy German translation of the Line Item Descriptions?
9c. Would it be possible for the Government to provide additional time (say two weeks) for us to translate the price table and line item descriptions and resolicit competitive pricing from subcontractors?
Answer:
9a. Unfortunately, the Government will not provide a courtesy German translation of the Price Table.
9b. Unfortunately, the Government will not provide a courtesy German translation of the Line Item Descriptions.
9c. This Amendment extends the proposal due date to Monday, 05 August 2013, 1500 hours Central European Time (CET).
10. Question: Regarding Letter of Assurance/Letter of Guarantee, the Letter of Assurance clause on page 133 seems to require a letter be provided with our proposal that is similar to the sample on page 140, and then if we are awarded the contract, we would need the bank to provide a Letter of Guaranty similar to the sample on page 141. However, this proposal is for an IDIQ MATOC, so we assume that any bonding would be required for individual task orders (i.e., performance) rather than the entire contract, which doesn’t actually guarantee any work or performance will be required. Could you please clarify the bonding requirements?
Answer: Bank Letters of Assurance (BLA) are required to be submitted with the proposal submission as required by the solicitation. Bank Letters of Guarantee (BLG) are required to be submitted after contract award and upon the issuance of task orders. The sample BLA and BLG letters on page 140 and 141, respectively are template letters that must be submitted by your firm verbatim.
11. Question: Regarding the Price Table Line Item 0057 Dust Control: The detailed description states that a minimum of 2,000 m will be ordered per task order; however, the table gives an estimate of 1,000 m. Which is correct?
Answer: the Solicitation task description will be amended to state a minimum of 1,000 m.
NOTE: Questions may not be submitted after Tuesday, 23 July 2013 at 1500 hours Central European Time (CET).

Purpose and Scope
The objective of the contract is to provide a Firm Fixed Priced (FPP), Indefinite Delivery, Indefinite Quantity (IDIQ), Multiple Award Task Order Contracts (MATOCs) to provide support for reducing/preventing erosion and controlling dust and the protection of natural resources at the following US Garrisons (USAGs): USAG Grafenwoehr, USAG Hohenfels, and USAG Stuttgart, but will include other training areas as well. This solicitation will cover multiple contract awards with a total capacity of $8.5M for each US Garrison up to $25.5M total ($8.5M times three). The $8.5M capacity shall be the total ceiling (capacity) for each US Garrison, and shall be competitively bid on a Task Order basis between each of the successful awardees for that US Garrison. Up to three (3) IDIQ Erosion Prevention/Dust Control and Natural resource Protection Contracts will be issued at each Garrison under this solicitation, USAG Grafenwoehr, USAG Hohenfels, and USAG Stuttgart. These FFP, IDIQ, MATOCs for services will be awarded on a full and open competitive basis.
Note that although the primary focus of this contract is at USAG Grafenwoehr, USAG Hohenfels, and USAG Stuttgart, the Contractor may be required to perform similar work, with a maximum of 15% of work, at other U.S. installations elsewhere within Germany. The work will primarily focus on US Army Europe (USAREUR) installations within Germany, but could extend to any other facilities (US or non-US) located throughout Germany.
The Contract(s) awarded as a result of this solicitation shall be awarded on the basis of best overall value to the Government using a trade-off process, weighing both technical approach and price. The detailed scope and locations for the work will be specified under individual task orders.
This solicitation will cover multiple contract awards (up to three for each Garrison) with a total capacity of US $8,500,000.00, for each US Garrison: USAG Grafenwoehr, USAG Hohenfels, and USAG Stuttgart. There is no limit in the number of Task Order(s) that may be executed.
The contract will end upon reaching the total term of five (5) years or upon reaching the total capacity or an option period is not exercised. Each awardee of a contract for each Garrison shall have a fair opportunity for task orders. All contracts in each Garrison shall be funded by the $8,500,000.00, contract maximum, which, shall not be exceeded. There will be no more than three (3) contract awards per Garrison: USAG Grafenwoehr, USAG Hohenfels, and USAG Stuttgart.
Period of Service
Day one of the contract shall be the Contracting Officer signature date. The ordering period for the contract will automatically end up on the completion of the base period, if the option period is not exercised. Task Orders may be issued up to the date of contract expiration. Modifications to individual task orders may be issued after the expiration of the contract ordering period.
The contract will include a base period (one year) and four (4) one-year option periods, for a total contract performance period of five years. If ordering capacity is fully utilized for any period before the one-year time limit, the Government may decide to exercise the next option period and adjust the contract performance dates. The maximum overall cumulative value of all work awarded under the contract resulting from this solicitation will be $8,500,000.00 for five
(5) years, over the life of the contract. The task order minimum limit is $2,500.00 and the $1,000,000.00 each. Approximately $1,700,000.00 will be utilized per year for the base and each of the four option years per Garrison. Other than this, there is no limit to the number and size of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations. The Government reserves the right to divert the Contractor to work on TOs of higher priority. In such cases, time extensions will be granted for completion of TOs that have been delayed because of Government directions.
The awarded contracts shall have a total guarantee minimum amount of $10,000.00 for the entire contract. The guaranteed minimum may be met with the obligation of a task order meeting or exceeding the guarantee amount and shall be de-obligated when the obligation occurs.
Ordering Procedures for Task Orders
As each project is identified for execution under this contract, a Request for Proposal (RFP) will be issued to the Contractor. Each RFP letter will contain the project title, project location, list of major tasks to be accomplished, schedule for negotiations, and the name of the Government Negotiator. As attachments to the RFP the Government will provide, as necessary, proposal format information and applicable project background information. Scopes will vary in detail and clarity but will provide an adequate description of the actual services required to allow suitable negotiations. Typically the individual Task Orders will provide the Contractor the start of work, location, description of work, and time of execution. When applicable, the quantities of a particular item that is required will be stated and a map/sketch showing the work locations will be included.
All submissions shall be in English unless otherwise requested. The Price Table shown in Section B of this contract will be used as a basis for developing cost proposals, negotiating and coming to a agreed upon cost of the required work under a Task Order. A detailed explanation of the efforts that are to be included in most of the line items is given in Section C.5 of this Scope of Work. The remaining line items should be self-explanatory.
As required under the Task Order, the Contractor must receive approval from the Contracting Officer or the COR on all site specific plans (i.e., HASP, Work Plans, QA/QC Plans, etc.) prior to initiating any on-site activity.
It is the Contractor’s responsibility to obtain base access from Base Commanders in accordance with AE Regulation 190-16, Installation Access Control, dated 5 December 2002. Failure to obtain base access may result in termination of the Contract.
The Government reserves the right to issue additional solicitations and award additional contracts within the region covered by this solicitation. In addition, this contract may be combined with other Government contracts for the purpose of better competition. In this event, other contractors, in accordance with the terms of their contracts, may compete for Task Orders with the Contractor selected under this solicitation.

C.1.3 Guarantee: The awarded contracts shall have a total guarantee minimum amount of US $10,000.00 for the Base period. There are no minimum guarantees for option years that are exercised by the Government. The guaranteed minimum may be met with the obligation of a Task Order meeting or exceeding the guarantee amount and shall be de-obligated when the obligation occurs.
C.1.4 Introduction.
This contract provides support for reducing/preventing erosion, controlling dust, and protecting natural resources within the following US Garrisons: USAG Grafenwoehr, USAG Hohenfels, and USAG Stuttgart, but also to include other training areas as well. Work includes the servicing of existing and construction of new check dams and other erosion control structures and any additional erosion protection measures required. The ongoing erosion control work is required in areas (1) in or immediately adjacent to watercourses; (2) of overland flow from rainfall or snowmelt; and (3) where maneuver actions have exacerbated erosion problems. Dust control, vegetation maintenance and removal, and aerial seeding are also required within the training areas and can be performed under this contract.
Landscape Preservation - The Contractor shall give attention to the effect of contract operations upon the landscape, shall take care to maintain natural surroundings, and shall conduct the work in compliance with the following requirements: a. The Contractor shall take sufficient precautions to prevent pollution with fuels, oils or other harmful materials; and b. The Contractor shall clean up all garbage left at the worksite. Subcontractor Approval - The contractor may use rental equipment and/or subcontractors. The Government shall approve the use of any subcontractors. The contractor shall provide the Government with the make, model, manufacturer, date and operator's qualifications for substitute equipment and operators.
C-1.5 Scope of Work In order to control erosion within U.S. military facilities and/or to reduce the adverse effects of these erosive actions the military continuously performs erosion control measures throughout the training areas. In addition to general ongoing repair work, the military constructs features such as trafficable crossings, check dams, roadways and/or other erosion control measures along water courses. Approximately 150 check dams can be found in the training areas. Each year, ongoing maintenance is performed on these structures in order to assure their continued proper functioning. Beyond the upkeep of the existing erosion control structures, erosion problems along watercourses and other areas that erode as a result of adverse weather conditions and/or troop movement need to be re-stabilized on a periodic basis. Additionally, structures such as culverts and maneuver roads may need to be repaired when there are associated erosion problems.
These actions assist with carrying out a program of planning for, and the development of, maintenance, and coordination of natural resources related services. This includes fauna habitat improvements or modification, range (or training area) rehabilitation where necessary for support of protected species, and generally supporting the execution of the Integrated Natural Resources Management Plan (INRMP). This also includes prevention and control of invasive species in accordance with the INRMP and EO 13112, Invasive Species/ DoDI 4715.03 and
4150.07 . Specific actions include the detection and response to eradicate or control populations of invasive species along with monitoring the results. More specifically, natural resources management actions include, but are not limited to, mapping of the occurrence of invasive species, repairing infrastructure that provides access to buildings housing threatened or endangered species, improving access to bat roosts, camera/monitoring systems , maintenance and installation of bird and bat nesting boxes, maintenance of historic orchards, collection of scions from historic fruit trees, and documentation of management actions. Any plan or project not directly connected with or necessary for the management of German designated areas of the European net “Natura 200,” but likely to have a significant effect thereon, either individually or in combination with other plans or projects, shall be subject to appropriate assessment of its implication for the site in view of the site’s conservation objectives.
The Contractor shall furnish all personnel, materials, and services required to reduce erosion through the repair, maintenance, improvement or construction of control structures or protection of deteriorating terrain within areas used by the U.S. military in Germany. These services will be requested through individual Task Orders (TOs) issued under this contract. To accomplish these goals the Contractor shall provide a wide range of services including, but not limited to:
a. Preparation of work plans for erosion control work
b. Protecting/preventing/repairing eroded (or potentially eroding) areas
c. Repairing/constructing check dams, retention basins, and dams
d. Installing simple wooden control structures
e. Cleaning water courses
f. Repair/placement of pipelines
f. Aerial and ground seeding
g. Construction of trafficable crossings
h. Dust control measures
i. Repair of maneuver trails, access and maintenance roads, and tank roads
j. Repair of sinkholes
k. Brush clearing/tree pruning for Threatened and Endangered Species (TES) maintenance and to meet training requirements
l. Constructing and maintaining roads and trails for training purposes.
m. Engineer designs, plans, and studies for land rehabilitation and maintenance in technical English and
German.
n. Land and Watershed Management (including vegetation clearing, tree pruning, and invasive species removal)
o. GIS – mapping, database management and database development
TASK ORDERS (TOs)
The Contractor provides proposal pricing based off Price Table described herein. Other tasks not specifically listed herein, but nonetheless related to the overall intent of the Contract and tasks described herein, shall be negotiated on a per Task Order Basis. The Contractor shall receive notice that the Government intends to award a Task Order through a Request for Proposal. The Contractor will have, at a minimum two (2) weeks notification prior to any equipment mobilization.
Unless otherwise directed by the Contracting Officer, each Task Order will be competitively bid between each successful offer for the USAG where the work will be performed. The Contractor shall submit a proposal based on the pricing submitted in the Price Table. It is important to note that the Price Table, submitted by each Contractor and accepted by the Government via Contract award, represents the maximum amount that each Contractor can bid for that particular task. If it so chooses, the Contractor may submit a price for a particular task that is less than the amount listed for the particular task in the Price Table. The Government will review each proposal submitted and determine which proposal is the best overall value for the Government based on a lowest price, technically acceptable basis.
The following types of TOs have been identified for possible execution under this contract:
C-2.1 Preparation of Work Plans for Erosion Control Work Under an individual TO, the Contractor may be asked to develop a work plan. This work may include, but is not limited to, performance of a check dam and/or retention basin survey (determining the need for check dams/retention basins), design of check dams and/or retention basins, torrent structures, placement of pipelines, or any other erosion control measures deemed appropriate. The TO will specify work plan requirements, including the identification of sites to be evaluated, distribution of the document, format, etc.
C-2.2 Protecting/Repairing Eroded Areas Under an individual TO the Contractor may be required to correct or improve problem areas in the training areas where erosion has occurred or where there is danger that this could occur in the future. Actions that could be requested include re-contouring terrain through the movement of soil in or adjacent to the site or the addition of material supplied from off-site; compacting these areas; placing topsoil; and/or seeding. In areas where it has been determined that protection measures are required or where the existing measures have failed, the Contractor may also be required to install and secure erosion control mats, place quarry rock, or perform other erosion control measures deemed appropriate. Some repair of maneuver trails, service roads, and/or tank roads may be required in order to redirect vehicular traffic away from areas that are subject to erosion.
C-2.3 Repairing/Constructing Check Dams/Retention Basins/Dams Based on information obtained from the check dams, retention basins and/or dams survey (or from dam inspections) the Contractor may be requested to correct the identified deficiencies. This work could include erosion repair; re-contouring and strengthening areas where settlement has occurred; replacement of broken end culverts at check dam, retention basin, and/or dam structures; clearing clogged drainage pipes; removal of vegetation (small trees etc.); refilling holes created by small animals, training exercises, or any other repair work deemed appropriate. Shall the need be identified, new check dams, retention basin, and/or dams could be constructed under this contract. In this instance, soils investigations, physical testing and any design analysis required for this structure would typically be performed under a separate contract. Line items from this contract would then be used to construct the check dam, retention basin, and/or dams. Examples of typical check dams are included as Figures 1A and 1B.
C-2.4 Install Simple Wooden Structures To restrict the flow of water the Contractor may be requested to install wooden control structures such as torrent structures. Example diagrams of torrent structures are attached as Figures 2A and 2B.
C-2.5 Cleaning Watercourses Work required of a Contractor under an individual TO could include the removal of sediment, debris, small trees, etc., along water courses (typically within 10-year high water limits) in order to assure the unimpeded flow of water.
C-2.6 Repair/Placement of Pipelines Short stretches of pipeline may need to be replaced or installed in order to direct water in a manner that will reduce erosive forces. This could include installation of pipelines under roadways. Typically, feasibility studies would not be included in this contract. This contract will only be used to install the desired structures.
C-2.7 Aerial Seeding In instances where large areas need to be seeded this may be accomplished through aerial seeding with a aircraft.
Specific details regarding aerial seeding are included in Appendix A. Work required of an individual contractor would include the use of a plane to perform aerial seeding, to be priced on a per hour basis (flight time only), with a minimum of 3 hours usage per task to include flight time to and from a local airport.
C-2.8 Trafficable Crossings Trafficable crossings are constructed to provide accessible vehicular crossings of low areas, typically valleys.
C-2.9 Dust Control The Contractor shall apply dust control in areas specified under an individual T.O. The application of dust control chemicals is performed to reduce the raising of dust along roads, thereby reducing potential for decreased visibility of military vehicles.
C-2.10 Maneuver Trails This contract may be used to construct maneuver trails.
