1 22.403-1 Construction Wage Rate Requirements statute
40 U.S.C. chapter 31, subchapter IV, Wage Rate Requirements (Construction), formerly known as the Davis-Bacon Act, provides that contracts in excess of $2,000 to which the United States or the District of Columbia is a party for construction, alteration, or repair (including painting and decorating) of public buildings or public works within the United States, shall contain a clause (see 52.222-6) that no laborer or mechanic employed directly upon the site of the work shall receive less than the prevailing wage rates as determined by the Secretary of Labor.
2 Question Asked as a result of the Site Visit Held March 8, 2016
1. Just a heads up, the Solicitation # on SF 1449 does not match, check Block 5. Just trying to keep you out of trouble. Have a great day!
The correct Solicitation # in Block 5 should be TIRMS16R00002
2. According to the site visit information that was posted on FBO on March 1st, the due date is listed as March 29, 2016.
Amendment 1 issued to show the changes of dates
3. Can you please tell us if a correction will be posted to FBO and when the wage determination information will be posted as well?
Wage determination is incorporated into solicitation
4. Can you please tell us if this will be a union contract and if so when we might expect to see the CBA posted?
No, it is not mandated as union Employees. However, the Federal Prevailing Wage Criteria has to be met
5. According to the Instructions to Offerors, “Proposal Submission Requirements”, Number 6 states “Proposals shall be stamped ‘SOURCE SELECTION SENSITIVE”. Can you please tell us exactly where you would like this disclaimer? (i.e. on all pages of the proposal, the cover page, etc.). Also, can you please tell us if it is to be “stamped” or if “typewritten” is acceptable?
Typed or stamp is acceptable
Page - 3
6. On 03/10/16, a new solicitation was issued on FBO, see attached. In box 6 and 8, the dates have changed. Per this document, the due date is 01/13/16. On the site visit document (also attached), the due date is 03/28/16 by COB. Please advise on the corrected proposal due date.
Correct date for submission of proposals is 3-28-2016 COB
Also, the 03/11/16 change appears to be text only on FBO, stating: “Changes in submitting proposal to Solicitation TIRMS16R00002 are now required to be submitted electronically as a pdf file to eFax 866-275-9299.” Does this mean physical binders are not required, OR that electronic copies are acceptable in lieu of physical copies?
Physical binders are not required. Only Electronic copies are acceptable and need to be submitted as zipped pdf files by 5:00 CST March 28, 2016.
If an electronic copy is the only required submission, does the IRS have data limits for electronic transmissions?
Needs to be submitted as a zip pdf file; there are no data limits
7. The amendment made on FBO on March 10th (Solicitation 2) stated that a change was made to the SF1449 Block #5 correcting the solicitation number. However in the attached file TIRMS16R00002, the SF1149 block #5 still carries the old solicitation number, and the Due date appears to be inaccurate stating 2016-01-13.
Solicitation 2 was created incorrectly and has been removed. The correct Solicitation # in Block 5 should be TIRMS16R00002. The due date is March 28, 2016 COB as shown in the FBO posting
In addition, the Instructions to Offeror (Section 10. 52.212-1) is different from the original solicitation posted
