About this file
This is a Sworn Statement Under Section 287.133(3)(a), Florida Statutes, required for entities bidding on public contracts with the City of Winter Park, Florida, regarding compliance with public entity crime prohibitions. The document serves as a mandatory certification that neither the bidding entity nor its officers, directors, executives, partners, shareholders, employees, members, or agents active in management, nor any affiliate of the entity, have been convicted of a public entity crime (defined as violations of state or federal law involving antitrust, fraud, theft, bribery, collusion, racketeering, conspiracy, or material misrepresentation related to public entity transactions) subsequent to July 1, 1989. Signatories must indicate one of three statements: that no convictions exist; that convictions do exist; or that convictions exist but have been subject to a subsequent administrative hearing that determined non-placement on the convicted vendor list. The statement must be notarized and submitted to the contracting officer, with validity extending through December 31 of the calendar year in which it is filed.
The sworn statement is applicable to the Hungerford Elementary School Sidewalk Gaps Safe Routes to School project, a capital improvement initiative in Orange County requiring approximately 2,651 square yards of 4-inch concrete sidewalk, 748 square yards of 6-inch concrete sidewalk, 2,430 square yards of concrete removal, 650 linear feet of concrete curb and gutter, and two Rectangular Rapid Flashing Beacon systems. Bidders must submit this certification electronically via the City's e-Procurement Portal by February 11, 2026, at 2:00 p.m. EST, with the deadline for submitting questions set for February 2, 2026. The project is funded through the Safe Routes to School program and subject to federal and state compliance requirements, including DBE requirements and prevailing wage rate standards. All prime contractors must have an approved DBE Affirmative Action Plan on file with the FDOT Equal Opportunity Office prior to contract execution, and bidders must provide performance and payment bonds equal to 100 percent of the contract price and general liability insurance of $1,000,000 per occurrence.
