Amendment issued to answer received questions and make PWS corrections.

Q8. The answer to question 1 from amendment 0001 is not clear. The quantity of 500,000 EA does not equal the weight or possibly the number of drums. What is one EA?

A8. See PWS 1.3.1 for explanation of the transportation charges. The quantity of QT2101 does not match the combined quantity of Q2105 and Q2170 because, as noted in A1 from amendment 0001, it assumes a quantity of oil removals under Q2260. Per PWS 3.3, when Q2260 is ordered CLIN QT2101 will not be ordered.

Q9. The Government MHE on base are only able to lift 10 tons, so a 20 foot container can't be loaded with the maximum weight capacity. This should be clear to all bidders.

A9. The generator has confirmed ownership of a container handler with no issues lifting 25,000 - 30,000 pounds (15 tons). Additionally, a new 50,000 pound container handler is expected to arrive by the start of the contract.

Q10. Other than the National Petroleum Products Company , is there any other Facility on the Qualified Facility List (QFL) located in Qatar ?

A10. Not at this time.

Q11. Can I assume that all Hazardous Waste is exported other than POL Waste? Where is the Hazardous Materials currently being disposed of?

A11. Correct, all hazardous waste other than POLs are being exported. The other waste is exported to Germany.

Q12. Exactly what CLINS are permitted to be disposed of or treated/ recycled at the National Petroleum Products Company.

A12. Presently CLINs Q2105 and Q2170 are disposed of or treated / recycled at National Petroleum Products Company.

Q13. I do not see any Transporter that is on the “Qualified Transporters List” in Qatar. Are there any Qualified Transports that are approved in Qatar and if so, can you please list the companies.

A13. There is not transporter on the Qualified Transporters List from Qatar.

Q14. If there are no Transporters on the list, can the Contractor propose a Transporter for approval and still qualify according to the PWS that the transporter should be on the Qualified List of Transporters?

A14. A facility or transporter not currently on the respective qualified list can be proposed and will be evaluated to determine if approved. See Addendum to 52.212-01 Instructions to Offerors - Commercial Items - Technical Proposal Requirements on page 38, PWS 16 starting on page 19, and Addendum to 52.212-02 Evaluation - Commercial Items II. Evaluation of Technical on page 40.

Q15. Can the offeror propose a Company that is not on the Qualified Facility List (QFL) for approval as suggested on page 1 of the PWS and in reference to Boom Waste Treatment Company (Qatar) , Rassas Battery Recycling (Qatar)? If the Contractor lists those companies will the contractor be disqualified?

A15. Any proposed facility or transporter not on the QFL, including those listed in Notes to Offerors 8 on page 3 of the solicitation, will require submittal of documentation for the Technical proposal. As identified in Notes to Offerors 8, offerors are cautioned that DLA Disposition Services does not guarantee any of these possible sources will be approved for the QFL.

Q16. If a Company is on the Qualified Facility List, does the Offeror need to provide current licenses and Permits from each Company to qualify technically?

A16. No. In accordance with Addendum to 52.212-02 Evaluation - Commercial Items, II. Evaluation of Technical (2), a rating of acceptable will be given if all disposal or recycling facilities in the technical proposal are approved for placement on the QFL... However, offerors are cautioned to review PWS 14 thru 16 as a company currently on the QFL may not be on the approved list at time of evaluation. Updates to the QFL are performed regularly, and contractors are required to submit updated documentation to keep facilities on the QFL.

Q17. Can you provide a POC to schedule a site visit?

PAGE 2 OF 4 PAGESCONTINUATION SHEET REFERENCE NO. OF DOCUMENT BEING CONTINUED:

CONTINUED ON NEXT PAGE

A17. The DLA POC is Chief Petty Officer Jerrim. A phone number will be provided upon email request to Nathanial.gaunt@dla.mil and john.grimes@dla.mil. However, due to base access requirements, it is possible that a site visit will not be possible prior to solicitation closing. The solicitation closing will not be extended due to a potential offeror's inability to conduct a site visit.

Q18. Is it possible to get email and telephone numbers for the POCs of the facilities on page 3?

A18. A phone number and email address for facility POCs will be provided upon email request to Nathanial.gaunt@dla.mil and john.grimes@dla.mil.

Q19. We found only QADOL1083240 National Petroleum Products Co in the Qualified Facility List. Are the other mentioned facilities also on an acceptable level?

A19. Notes to Offerors 8 states the facilities have been identified as possible sources, but only NPPC is on the QFL. Offerors are cautioned that DLA Disposition Services does not guarantee any of the possible sources will be approved for the QFL.

Performance Work Statement corrections:

2.2.g. Replace DLAI 4541.25 with DLAI 4145.25.

14(d)(3)(vii). Replace Germany's with Qatar's.

The "Technical Requirements" on page 5 are not applicable, but presently unable to be removed due to system constraints.

The solicitation closing is not extended at this time.

Part 12 Clauses

ADDENDUM TO 52.212-04 CONTRACT TERMS AND CONDITIONS - COMMERCIAL ITEMS

(b) Assignment: See DFARS 252.232-7008, ASSIGNMENT OF CLAIMS (OVERSEAS).

(c) Changes:

(1) Changes in terms and conditions of this basic contract may be made only by written agreement of the parties. Formal written agreement of the parties relative to the following terms and conditions is hereby made through contract acceptance or bilateral contract modification, as applicable.

(2) This addendum also serves as the formal written agreement of the parties authorizing revisions to CLIN weights/quantities for task orders issued against the contract. All task order weights are estimated amounts. The contractor can expect that the task order weights will be required to be adjusted upward or downward as removals take place and the actual pounds being removed are measured. Therefore, the Government has the unilateral right to increase the task order weight in those instances where the Government has underestimated the amount of weight that is required to be removed so the contractor can continue performance. The Government has the unilateral right to decrease the task order weight in those instances where the Government has overestimated the amount of weight that is required to be removed. In instances of decreasing weight, these decreases are not subject to FAR 52.212-4(l), Termination for the Government’s convenience. In addition, it is agreed that it is acceptable for the Government to issue task order modifications (e.g., quantity changes, noun descriptions, HIN changes, adding/deleting lines, extending task order end dates, etc.) unilaterally. The contractor will be paid for the actual items and quantities removed per the awarded contract price schedule. If, upon receipt of a unilateral task order modification, the contractor does not agree with the change or changes, the contractor reserves the right to seek resolution with the Contracting Officer. These modifications are only against task orders. No changes are made to the terms and conditions of the contract.

(g) Invoice: See PWS Section entitled DOCUMENTATION REQUIREMENTS, ACCEPTANCE, INVOICING, AND TRACKING.

(k) Taxes: Contract prices are exclusive of taxes or duties. See FAR 52.229-06, TAXES – FOREIGN FIXED-PRICE CONTRACTS; DFARS 252.229-7000, INVOICES EXCLUSIVE OF TAXES OR DUTIES; DFARS 252.229-7001, TAX RELIEF.

(t) This paragraph is revised to read as follows:

(t) System for Award Management (SAM).

(1) Unless exempted by an addendum to this contract, the Contractor is responsible during performance and through final payment of any contract for the accuracy and completeness of the data within the SAM database, and for any liability resulting from the Government’s reliance on inaccurate or incomplete data. To remain registered in the SAM database after the initial registration, the Contractor is required to review and update on an annual basis from the date of initial registration or subsequent updates its information in the SAM database to ensure it is current, accurate and complete. Updating information in the SAM does not alter the terms and conditions of this contract and is not a substitute for a properly executed contractual document.

(2)

(i) If a Contractor has legally changed its business name, “doing business as” name, or division name (whichever is shown on the contract), or has transferred the assets used in performing the contract, but has not completed the necessary requirements regarding novation and change-of-name agreements in Subpart 42.12, the Contractor shall provide the responsible Contracting Officer a minimum of one business day’s written notification of its intention to:

(A) Change the name in the SAM database;

(B) Comply with the requirements of Subpart 42.12 of the FAR;

(C) Agree in writing to the timeline and procedures specified by the responsible Contracting Officer. The Contractor must provide with the notification sufficient documentation to support the legally changed name.

(ii) If the Contractor fails to comply with the requirements of paragraph (t)(2)(i) of this clause, or fails to perform the agreement at paragraph (t)(2)(i)(C) of this clause, and, in the absence of a properly executed novation or change-of-name agreement, the SAM information that shows the Contractor to be other than the Contractor indicated in the contract will be considered to be incorrect information within the meaning of the “Suspension of Payment” paragraph of the electronic funds transfer (EFT) clause of this contract.

(3) The Contractor shall not change the name or address for EFT payments or manual payments, as appropriate, in the SAM record to reflect an assignee for the purpose of assignment of claims (see FAR Subpart 32.8, Assignment of Claims).

Assignees shall be separately registered in the SAM database. Information provided to the Contractor’s SAM record that indicates payments, including those made by EFT, to an ultimate recipient other than that Contractor will be considered to be incorrect information within the meaning of the “Suspension of payment” paragraph of the EFT clause of this contract.

(4) Offerors and Contractors may obtain information on registration and annual confirmation requirements via SAM accessed through https://www.acquisition.gov.
