About this file

This is a memorandum from Cindy Palmer, Chief Procurement Officer of the Arizona Attorney General's Office (AGO), documenting a procurement decision for the Procurement File AG16-0003. The document involves the AGO, ThoughtSpan Technology LLC, and references integration with Porter Lee Corporation's BEAST system.

The memorandum details a Criminal Complaint Intake and Management Software System originally awarded to ThoughtSpan Technology LLC on December 16, 2015, following an RFP issued on July 22, 2015. The contract was renewed for 48 months, and the AGO seeks to negotiate continued maintenance and updates with ThoughtSpan. The rationale for sole-source procurement includes the software's proven performance, existing staff training investment, system integration with other AGO software, and cost-effectiveness of maintaining versus replacing the current system. The procurement is being pursued under A.R.S. § 41-2537, which allows for negotiation when competitive quoting is not practicable.

OFFICE OF ATTORNEY GENERAL KRIS MAYES

OPERATIONS DIVISION/PROCUREMENT SECTION

MEMORANDUM

TO: Procurement File: AG16-0003

FROM: Cindy Palmer, Chief Procurement Officer

DATE: October 10, 2023

RE: Competition Not Practicable in Accordance with A.R.S. § 41-2537

The Office of the Arizona Attorney General (AGO) issued an RFP for a Criminal Complaint Intake and Management Software System on July 22, 2015. The award was made to ThoughtSpan Technology LLC on December 16, 2015. The contract was renewed for 48 months pursuant to Special Terms & Conditions, Section

2.4. The AGO is satisfied with the software and continues to use it.

It would be advantageous to the State, the Office of the Arizona Attorney General, to negotiate a contract with ThoughtSpan Technology LLC to maintain and update the software. The software continues to work well and it is much cheaper to maintain the software than to replace it. The AGO has also invested much in training staff to use the software. The cost for retraining can be expensive. The existing software system also integrates with the AGO’s Consumer Complaint Management Software System and Porter Lee Corporation BEAST. This should save the State time, effort and money and also result in a more favorable outcome for the State.

This procurement is determined not practicable to quote per A.R.S. § 41-2537. A contract advantageous to the AGO and the State of Arizona shall be negotiated with ThoughtSpan Technology LLC.

This is in accordance with A.R.S. § 41-2537.

Cindy Palmer Chief Procurement Officer
