SectionQuestionAnswer
L.19.2, page 118Is the term “offeror” (L.19.2, page 118) as it applies to past performance defined as only the prime? Or can the past performance requirements be met by the prime and its subcontractors?Provision L 19.2 has been updated to include the following: at least two (2) of the past performance contract profiles shall be for services performed as the prime contractor.
L.19.2, page 118Since any task order under $5M under this procurement will be reserved for a small business (B.2, page 5), will the government consider changing the past performance requirement for SDVOSBs from $10M to $5M (L.19.2, page 118)?L.19.2 has been updated to include the following: For the purposes of similar size, dollar value will be evaluated in one of the two followings ways: (1) multiple simultaneous task orders with an overall value of at least $5 million in geographically dispersed locations; and/or (2) a contract vehicle with a maximum value similar to the maximum quantity B.3
Do you anticipate that there will be aviation related tasks (airfield security to include K9 training, aerial port/logistics training to ensure proper tracking of personnel/cargo and safe aircraft loading/safe aircraft center of gravity, etc)?Any requirement for aviation services will be determined at the task order level.
Can I bid on individual items on this list, say a few items at a time, as I get my bid ready?or do I have to offer my bid on the full list at one time? No. Provision L.19.3.2(28) has been updated to include the following: The IDIQ award shall be based, in part, on an aggregate basis for all supplies listed in Pricing Table 6. These supplies are also listed in Section J, Attachment 3 – Equipment List. Offerors that do not quote an NTE unit price per contract period for each item in Pricing Table 6/Attachment 3 shall not be eligible for award.
Can I use imported items to bid this RFQ ? (I have supplied imported items to prime contractors on this bid, in the past). The term "imported" does not appear in the solicitation.
Where are your requested quantities listed ? so I know how many, for the RFQ, and time frame for production.?For the purposes of Attachment 3 and pursuant to B.14 (d), each negotiated NTE unit price is based on a quantity of one per unit of measure (e.g., one each hat, one pair of boots) and otherwise as described in Attachment 3 – Equipment List in Section J.
Are we allowed to participate and bid on DOS tenders, or do we need to have a US registered company?Offerors are restricted to companies that can obtain a security clearance. The Government will sponsor U.S. Companies that do not have a clearance as identified in Clause H.19 of the IDIQ.
Technical Proposal, Sub Factor 3: Operational/SituationalCompetency, para (b) states:Is it the Government’s intent in this requirement for the offeror to describe specific country conditions in the countries of each active mission, or the specific country conditions in the TCC countries where training will take place?Describe the conditions of each active mission
Sample Task Order: ACOTA Training in TCC Togo. States, in para 2.6.2:

2.6.2 The Contractor shall plan, design and conduct PSOSST training in accordance with the IDIQ Section J, Attachment 6 Training Courses Section C.1.2.6.

Attachment 6, Training Courses Section C.1.2.6 PSO Soldier Skills Training states:

“Training shall include Close Quarters Marksmanship (CQM) including day and night live-fire.PSOSST training shall include individual and collective training for all topics listed below.”

This requirement specifies CQM, but not the basic marksmanship that would normally precede CQM (zero and qualify). Is it the Government’s intent for the offeror to assume that the TCC soldiers being trained will have already completed basic marksmanship and report to training with zero’d weapons, or should we assume that we will also conduct basic marksmanship for the 850 soldier battalions. This has a significant affect on the schedule. The requirement for PSOSST training has been removed in its entirety. Refer to Section 2 of the revised sample task order for training requirements.
Sample Task Order: ACOTA Training in TCC Togo. States, in para 2.6.2Is it the Government’s intent for this Crew Served Weapons Training to include the entire 10 day course of instruction as outlined in Attachment 6, Training Courses Section C.1.2.18 PSO CREW SERVED WEAPONS (CSW) or to limit the training to conducting live-fire training during day light and hours of limited visibility for all the battalions’ weapons systems.Refer to Comment 10
Sample Task Order: ACOTA Training in TCC Togo. States, in para 2.6.2Is it the government’s intent to include mortars as part of the Crew Served Weapons Training, as outlined in C.1.2.21 Attachment 6, Training Courses Section PSO MORTAR TRAININGRefer to Comment 10
Sample Task Order: ACOTA Training in TCC Togo. States, in para 2.6.2Teaching Offensive Operations are potentially lengthy training cycles. The Manual for the UN Infantry Battalion (Vol I) states that The Statement of Force/Unit Requirements, Mandate, Force Commander’s Directive, the CONOPS and Operational Orders will clearly outline the “Mission Essential Tasks” that are to be executed by the battalion in a designated AOR, subject to the applicable ROE. There are sixteen tasks that have been identified as peacekeeping related tasks from which mission-specific essential tasks could be drawn out for a particular mission based on its particular mandate and operational environment. Is it the government’s Intent that the Offensive Operations taught as part of PSOSST be drawn from the Mission-Specific Essential Tasks such as Cordon and Search or Extract/Evacuate for the specific METL of each UN Mission?Refer to comment 10
Sample Task Order: ACOTA Training in TCC TogoBoth Pre-deployment peace operations training tasks (UNIFIL and UNMISS”) have start dates for the PSOSST of 1 April 2016 with 25 training days, but the base period of performance is one year. Is it the Government’s Intent for both battalion units to be in PSOSST simultaneously, or is it the Government’s intent for the battalion units to be trained sequentially over the course of the base period of the contract?Refer to comment 10. Revised training requirements shall be conducted in accordance with Appendix A in the revised Sample Task Order. UNIFIL and UNMISS training shall be conducted concurrently and sequentially in accordance with the tables in Appendix A and B.
Sample Task Order: ACOTA Training in TCC TogoACOTA Training in TCC Togo states, that both CSOS training and the CPX will start on 1 April 2016 for both battalions. Is it the Government’s Intent for the CPX to follow CSOS training as a logical extension of the initial staff training for each battalion?
Refer to comment 14
D.3, Page 33What security requirements are mandated? Do drivers/warehouse workers need security clearances?Refer to Clause H.19 for security requirements. Clearance requirements for personnel will be specified at the Task Order level
D.7, Page 34If US Flag is not available, is it necessary to obtain a waiver from DOS in order to ship Non-US Flag? Under the Open Skies agreement, can EU air carriers be considered US Flag carriers?Yes. A waiver citing a specific exception to the Fly America Act must be approved by the Contracting Officer. Federal travelers are required by 49 U.S.C. 40118, commonly referred to as the "Fly America Act," to use United States air carrier service for all air travel and cargo transportation services funded by the United States Government. One exception to this requirement is transportation provided under a bilateral or multilateral air transport agreement, to which the United States Government and the government of a foreign country are parties, and which the Department of Transportation has determined meets the requirements of the Fly America Act. The United States Government has entered into several air transport agreements that allow federal funded transportation services for travel and cargo movements to use foreign air carriers under certain circumstances. There are currently four bilateral/multilateral “Open Skies Agreements” in effect. Information on the four Open Skies Agreements (U.S. Government Procured Transportation) and other specific country agreements may be accessed via the Department of State’s website. Federal Travel Regulation (FTR) Bulletin 11-02 and Bulletin 12-04 provides additional information and guidance on Open Skies agreements.
L.19.2 page 118Requiring 3-6 Contract Profiles with such stringent criteria appears to disadvantage small business competitors. Is it the government’s intent that the criteria described in (1) and (2) above be for the aggregate of all past performance Contract Profiles submitted?Refer to comment 3. Similar size will not be calculated on an aggregate basis. Each past performance contract profile must meet one of the similar size standards identified in L.19.2.
L.19.2 page 118Is the requirement to submit contract profiles where the company performing was a prime contractor on the referenced effort even if they are a subcontractor on this effort or is the requirement for the prime on the ACOTA solicitation to submit two contract profiles?Refer to comment 2. Pursuant to L.19.2, the offeror shall submit at least three past performance contract profiles. L.19.2 has been revised to update the following: At least two (2) of the Past Performance Contract Profiles shall be for services performed as the prime contractor.
H19, page 69Given the current backlog on gaining security clearances, what flexibility will the government provide regarding periodic clearance renewals? Initial clearances? The contractor should submit requests for PCLs expeditiously. DOS will accept interim PCL’s issued by Defense Security Service. It is DOS’s understanding that there isn’t a large backlog on DSS issuing Interim PCL’s
H.19 and labor category descriptions page 69, Attachment 7H.19 states that a Secret facility clearance is required, yet labor category descriptions to do not appear to identify which positions require a Secret clearance. Will the government please indicate which positions require Secret clearances?Pursuant to H.19(f), clearance requirements for personnel will be specified at the Task Order level

ref L.12, SubcontractingIs the subcontracting value limit of 50% applied to the contract as a whole or to each task order individually. Some Task orders may be heavy in one particular skill area, favoring either the prime or a subcontractor. Managing the subcontracting limitation at the contract level may be advantageous to the government.Although the FAR Limitations on Subcontracting clause, FAR 52.219-14, does not address IDIQs, task or delivery orders, the GAO has held that the subcontracting limitation FAR clause “applies to the contract as a whole and does not require that each delivery order placed under the contract satisfy the requirements of the clause.”
Ref : L.12, SubcontractingSection 1651 of the National Defense Authorization Act (NDAA), P.L. 112-239 amended the criteria for complying with the 50% rule for set aside contracts. In addition to simplifying how the permissible amount of subcontract work is computed, the NDAA expanded permissible subcontracting opportunities for small businesses under set aside contracts. Will the government approve splitting of the minimum 50% SDVOSB workshare among two or more “similarly situated” small businesses as stated in the Defense Authorization Act of 2013?The proposal shall be submitted in accordance with FAR 52.219-14, limitation on subcontracting

Pursuant to Technical Approach, Sub-Factor 1(d), the response for the Sample Task Order shall not exceed sixty (60) pages, and shall be submitted as part of an offeror's technical proposal.
Ref L.19.1, M.9.1Subfactor numbering in this section appears to be inconsistent, for example there are two each of subfactors 1,2,3. Should the subfactors be numbered sequentially, or are some second-tier subfactors, or do the factors apply to different volumes?Pursuant to L.19.1, The Offeror’s Technical Approach proposal shall include the following three sub-factors:

1. Sample task order;

2. Risk analysis plan;

3. Operational/Situational Competency The Offeror’s Management Approach proposal shall include the following three sub-factors:

Please clarify how construction efforts are to be priced and evaluated.Specific construction requirements will be determined at the task order level. Pricing shall be proposed and evaluated at the task order level.
Ref C.1.4.2.1 CONUS Inventory ManagementHigh value items are identified as those over $200.00. Many contracts have a much higher threshold value. Please confirm that $200.00 is the intended high value threshold.Confirm. The threshold is $200

Please clarify where in the proposal Key Personnel resumes are to be submitted, and which position(s) listed in Pricing Table 7 are considered keyRefer to comment 60. H.8 - Key Personnel is a standard clause that will be included at the task order level, as applicable.
Ref Sample Task 2.2.3, 2.2.4All sample task courses have the same estimated start date. Is it required to run all classes simultaneously, or may classes be staggered to maximize effective use of instructors?Refer to Appendix A in the revised Sample Task Order. Please clarify what the intended period of performance is for these construction elements.Refer to comment 40. Refer to 2.7.5 in the revised Sample Task Order. The tent pads shall be constructed prior to the commencement of training.
Ref H.9 (h)The reference paragraph states Contractor personnel may not possess privately owned firearms. Will government firearms be issued to contractor personnel or will government security personnel be provided outside the host country training bases?Government firearms will not be issued and government security personnel will not be provided.
Ref H.9The reference paragraph states that ACOTA task orders will be executed as part of a diplomatic or consular mission. Will contractor employees be authorized diplomatic passports for purposes of this contract?Generally no, but diplomatic passports may be issued at the task order level based on an analysis of specific facts and conditions.
Ref Sample Task, 2.9.2, Attachment 6Please clarify if the Government will supply DOS-approved curriculum, class materials, and courseware for each of the courses listed in Attachment 6 and in the Sample Task. Ref H.7.1Is there a requirement for personnel to deploy through CRC, Ft. Bliss, or a similar pre-deployment center?Specific deployment requirements will be determined at the task order level.
RFP Sections B-M para L.19.2 page 118Requiring 3-6 Contract Profiles with such stringent criteria appears to disadvantage small business competitors.

Question - Is it the government’s intent that the criteria described in (1) and (2) above be for the aggregate of all past performance Contract Profiles submitted?

Refer to comment 3 and 18.
RFP Sections B-M para L.19.2 page 118Is the requirement to submit contract profiles where the company performing was a prime contractor on the referenced effort even if they are a subcontractor on this effort or is the requirement for the prime on the ACOTA solicitation to submit two contract profiles?Refer to comment 19
