3.12 EVALUATION PROCESS

3.12.1 Responsiveness and Responsibility Determination

3.12.1.1 Responsiveness Determination

Responsiveness includes a determination that a Proposal substantially complies with the RFP and all prescribed procurement procedures and requirements.

The SPC will conduct an initial Responsiveness check of each Proposal received prior to Opening/Closing to determine if Proposer has submitted all required documents and information in compliance with the Minimum Submission Requirements section.

Agency will continue its review throughout the evaluation process to determine if a Proposal is Responsive to all RFP requirements. The final determination of Responsiveness includes a determination that the Proposal substantially complies with all submittal requirements, all Services requirements, all System requirements, the State’s security requirements, and any and all other requirements detailed in the RFP and any Addenda/Amendment.

At any time prior to award, Agency may reject a Proposal found not to be Responsive.

If the Proposal or information contained is unclear, the SPC may request clarification from Proposer. However, clarifications may not be used to rehabilitate a non- Responsive Proposal. If the SPC finds the Proposal non-Responsive at any time during the evaluation process, the Proposal may be rejected. Agency may waive mistakes in accordance with OAR 125-247-0470.

3.12.1.2 Responsibility Determination

Agency will determine if an apparent successful Proposer is Responsible prior to award and execution of the Contract. Proposer shall submit a signed Responsibility Inquiry form (Attachment E) with its Proposal.

At any time prior to award, Agency may reject a Proposer found to be not Responsible.

3.12.2 Evaluation Criteria

Each Proposal meeting all initial Responsiveness requirements will be independently evaluated by members of an Evaluation Committee. Evaluation Committee membership may change, and the Agency may use additional or fewer evaluators for optional rounds of competition. Evaluators will assign a score for each evaluation criterion listed in Section

4.10.2 up to the maximum points available as specified in Section 4.11 (Point and Score Calculation).

SPC may request clarifications to assist the Evaluation Committee in gaining additional understanding of a Proposal. A response to a clarification request may only clarify or explain information already included in the original Proposal and may not introduce new information.

The Agency will score Proposer responses using proportional scoring. The highest‑scoring Proposer for each criterion will receive the maximum available points, and all other

Proposers will receive points relative to that score.

3.12.2.1 Number of Titles Provided (30 points – 30%)

For this criterion, “Title” is defined in Section 2.2 and Agency will apply this definition consistently across all Proposals. Titles that are unclear, duplicative, or non‑compliant may be excluded from scoring at the Agency’s discretion.

Evaluators will score Proposers' responses according to the criteria below:

1. The Proposer submitting the largest number of eligible, distinct titles (“Highest # of Titles”) will receive the full 30 points.

2. All remaining Proposers will receive proportional points based on the following formula:

Proposer’s # of Titles

X 30

Proposer’s

Score Highest # of Titles

3. The Agency may request clarification or verification of Title lists and may exclude those not supported by the proposer documentation.

3.12.2.2 Preferred Expanded Training Content (20 points – 20%)

For this criterion, “Evaluated Quality Score” means the raw score assigned by evaluators based on clarity, completeness, responsiveness, demonstrated value, and alignment with Agency’s objectives. The Proposer with the highest such score (“Highest Evaluated Quality Score”) will receive the maximum available points.

1. The Proposer with the Highest Evaluated Quality Score will receive the full 20 points.

2. All remaining Proposers will receive proportional points based on the following formula:

Evaluated

Quality Score X 20

Score Highest Evaluated

Quality Score

3. Evaluators will consider these factors:

Content Quality and Relevance

Quality, accuracy, depth, and relevance of the proposed training content to the Agency’s needs and objectives.

6 Points Possible

Course Variety and Coverage

Breadth and diversity of available training topics, including alignment with preferred content areas identified in Section 2.4.

5 Points Possible

User Experience and Accessibility

Ease of use, navigation, accessibility features, and overall learner experience of the courses.

4 Points Possible

Instructional Design and Engagement

Effectiveness of course structure, interactivity, multimedia use, assessments, and learner engagement strategies.

2 Points Possible

Customer Support Quality of technical support and ongoing customer service.

3 Points Possible

4. Evaluators may disregard incomplete, unclear, or inconsistent RFP requirement information.

3.12.3 PRICE EVALUATION (50 points – 50%)

The SPC will conduct the price evaluation based upon the price proposal sheet submitted by Proposer meeting all requirements set forth in Section 3.2.6(C). The SPC will award a price score to each Price Proposal based upon the percentage of the proposed price as compared to the lowest Proposer’s price using the following formula:

Lowest price of all Proposers

X 50

Price Score Pricing being scored

3.12.4 PREFERENCES

3.12.4.1 Reciprocal Preference

For evaluation purposes per OAR 125-246-0310, Agency shall add a percentage increase to each out-of-state Proposer's Proposal price that is equal to the percentage preference, if any, given to a Resident Proposer in the Proposer's state.

3.12.4.2 Tiebreakers

If Agency receives Proposals identical in price, fitness, availability and quality and chooses to award a Contract, Agency shall award the Contract in accordance with the procedures outlined in OAR 137-046-0300.

3.13 POINT AND SCORE CALCULATIONS

Points are the total possible for each section as listed in the table below.

https://www.naspo.org/reciprocity1

The SPC will average all scores for each evaluation criterion. Price points are calculated as stated in the Price Evaluation section.

3.14 RANKING OF PROPOSERS

The SPC will average the scores for each Proposal (calculated by totaling the points awarded by each Evaluation Committee member and dividing by the number of members). The SPC will add the average score for each Proposal to the Proposer’s price score and assign a total score for each proposal

After any applicable preference has been applied, the SPC will determine the rank of each Proposal, with the highest score receiving the highest rank, and successive rank order determined by the next highest score.

Agency may, in Agency’s sole discretion, determine an apparent successful Proposer with no additional rounds of competition. If additional rounds are conducted, Agency will rank advancing Proposers at the conclusion of each subsequent round and may determine an apparent successful Proposer at any time during the solicitation process

3.15 NEXT STEP DETERMINATION

At the conclusion of a round of competition, Agency may choose to conduct additional round(s) of competition if in the best interest of the State. Additional rounds of competition may consist of, but will not be limited to:

• Interviews

• Presentations/Demonstrations/Additional Submittal Items

• Discussions and submittal of revised Proposals

• Serial or simultaneous negotiations

• Best and Final Offers

3.15.1 Competitive Range Determination

If Agency, in its sole discretion, determines that one or more additional rounds of competition is necessary, it will select a Competitive Range to indicate the Proposers that will be invited to participate in a subsequent round. The Competitive Range may include all, or at Agency’s sole discretion, some (based primarily on a natural break in the distribution of scores), of the Proposers from a previous round. Agency will post a notice in OregonBuys of its Competitive Range Determination and provide details about the process and schedule for the subsequent round.

3.15.2 SCORING AND RANKING OF PROPOSERS FOR SUBSEQUENT ROUNDS

TOTAL POINTS POSSIBLE : 100

TITLE/CONTENT POINTS POSSIBLE 50

4.10.2.1 Number of titles 30

4.10.2.2 Preferred Expanded Training Content 20

4.10.3 PRICE POINTS POSSIBLE 50

If Agency conducts two or more rounds of competition, the rounds will be scored independently. Once the ranking from a previous round is complete and a Competitive Range has been determined, Proposers participating in a subsequent round will compete on an equal basis – scores from the previous round will be set aside and will not carry over. The Proposer with the highest score from the final round will receive the highest final ranking.
