Summary of Robbins Key Contract Specifications

This is a Contract Specifications document prepared by the State of Alabama Department of Workforce for Abandoned Mine Land Reclamation Projects, most recently revised on May 19, 2026. The document establishes the general conditions and administrative requirements applicable to all contracts entered into by the department for abandoned mine land reclamation work. The specifications comprehensively detail instructions to bidders, including qualifications requirements, examination protocols, bid security provisions, and award procedures. Bidders must be licensed general contractors in Alabama, qualified to be bonded for the bid value, with uncompleted work not exceeding their qualification certificate amount. Successful bidders must complete AML Contractor Ownership and Control Information forms under the Federal Applicant Violator System and maintain current registration with SAM.gov. The document specifies that bid documents, including project plans and specifications on flash drives with CAD files, are distributed free at walkaround inspections, with additional copies available at no charge from the Department of Workforce's Abandoned Mine Land Field Office in Vestavia Hills, Alabama. The contract includes detailed provisions for contract time, liquidated damages, performance and labor bonds equal to 100 percent of the contract amount, and various insurance requirements.

The specifications require comprehensive insurance coverage from contractors, including general liability of $1,000,000 per occurrence with $2,000,000 aggregate, professional liability of $2,000,000, automobile liability of $1,000,000 combined single limit, workers' compensation and employer's liability of $1,000,000 per accident, contractor's pollution liability of $1,000,000 per occurrence with $2,000,000 aggregate, and umbrella/excess liability of $5,000,000 per occurrence. The Alabama Department of Workforce must be named as an additional insured on all policies. Contractors are responsible for all permitting, compliance with applicable laws and regulations, safety and protection measures, erosion control maintenance, and completion of work within specified contract timeframes. The department reserves the right to reject any and all bids and evaluates proposals based on bidder qualifications, compliance with prescribed requirements, and unit prices. Payment procedures require submission of applications for progress and final payment supported by required documentation, with the department conducting final inspections before issuing recommendations for final payment and releasing retained contract security.

INSTRUCTIONS TO BIDDERS

A. INSTRUCTIONS TO BIDDERS

INSTRUCTIONS TO BIDDERS

1. DEFINED TERMS

1.1 Terms used in these Instructions to Bidders, which are defined in Section B of the contract documents, have the meanings assigned to them in Section B. The term "successful bidder" means the lowest, qualified, responsible bidder to whom the DEPARTMENT (on the basis of the DEPARTMENT's evaluation as hereinafter provided) makes an award.

2. COPIES OF BIDDING DOCUMENTS

2.1 At the time of the walkaround inspection announced in the Invitation to Bid, one (1) set of project plans and specifications as well as a flash drive with electronic copies of all pertinent documents and CAD files related to the project will be distributed free of charge to all contractors interested in bidding on the work. Extra copies of the plans and specifications, as well as all copies requested after the walkaround inspection, will be available from the Department of Workforce, Abandoned Mine Land Field Office located at 1400 Urban Center Drive, Suite 200, Vestavia Hills, AL. No charge for an extra copy.

2.2 Complete sets of bidding documents shall be used in preparing bids. The DEPARTMENT does not assume any responsibility for errors or misinterpretations resulting from the use of incomplete sets of bidding documents.

2.3 The DEPARTMENT in making copies of bidding documents available on the above terms do so only for the purpose of obtaining bids on the work and do not confer a license or grant for any other use.

2.4 All alternates not specified in these plans and specifications must be submitted with the base bid showing reasons for the alternate bid and a cost analysis of the alternate bid as compared to the similar base bid item. All alternates are subject to approval by the DEPARTMENT.

INSTRUCTIONS TO BIDDERS

3. QUALIFICATIONS OF BIDDERS

3.1 Each bidder must be a licensed general contractor in the State of Alabama, qualified and able to be bonded for the value of the bid. The total amount of uncompleted work to the CONTRACTOR must not exceed the qualification certificate.

3.2 All successful bidders must complete and submit AML Contractor Ownership and Control Information forms for processing under the Federal Applicant Violator System (AVS).

Pursuant to 30 CFR 773.15(b)(1), the DEPARTMENT is prohibited from awarding an AML contract if a surface coal mining operation permitted to the successful bidder (or to any person who exercises ownership/control rights over the successful bidder) is currently in violation of the Surface Mining Control and Reclamation Act of 1977, the state coal regulatory program, or any federal or state law, rule or regulation pertaining to environmental protection. If no violations are identified through AVS, the DEPARTMENT may award the contract.

3.3 All successful bidders must have a current and up-to-date registration with the Federal government through SAM.gov. Successful bidders must provide the DEPARTMENT with their Unique Entity ID to be awarded the contract.

INSTRUCTIONS TO BIDDERS

4. EXAMINATION OF CONTRACT DOCUMENTS AND SITE

4.1 Before submitting a bid, each bidder must (a) examine the Contract Documents thoroughly,

(b) visit the project to familiarize himself with local conditions that may in any manner affect cost, progress or performance of the work, (c) familiarize himself with Federal, State and local laws, ordinances, rules and regulations that may in any manner affect cost, progress or performance of the work, and (d) study and carefully correlate bidder’s observations with the Contract Documents.

4.2 Reference is made to the Special Provisions for the identification of those reports of investigations and tests of subsurface and latent physical conditions at the project or otherwise affecting cost, progress or performance of the work which have been relied upon by the DEPARTMENT in preparing the drawings and specifications. The DEPARTMENT will make copies of such reports available to any bidder requesting them. These reports are not guaranteed as to accuracy or completeness, nor are they considered part of the Contract Documents. Before submitting his bid, each bidder will, at his own expense, make such additional investigations and tests as the bidder may deem necessary to determine his bid for performance of the work in accordance with the time, price and other terms and conditions of the Contract Documents.

4.3 On request, the DEPARTMENT will provide each bidder access to the site to conduct such investigations and tests as each bidder deems necessary for submission of his bid.

4.4 The lands upon which the work is to be performed, rights-of-way for access thereto and other lands designated for use by the CONTRACTOR in performing the work are identified in the General Conditions, Special Provisions and drawings.

4.5 The submission of a bid will constitute an incontrovertible representation by the bidder that he has complied with every requirement of this Article 4 and that the Contract Documents are sufficient in scope and detail to indicate and convey understanding of all terms and conditions for performance of the work.

5. INTERPRETATIONS

5.1 All questions about the meaning or intent of the Contract Documents shall be submitted to the DEPARTMENT in writing. Replies will be issued by addenda electronically mailed or delivered to all parties recorded by the DEPARTMENT as having received the bidding documents. Questions received less than forty-eight (48) hours prior to the bid submission deadline will not be answered. Only questions answered by formal, written addenda will be binding. Oral and other interpretations or clarifications will be without legal effect.

INSTRUCTIONS TO BIDDERS

6. BID SECURITY

6.1 Bid security shall be made payable to the DEPARTMENT, in an amount of five percent

(5%) of the bidder's maximum bid price and in the form of a cashiers or bank check or a bid bond issued by a surety meeting the requirements of Section F, Paragraph 1.1. Not required unless stated in the Special Provisions and/or Invitation To Bid.

6.2 The bid security of the successful bidder will be retained until such bidder has furnished the required contract security, whereupon it will be returned with the fully executed contract as a notice to proceed. If the successful bidder fails to execute and deliver the required contract security within 20 days of the Notice of Intent to Award, the DEPARTMENT may annul the requisition, and the bid security of that bidder will be forfeited. The bid security of any bidder whom the DEPARTMENT believes to have a reasonable chance of receiving the award may be retained by the DEPARTMENT until the award is made.

7.1 The number of workdays within which, or the date by which, the project is to be completed

(the contract time) is set forth in the Supplementary Conditions of this contract and noted in the Invitation to Bid.

8. LIQUIDATED DAMAGES

8.1 Provisions for liquidated damages, if any, are set forth in the Supplementary Conditions.

9. SUBSTITUTE MATERIALS AND EQUIPMENT

9.1 The contract, if awarded, will be on the basis of materials and equipment described in the drawings or specified in the specifications without consideration of possible substitute or "or equal" items. Whenever it is indicated in the drawings or specified in the specifications that a substitute or "or equal" item of material or equipment may be furnished or used by the CONTRACTOR if acceptable to the DEPARTMENT, application for such acceptance will not be considered by the DEPARTMENT until after the bid opening. The procedure for submittal of any such application by the CONTRACTOR and consideration by the DEPARTMENT is set forth in Section G, Article 3.

14.1 The DEPARTMENT reserves the right to reject any and all bids.

14.2 In evaluating bids, the DEPARTMENT shall consider the qualifications of the bidders, whether or not the bids comply with the prescribed requirements, and alternates and unit prices if requested in the bid forms.

14.3 Unit prices are required on all Lump Sum and Unit Price Items of Work. Failure to submit unit prices for all Lump Sum and Unit Price Items of Work will result in the bid being automatically rejected without further consideration.

14.4 If there is an error in calculating the extended price of a bid item, the unit price submitted by the CONTRACTOR will prevail and the extended price will be re-calculated. Likewise, if there is an error in adding the extended prices to arrive at a Total Contract Bid Price, the Total Contract Bid Price will be re-calculated and the resulting price will prevail.
