Proposers must demonstrate a minimum of five (5) consecutive years of business operation and current licensure in Florida as of the RFQ due date, with at least one professional engineer registered in Florida and one member holding AICP certification on the proposed team. Professional services are to be negotiated after qualifications-based selection, with compensation structured as lump sum, hourly rates, fixed per phase, cost-plus, or a combination thereof. The RFQ evaluation criteria allocate 35 points for firm qualifications and experience, 25 points for similar projects and references, 20 points for project approach, 15 points for personnel and project team experience, 5 points for required forms, and 0 points for fee schedule and additional information, totaling 100 points. All responses become public records under Florida Statute Chapter 119, and proposers must identify any information they claim as confidential or proprietary with specific statutory citations. The contract is non-exclusive; the City reserves the right to obtain services from third parties. No performance or payment bonds are required. Professional liability insurance of $1,000,000 minimum, workers' compensation with $1,000,000 employer's liability limits, commercial general liability of $2,000,000 per occurrence and $3,000,000 general aggregate, and comprehensive auto liability of $1,000,000 combined single limit are required.

Dear Potential Proposer:

The City of Sanford, Florida, a municipal corporation existing under the laws of the State of Florida, herein after also referred to as the “City”, does hereby announce that it is accepting written proposals from all qualified firms or individuals interested in providing the services generally described herein and as specified in the “Scope of Services” of this Request for Proposals (RFQ) document. The successful proposer(s) must demonstrate by his/hers qualifications, experience, availability, approach, and work plan that he/she will best serve the overall needs of the City.

If you are interested in preparing a response to this RFQ, please read requirements carefully and complete the proposal in the manner as set forth in this RFQ document. Your response is considered a binding offer to perform in the manner described in the proposal response and shall remain a firm offer for a period not to exceed one hundred eighty (180) days from public opening. Also please be aware that, under the competitive proposal process, the stipulations set forth herein are fully binding on the proposer to the extent that you confirm acceptance by your signature on Attachment “F”, Acceptance of Proposal Terms and Conditions.

There will not be a pre-proposal conference held for this project. Questions regarding this solicitation must be received in writing at the address above no later than Tuesday, October 28, 2025, at 2:00 P.M. Local Time.

Responses to those questions considered material to the solicitation shall be distributed via formal addenda and posted to the City of Sanford website: http://www.myvendorlink.com.

All proposers are advised that under Chapter 119, Florida Statutes, all responses are deemed a public record and open to the public as provided for in said statute.

The City welcomes your response to this RFQ document. Proposals should be prepared in accordance with the RFQ instructions and will be evaluated by the City as stated in the evaluation section of this document. The City reserves the right to waive any formalities, to reject any or all proposals or to re-advertise for proposals for these services. The City may withdraw all or part of this RFQ at any time to protect the interests of the City. All proposers are asked to be thorough yet concise in their response. SECTION 1. PROJECT OVERVIEW.

1.01 INTENT AND PURPOSE.

The City is seeking to establish a new solicitation for the existing vendors under the Consultant Competitive Negotiation Act (CCNA). The size of the work task authorization will be limited to the financial constraints imposed by Section 287.055, Florida Statutes, for professional services secured from a continuing contract.

1.02 BACKGROUND.

The City of Sanford was incorporated in 1877 under the direction of General Henry Shelton Sanford and is located in Central Florida in Seminole County. Nicknamed “Celery City” for its agricultural interest in the early 1900’s. Sanford is bounded in the East by Orlando-Sanford International, in North by Lake Monroe, in the West by the Interstate 4, and in the South by Seminole State College and the City of Lake Mary. The Sanford Commercial District was proclaimed a historic district and placed on the National Register in 1976. The Sanford Residential Historic District, an area of approximately 76 blocks south of the commercials district, was placed on the National Register in 1989.

Located just 20 minutes northeast of downtown Orlando, Sanford’s city government is focused on meeting the needs of businesses looking to relocate and/or entrepreneurs who are seeking the right location to jump-start a new enterprise. One of the fastest-growing areas in Metro Orlando, Sanford is an exciting, thriving community in which to do business.

The City operates under a Commission/Manager form of government and provides a full range of services to include, fire and rescue, police, the construction and maintenance of streets, sidewalks, parks and recreation, storm-water management, solid waste collection, wastewater, water and other infrastructure, engineering, planning and zoning, building inspections, community and economic development, code enforcement, general administration and support services, and recreational and cultural events.

to-exceed a five (5) year contract when in the best interest of the City. The decision to renew or extend the contract shall be at the discretion of the City.

A. As of July 1, 2024, the bill increases the maximum cost for each individual project procured pursuant to the Consultant’s Competitive Negotiation Act (CCNA) from $4 million to $7.5 million, plus an annual increase based on the consumer price index (CPI). This limitation applies to projects procured under the CCNA by the state, counties, municipalities, school districts, special districts, and other political subdivisions.

B. Continuing Consultants Competitive Negotiation Act (CCNA) contracts are limited to projects in which construction cost do not exceed $7,500,000.00 and when the fees for professional services does not exceed $500,000.00, pursuant to Florida Statute 287.055(2)(g), or as amended.

C. Services may not begin until after execution of the agreement and approval or all require documentation.

D. The City reserves the right to re-negotiate rates based on current market conditions during the term of the awarded agreement.

1.04 MINIMUM REQUIREMENTS.

A. The Proposer shall have been in business for a minimum of five (5) consecutive years and shall currently be licensed to perform services within the State of Florida. This requirement shall be based on the Solicitation’s due date. Copies of documentation demonstrating meeting this minimum requirement shall be submitted with your response. Examples of documentation may include, but not be limited to; local business tax receipts for five (5) years, corporation documents with date of inception, certificate of authority, etcetera.

1. If the business headquarters is located outside of the state of Florida, they shall currently be licensed to perform services in both their home state and the state of Florida; and shall have been in business for a minimum of five (5) consecutive years. This requirement shall be based on the Solicitation’s due date. Copies of documentation demonstrating meeting this minimum requirement shall be submitted with your response. Examples of documentation may include, but not be limited to, local business tax receipts for five (5) years, corporation documents with date of inception, certificate of authority, etcetera.

a. In this case the Proposer shall submit to Purchasing a current Certificate of Authority, which is issued through the Department of State and in accordance with Florida Statute 607.1501, within ten (10) business days upon notice of intent to award.

2. The Proposer shall have held and maintained for a minimum of five (5) years a current State of Florida:

a. Business or Corporation shall hold a Certificate of Authorization as an Engineering Services Business; or

b. Individual shall hold a current State of Florida Registered license as required by rule, and have authority to submit certified reports to state agencies (if applicable)

c. The firm must have been established as a legal entity, be licensed in the State of Florida, and the principals of the firm must have performed A&E Professional Services for a minimum of five (5) years.

d. The firm must have completed a quality control peer review within the past three years.

B. Demonstration of Experience: Submission must include evidence of satisfying the following technical qualifications:

1. Technical Design Experience

i. Experience in conventional and /or innovative design particularly that related to urbanized areas, context sensitive solutions, multi-modal designs, and alternative (“green”) materials and design components.

ii. List and provide a brief description of similar projects satisfactorily completed and/or currently bring provided with location, dates of contract, names and addresses, email address, and telephone numbers of owners by completing reference GSA Standard Form SF-330.

iii. Post Design Services

iv. SF-330 Section G: Describe your law firm’s experience working with other municipalities over the past five (5) years performing services relevant to those required in the scope of services herein.

2. Permitting and Compliance experience with SJRWMD, FDEP and other agencies related to design projects.

3. Funding experience. Skills on managing projects, including budgeting, scheduling, and coordination with other professional and stakeholders.

6. Technical Skills software proficiency: competence in industry-standard software (e.g., AutoCAD, Revit for architects; MATLAB, AutoCAD Civil 3D for engineers).

C. Professional Team Members proposed to provide services for this engagement must include at least one (1) Professional Engineer Registered in the State of Florida per Section 287.055 Florida Statues and at least one (1) member with AICP certification. Must include a Project Manager with a minimum of five (5) years’ experience managing or working with Florida municipalities. In addition, the firm must have adequate resources of certified (per each industry standards) professionals (for example, planners, surveyors, environmental consultants, etc.) as needed to ensure the deliverable(s) are met accurately and in a timely manner.

1. The awarded proposer(s) shall perform the following work upon Contract award.

i. Develop architectural and/or engineering design studies for potential projects.

ii. Complete budget development for potential projects.

iii. Prepare specifications and drawings for potential projects.

iv. Assist the City in preparation of Request for Proposal (RFP) or Invitation for Bid

(IFB) packages for assigned projects.

v. Provide construction administration services for assigned projects, including periodic review of works in progress and completed projects to ensure compliance with drawings and specifications.

vi. Contract for and review the drawings and specifications prepared by specialty design consultants; and

vii. Commission completed projects to ensure that they meet with the project drawings and specifications.

2. The following are projects phases that the awarded proposer(s) must complete, though not all phases will be required for all projects:

i. Study: Investigate the issue presented in an effort to gather sufficient information to then work to develop a resolution.

ii. Design Development: Utilize the information gathered in the Study phase to design a solution to the client’s issue.

iii. Construction Documents: Provide documentation of the solution to the issue which can be utilized in an RFP, ITN or IFB for a contractor to implement this solution.

iv. Bidding: Provide support during this phase for answers to questions or for Proposal review.

v. Construction Administration: Provide administrative review over the construction process once the contract has been awarded. This often includes walk-through visits of the site, preparation of meeting minutes, incremental inspection of the work, and review of contractor applications for payment; and

vi. Commissioning: Ensure that the work has been completed in compliance with the original construction documents.

D. Project Budget

i. The awarded proposer(s) shall provide updated budget estimates for the project as part of the Study, Design Development, and Construction Document phases.

E. Fees

i. Fee structure to be negotiated after qualifications selection, in accordance with CCNA.

The compensation must be fair, competitive, and reasonable.

ii. Basis for fee: may be lump sum, hourly rates, fixed per phase, cost-plus, or combination.

iii. For contracts (or phases) over applicable thresholds (per s. 287.017 and 287.055), require a Truth-In Negotiation Certificate: that wages rates, unit costs, etc. are accurate, complete, current at time of contracting.

iv. Scope of Work shall be outlined in Section 00860 Task Authorization Form.

F. The City is seeking to establish a new solicitation for the existing vendors under the Consultant Competitive Negotiation Act (CCNA). A described scope of work shall be developed for each study or service; and an individual work task authorization aka: work order will be assigned to accomplish the work. The size of the work task authorization will be limited to the financial constraints imposed by Section 287.055, Florida Statutes, for professional services secured from continuing contract.

G. Please note: If you have an existing contract under a previous solicitation for Consultant Competitive Negotiation Act (CCNA) you are required to resubmit a new solicitation if you provide Engineering Consulting Services to renew your contract. A new solicitation will be posted separately for additional services. Contracts over the five-year period are null.

i. Section 287.055(2)(g), Florida Statutes; defines a “continuing contract” is a contract for professional services entered into in accordance with all the procedures of this act between an agency and a firm whereby the firm provides professional services to the agency for projects in which the estimated construction cost of each individual project under the contract does not exceed $7.5 million. Beginning July 1, 2025, and each July 1, thereafter, the department shall adjust the maximum amount allowed on the preceding June 30 for each individual project in a continuing contract by using the change in the June-to-June Consumer Price Index for All Urban Consumers issued by the Bureau of Labor Statistics of the United States Department of Labor. The department shall publish the adjusted amount on its website; Study activity if the fee for professional services for each individual study under the contract does not exceed $500,000.00 or for work of a specified nature as outlined in the contract required by the agency, with the contract being for a fixed term or with no time limitation except that the contract must provide a termination clause. Firms providing professional services under continuing contracts shall not be required to bid against one another.

ii. In accordance with Chapter 119 of the Florida Statutes (Public Records Law); and except as it may be provided by other applicable State of Federal Law, all Proposer should be aware the Request of Qualifications (RFQ) solicitation and the responses thereto are in the public domain. contained in their Proposal which they consider confidential and/or proprietary and which they believe to be exempt from disclosure, citing specifically the applicable exempting law.

i. A generic notation that information is “confidential” is not sufficient. Failure to provide the Procurement Division with a detailed explanation and justification including statutory cites and specific reference to your Proposal detailing what provisions, if any, you believe are exempt from disclosure may result in entire Proposal being subject to disclosure in accordance with Chapter 119 of the Florida Statutes.

2.02 It is noted there are a number of disciplines listed in which related services will not be needed or used by the City at a level which predicates the need for establishment of a Master Contract. Therefore, since preparing a response requires time and effort, firms are welcome and encouraged to contact the Purchasing Manager of the City at 407.688.5028 for guidance or information regarding applicability of their firm’s specialty(s) to the needs of the city.

2.03 It is underscored that discipline and experience profile codes must be accurately reflected. In addition, if a firm is to be certified by the city in multiple disciplines, it is essential that resumes of key personnel, relevant projects and experience information include designations and notations regarding discipline and experience profile codes.

2.04 The City of Sanford Purchasing Department does not pre-qualify firms for CCNA solicitations. Firms must submit qualifications for each new CCNA solicitation for which they are interested in providing services.

2.05 The City does not guarantee the number of assignments, if any or the dollar value of fees for work tasks that may be assigned hereunder to any successful proposer. Any agreement resulting from this solicitation shall be non-exclusive and without limitations upon obtaining services from third parties as the City deems appropriate in its sole discretion.

Note: Failure to provide all information requested on each form may result in the rejection of your proposal at the sole discretion of the City.

2.06 Task Authorization Review and Approval Process

i. The City will request written proposal from the successful proposer(s) for each individual project.

ii. The Work Order is prepared and completed using Form Number Section 00860 Task Authorization Form for Consultants Services, which will include a detailed summary of the proposed project, a detailed summary of the cost for each project and a scope of work. The proposed manager shall include the following attachments.

a. Section 00860, Task Authorization Form [should be detailed and outlined all tasks, deliverables, etcetera] and executed by the proposer(s).

b. A copy of the fully executed agreement (consultant RFQ).

c. The negotiated Price Sheet-breakdown [should be detailed to ensure pricing is pursuant to agreement] (i.e. for example, engineering services (10 hours) at $250 an

2.07 Key Personnel

The successful proposer(s) shall appoint a single representative with whom the City shall coordinate all Task Authorization. This representative shall have the authority to transmit instructions, receive information, interpret and deliver decisions on behalf of the successful proposer(s). If this representative is to leave the firm for any reason, the City shall be notified in writing within fourteen (14) days after said person leaves the firm. A new representative should then be assigned this role. The City must be notified if the proposer(s) acquires any changes during the contract term.

2.08 While it is anticipated the majority of efforts under this RFQ will primarily be conducted with the Public

Works/Utilities Department, this contract will be open to use by various City departments including Community Development, Fire and Police, Parks etc. Therefore, there may be a variety of tasks solicited from a variety of perspectives and needs.

2.09 Response

i. Firms which desire to participate in this process are requested to respond to this solicitation as provided herein. One of the submission items included with this solicitation is Standard Form

330. It is noted that firms will be grouped and ranked in competition with other firms in the context of the applicable discipline(s) or function(s) as appropriate. The rankings grouped by discipline will be the basis for selection of firms with which to establish Master Contracts in the needed discipline or function area as consistent with the CCNA.

ii. It is noted there are a number of disciplines listed in which related services will not be needed or used by the City at a level which predicates the need for establishment of a Master Contract.

Therefore, since preparing a response requires time and effort, firms are welcome and encouraged to contact the Purchasing Manager of the City at 407.688.5028 for guidance or information regarding applicability of their firm’s specialty(s) to the needs of the City.

iii. It is underscored that discipline and experience profile codes must be accurately reflected. Also, if a firm is to be certified by the City in multiple disciplines, it is essential that resumes of key personnel, relevant projects and experience information include designations and notations regarding discipline and experience profile codes.

2.10 Preparation of Submission

i. Firms submitting a response to this request will be referred to herein as Proposer(s). proposer(s) who are preparing a response to this request are expected to examine this request including all relevant forms, terms, conditions, and instructions. All costs associated with preparation and submission of the statements of qualifications, and any other information shall be borne entirely by the proposer(s).

ii. Time is of the essence in the delivery of response to this solicitation and any other information or documentation as may be requested by the City in the evaluation and/or award process.

iii. Submissions and modifications thereof shall be enclosed in sealed envelopes, Attachment “J” is provided for your personal use. You shall provide the required forms, addressed to the office specified in the Attachment “J". Submissions received after the stated time and date will be returned to the sender unopened.

iv. A “black-out-period” is hereby established for the time frame between the time the request for statements of qualifications is issued and selection(s) are completed.

v. It is noted that attempts to contact Officers of the City, City Commission members and City employees other than through the indicated contact person(s) during this procurement process is contrary to the public interest due to the potential to distort, compromise and get in the way of the decision-making process. Therefore, attempts to contact, fraternize, or influence personnel indicated above may result in disqualification of a responding firm.

vi. Questions

a. It is the responsibility of the Proposer(s) to carefully examine the documents and information requested, provided or contained herein before and after and to report any ambiguities or inconsistencies to Purchasing Division at least seven (7) days prior to the submission deadline. Any Proposer(s) who is in doubt as to the true meaning of any part of the Solicitation Documents, or finds a discrepancy or omission therein, are requested to contact Purchasing Division by email at purchasing@sanfordfl.gov no less than seven

This in no way relieves the Proposer(s) of the responsibility of completeness, correctness and accuracy of response to this request. Only interpretation, instructions or correction(s) given, in writing, by the Purchasing Division will be binding upon the CITY. Proposer(s) are hereby notified that no other source is authorized to give information concerning explaining and/or interpreting this Request.

2.11 Any firm or individual desiring to provide A & E Professional Services must be a registered vendor through the State of Florida, a certified vendor that must follow Florida Statute laws, regulations, and governing City Policy as standards and practices to this solicitation.

i. Among the factors to be considered and evaluated in making this finding are the capabilities, adequacy of personnel, past record, experience of the firm or individual and other factors determined by the CITY to be applicable to the subject project. Additionally, the CITY will consider such factors as to whether a firm is a certified minority business enterprise; past performance; willingness to meet time and budget requirements; location; recent, current, and projected workloads of the firms; and the volume of work previously awarded to each firm by the agency, with the object of effecting an equitable distribution of contracts among qualified firms, provided such distribution does not violate the principle of selection of the most highly qualified firms. The agency may request, accept, and consider proposals for the compensation to be paid under the contract only during actual negotiations.

ii. The CITY reserves the right to declare any proposer(s) ineligible at any time during the process where developments arise which adversely affect the proposer(s) responsibility. Also, failure of a proposer(s) to observe any of the instructions and conditions contained herein before and after may constitute grounds for rejection of the relevant response.

2.12 The CITY reserves the right to conduct any investigation and consider any evidence relevant to the qualifications and capabilities of Proposer(s)to perform the work contemplated. The investigation may include, but is not limited to, a detailed review of references, current and previous entities for whom similar work has been performed, an inspection of the Proposer(s) facilities, equipment, personnel and any other evidence including financial, technical and other qualifications and abilities of the Proposer(s).

2.13 The CITY reserves the right to cancel a solicitation at any time prior to an award, to reject any and all responses and/or portions thereof.

2.14 The Proposer must submit evidence of registration with the Florida Department of Business Regulations (DBPR). The current license is the preferred form of documentation.

2.15 Prohibition Against Contingency Fees

The architect or register surveyor and mapper or professional engineer, as applicable warrants that he or she has not employed or retained any company or person, other than a bona fide employee working solely for the architect, registered surveyor, mapper or professional engineer, as applicable, to solicit or secure this agreement and that he or she has paid or agreed to pay any person, company, corporation, individual, or firm, other than a bona fide employee working solely for the architect, registered surveyor mapper or professional engineer, as applicable, any fee, commission, percentage, gift, or other consideration contingent upon or resulting from the award or making of an agreement resulting from this solicitation. "For the breach or violation of this provision, the CITY shall have the right to terminate the agreement without liability and, at its discretion, to deduct from the contract price, or otherwise recover, the full amount of such fee, commission, percentage, gift, or consideration.

2.16 Competitive Selection

i. The CITY will evaluate current statements of qualifications along with performance data on file together with those that may be submitted by other firms regarding the proposed project, and shall conduct discussions with, and may require public presentations by, no fewer than three firms regarding their qualifications, approach to the project, and ability to furnish the required services.

ii. The CITY will select in order of preference by discipline no fewer than three firms deemed to be the most highly qualified to perform the required services in each grouping by discipline. In determining which firms are qualified. The CITY will consider such factors as the ability of professional personnel; whether a firm is a certified minority business enterprise; past performance; willingness to meet time and budget requirements; location; recent, current, and projected workloads of the firms; and the volume of work previously awarded to each firm by the CITY, with the object of effecting an equitable distribution of contracts among qualified firms, provided such distribution does not violate the principle of selection of the most highly qualified firms.

iii. The CITY will not request, accept, and consider proposals for the compensation to be paid under the contract except during the actual competitive negotiation phase of the process. Do not submit compensation proposals unless and until specifically asks for them.

iv. Respondents are advised to carefully follow the instructions contained herein in to be considered fully responsive to this solicitation. Compliance with all requirements will be solely the responsibility of the Respondent. Failure to provide requested information and to follow the outline provided may result in disqualification of his/her response.

v. Note: that the CITY is not looking for responses which are textbook in that they only present what the process is, or “how to”. The CITY is looking for how the Responding Firm actually has completed the various processes indicated.

2.17 Submission Deliverable

i. The original submission shall be unbound printed on “8 ½ X 11” white paper, printed on one side. Items which do not conform to this requirement may be discarded and not be considered.

2.20 2 CFR Part 200 Uniform Administration Requirements Proposer agrees to comply with all applicable provisions of 2 CFR Part 200, including but not limited to the Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards, as applicable to non- Federal entities receiving federal funds. This includes compliance with the following where applicable:

3.01 REQUESTING THE SOLICITATION DOCUMENT.

3.05 SOLICITATION DOCUMENTS FROM THIRD PARTY PROVIDERS.

The City of Sanford Purchasing Division, its website and its service provider VendorLink are the only authorized sources of solicitation documents/forms. Solicitation documents/forms obtained from any other third-party source may be an incomplete set of documents. Proposers using solicitation documents/forms obtained from any other third-party source are advised to contact the City’s Purchasing Division to provide a contact name, mailing address, phone number, fax number, and email address to obtain a complete set of solicitation documents and to enable notification of required addenda.

3.06 PRE-PROPOSAL CONFERENCE.

There will be no pre-proposal conference for this project.

IMPORTANT NOTE: It is imperative that all proposers have a clear understanding of the scope of services requirements. As such, the City reserves the right to change the non-mandatory pre-proposal conference or to schedule a pre-proposal conference; therefore, in the event a non-mandatory pre-proposal conference is required and/or subsequently scheduled, attendance will be a pre-requisite for submitting a proposal; and proposals will only be accepted from those who are represented at a mandatory pre-proposal conference.
