About this file

This is a Project Labor Agreements Fact Sheet issued by the City of Toledo, Ohio, detailing requirements and procedures for construction projects funded by the city. The fact sheet establishes that Project Labor Agreements are mandatory for all construction projects valued at $100,000 or greater funded by the City of Toledo or other funding sources that do not explicitly exclude such agreements. All contractors and subcontractors performing construction work on-site or adjacent to the worksite must comply with the agreement. The execution timeline requires a pre-job conference between the successful bidder and the Northwest Ohio Building and Construction Trades Council within fifteen days of bid award notification, followed by delivery of an executed Project Labor Agreement to the Division of Purchases and Supplies within fifteen working days of the pre-job conference. The agreement must be signed by the lead contractor and the Executive Secretary of the Northwest Ohio Building and Construction Trades Council to be considered valid. There are no exemptions from the pre-job meeting requirement, even for companies already signatory to collective bargaining agreements.

The Project Labor Agreement does not affect the City's Minority Business Enterprise Program requirements, which mandate compliance with Toledo Municipal Code goals of 15 percent minority business enterprise participation in construction projects and 21 percent in HUD-assisted projects. Manufacturing and fabrication work are excluded from the agreement requirements. Under the agreement, wages and fringe benefits must be paid according to applicable local collective bargaining agreements. The agreement prohibits strikes, lockouts, slowdowns, picketing, and other work stoppages by the union and its members during the contract term, with violations constituting breach of the agreement. Grievances and disputes are addressed through Article VI of the Project Labor Agreement.
