CONTRACT LINE CLIN NOTES

General

1. Offerors shall enter unit prices and/or extended totals in spaces provided. If there is a mathematical discrepancy between the unit price and the total, the unit price will be held to be the intended price and the total recomputed accordingly. If an Offeror provides the total amount but fails to enter the unit price, the total divided by the specified quantity will be held to be the Offerors intended price.

2. FAR 52.217-5, Evaluation of Options (Jul 1990) – Except when it is determined in accordance with FAR

17.206 (b) not to be in the Government's best interest, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).

For purposes of award, the Government will evaluate offers based on the Grand Total Price (the sum of CLINs 0001-0007).

3. In accordance with FAR 52.215-1, the Government may determine that a proposal is unacceptable if the prices proposed are materially unbalanced between line items or subline items. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is sufficiently overstated or understated as indicated by the application of cost or price analysis techniques. A proposal may be rejected if the Contracting Officer determines that a lack of balance poses an unacceptable risk to the Government.

4. The Government reserves the unilateral right to award CLINs 0002, 0003, 0004, and 0005 to the contractor at the proposed price within 30 calendar days after contract award. The Government reserves the unilateral right to award CLINs 0006, 0006A, and 0007 to the contractor at the proposed price within 210 calendar days after contract award. A firm fixed proposed price is required for CLINs 0001–0007. No provision is made for economic price adjustment. If options are exercised, the contract completion date remains 504 calendar days after award of the contract for Conversion and Renovation of Military Family Housing (P-1602) and 210 calendar days after award of the contract for Construct Housing Welcome Center (H-238).

5. If CLINs 0002, 0003, 0004, 0005, 0006, 0006A, and 0007 are exercised, additional bonding and consent of surety will be required. Consequently, the Performance Bond shall reflect 100 percent of the aggregate amount of all CLINs.

6. Failure to enter a price for any of the CLINs will result in the proposal being rejected as unacceptable.

7. For CLIN 0001A and CLIN 0006A, Unit price for all work in connection with the removal, disposal and replacement of geotechnically unsuitable, non-hazardous, subgrade soil (i.e. soft subgrade soils, debris) with clean imported select granular backfill. Unsuitable subgrade soil determinations shall be made by the Contracting Officer. The price shall include the removal of geotechnically unsuitable soils and debris encountered within planned excavations (i.e. footings, utilities) or identified during proof rolling of planned subgrades, disposal at a permitted licensed disposal facility within a 50 mile radius of the project site and backfilling the excavation with compacted clean imported select granular backfill. Unit price shall include all chemical characterization testing required by the receiving facility, transportation and proper disposal at the permitted facility. Clean imported select granular backfill shall conform to project specification requirements for Select Material (Section 31 23 00.00, Paragraph 2.1.4). Soil disturbed by the Contractor’s construction activities, or that are excessively wet and soft due to lack of proper site drainage or excavation dewatering will not be considered unsuitable. Unit price shall include handling and transportation. The volume of material removed and imported backfill required shall be determined based on field measurements (length x width x depth) of the completed excavation to remove the unsuitable soil / debris as approved by the Contracting Officer.

A. GENERAL INFORMATION

OVERVIEW OF THIS SOURCE SELECTION

This solicitation is being conducted as a negotiated procurement utilizing procedures in accordance with FAR Part 15.101-2. The best value continuum source selection process used in this acquisition is the lowest price technically acceptable. Award will be made to that responsible offeror whose proposal, conforming to the solicitation, is determined to be lowest price and meeting the acceptability standards for non-price factors (technical and past performance) as stated herein.

The Government reserves the right to eliminate from consideration any or all offerors at any time prior to award of the contract; to negotiate with offerors in the competitive range; and to award the contract to the offeror submitting the proposal determined to be the best value.

The number of proposals to be evaluated for technical acceptability may be limited to the five lowest priced offers at the discretion of the contracting officer. If the number of proposals to be evaluated is limited, technical proposals shall be provided to the evaluator(s) without any identification of prices or any rank order of prices. If no proposals are found to be technically acceptable within the first group of proposals, then the process described will be conducted again as many times as necessary, until such time as the Government identifies a technically acceptable proposal.

This procurement will be awarded as Firm Fixed Price (FFP) Contract. The Government reserves the right to enter into negotiations or limit the competitive range. The magnitude of construction range is between $1,000,000 and

$5,000,000 (CLINS 0001-0007).

INTENT TO AWARD WITHOUT DISCUSSIONS: Proposals must set forth full, accurate and complete information as required by this Request for Proposal (including attachments). The penalty for making false statements in proposals is prescribed in 18 U.S.C. 1001. The Government intends to evaluate proposals and award without discussions. However, the Government reserves the right to conduct discussions if it is later determined by the Contracting Officer to be necessary. Therefore, each initial offer should contain the best terms from a technical and price standpoint.

The contract completion date is 504 calendar days from the notice to proceed.

This acquisition is solicited as a 100% total small business set aside.

Pre-Proposal Inquiries (PPI): Offerors who determine that the technical and or contractual requirements of this RFP require clarification(s) in order to permit submittal of a responsive proposal shall submit all questions in writing.

Additionally, all inquiries shall be submitted using the Pre-Proposal Inquiry (PPI) form attached to this solicitation as Attachment A and are due by 1200 EST Thursday, 26 January, 2017. All inquiries shall be submitted via email to tiffany.kirtsey@navy.mil. The Government does not intend to respond to inquiries submitted less than 7 days before the proposal receipt date. Responses will be published as an amendment to the solicitation.

D. EVALUATION FACTORS FOR AWARD

1. The solicitation requires the evaluation of price and the following non-price factors:

Factor 1 – Experience

Factor 2 – Safety

Factor 3 – Past Performance

The distinction between experience and past performance is construction experience pertains to the types of work and volume of work completed by a contractor that are comparable to the types of work covered by this requirement, in terms of size, scope, and complexity. Past performance pertains to both the relevance of recent efforts and how well a contractor has performed on the contracts.

2. Basis of Evaluation and Submittal Requirements for Each Factor.

(a) Price:

(1) Solicitation Submittal Requirements: The Offeror(s) shall submit a best and final price for the Base award and six (6) options associated with this procurement. The offeror(s) shall use the Price Proposal Form included in the Solicitation and in Attachment E of this Source Selection Plan.

(2) Basis of Evaluation: The Government will evaluate price based on the total price. Total price consists of the basic requirements and all option items (see Section B of the solicitation). The Government intends to evaluate all options and has included the provision FAR 52.217-5, Evaluation of Options (JUL 1990) in the solicitation. In accordance with FAR 52.217-5, Evaluation of Options will not obligate the Government to exercise the option(s). Analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price:

(i) Comparison of proposed prices received in response to the RFP.

(ii) Comparison of proposed prices with the IGCE.

(iii) Comparison of proposed prices with available historical information.

(iv) Comparison of market survey results.

(b) Technical Factors:

(1) Factor 1, Experience:

(i) Solicitation Submittal Requirements: The Offeror shall submit the following information:

The Offeror shall submit the following information:

(1) Construction Experience:

Submit a maximum of five (5) relevant construction projects that demonstrates experience on projects similar in size, scope, and complexity to the RFP. The Offeror must submit a minimum of one relevant renovation project AND one relevant new construction project as defined below. To meet the minimum number of relevant construction projects, the offeror has the option to provide a single project that includes both the relevant new construction and renovation requirements; or provide one project that meets the renovation requirement and one project that meets the new construction requirement. For purposes of this evaluation, a relevant project is further defines as:

Renovation Project:

Size: A minimum of 2,000 square feet

Construction Cost: A minimum of $225,000

Scope/Complexity: General whole building unit (interior and exterior) simultaneous renovation of multiple (two or more) residential type housing units that includes building envelope, civil/landscape, plumbing, mechanical, and electrical renovation of the units.

New Construction:

Size: A minimum of 2,000 square feet

Construction Cost: A minimum of $250,000

Scope/Complexity: New construction of a residential or office type building unit.

Projects submitted shall have been completed within the past five (5) years of the date of issuance of this RFP.

A project is defined as a complete construction effort performed under a single task order or contract/subcontract.

For multiple award and indefinite delivery/indefinite quantity type contracts, the contract as a whole should not be submitted as a project; rather Offerors should submit the work performed under a task order as a project.

The attached Construction Experience Project Data Sheet (Attachment F) is MANDATORY and SHALL be used to submit project information. Except as specifically requested, the Government will not consider information submitted in addition to this form. Individual blocks on this form may be expanded; however, total length for each project data sheet shall not exceed one (1) double-sided page (or two (2) single-sided pages).

For all submitted projects, the description of the project shall clearly describe the scope of work performed and the relevancy to the project requirements of this RFP (i.e.: unique features, area, construction methods).

If the Offeror is a Joint Venture (JV), relevant project experience should be submitted for projects completed by the Joint Venture entity. If the Joint Venture does not have shared experience, projects may be submitted for the individual Joint Venture members. Offerors who fail to submit experience for all Joint Venture members may be rated lower. Offerors are still limited to a total of five (5) projects combined

If an Offeror is utilizing experience information of affiliates/subsidiaries/parent/LLC/LTD member companies (name is not exactly as stated on the SF1442), the proposal shall clearly demonstrate the relationship and role each affiliate/subsidiary/parent firm will perform under this contract. In order for the past performance information of the affiliate/subsidiary/parent/LLC/LTD member companies to be considered. The proposal shall state specific commitments of technical resources (e.g. personnel, equipment) that the affiliate/subsidiary/parent/LLC/LTD member companies commit to the performance of this contract. In particular, the proposal will clearly state the specific commitments of resources of the affiliate/subsidiary/parent/LLC/LTD member that will be located at the worksites and company offices in the city/area of the project. The proposal shall also describe specific roles of the affiliate/subsidiary/ parent/LLC/LTD member companies in terms of the work it will either self-perform or manage on behalf of the Offeror in performance of the contract. Any projects submitted in excess of the five (5) will not be considered.

Experience of proposed subcontractors will not be considered for construction experience.

(ii) Basis of Evaluation: The basis of evaluation will include the Offeror’s demonstrated experience and depth of experience in performing relevant construction projects as defined in the solicitation submittal requirements. The assessment of the Offeror’s relevant experience will be used as a means of evaluating the capability of the Offeror to successfully meet the requirements of the RFP. Any projects submitted in excess of the five (5) for Construction Experience will not be considered. Offerors not submitting a minimum of two (2) relevant projects (one for renovation and one for new construction or one relevant project that includes both renovation and new construction) will be rated unacceptable.

(2) Factor 2, Safety:

(i) Solicitation Submittal Requirements: The Offeror shall submit the following information:

(For a partnership or joint venture, the following submittal requirements are required for each contractor who is part of the partnership or joint venture; however, only one safety narrative is required. EMR and DART Rates shall not be submitted for subcontractors.)

(1) Experience Modification Rate (EMR): For the three previous complete calendar years [2013,2014,2015] submit your EMR (which compares your company’s annual losses in insurance claims against its policy premiums over a three year period). If you have no EMR, affirmatively state so, and explain why.

Any extenuating circumstances that affected the EMR and upward or downward trends should be addressed as part of this element. Lower EMRs will be given greater weight in the evaluation.

(2) OSHA Days Away from Work, Restricted Duty, or Job Transfer (DART) Rate: For the three previous complete calendar years [2013, 2014, 2015], submit your OSHA Days Away from Work, Restricted Duty, or Job Transfer (DART) Rate, as defined by the U.S. Department of Labor, Occupational Safety and Health Administration. If you cannot submit an OSHA DART Rate, affirmatively state so, and explain why.

Any extenuating circumstances that affected the OSHA DART Rate data and upward or downward trends should be addressed as part of this element. Lower OSHA DART Rates will be given greater weight in the evaluation.

(3) Technical Approach for Safety: Describe the plan that the Offeror will implement to evaluate safety performance of potential subcontractors, as a part of the selection process for all levels of subcontractors. Also, describe any innovative methods that the Offeror will employ to ensure and monitor safe work practices at all subcontractor levels. The Safety Narrative shall be limited to two pages.

(ii) Basis of Evaluation: The Government is seeking to determine that the Offeror has consistently demonstrated a commitment to safety and that the Offeror plans to properly manage and implement safety procedures for itself and its subcontractors. The Government will evaluate the Offeror’s overall safety record, the Offeror’s plan to select and monitor subcontractors, any and innovative safety methods that the Offeror plans to implement for this procurement. The Government’s sources of information for evaluating safety may include, but are not limited to, OSHA, NAVFAC’s Facility Accident and Incident Reporting (FAIR) database, and other related databases. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete safety information regarding these submittal requirements rests with the Offeror.

The evaluation will collectively consider the following:

- Experience Modification Rate (EMR)

- OSHA Days Away from Work, Restricted Duty, or Job Transfer (DART) Rate

- Offeror Technical Approach to Safety

- Other sources of information available to the Government

(1) Experience Modification Rate (EMR): The Government is seeking to determine whether the Offeror has an acceptable safety record. The Government will evaluate the Offeror’s overall safety record as evidenced by the TRC and DART rates, if the Offeror’s plan includes safety in the evaluation and selection of subcontractors, and if the narrative includes a plan to monitor the safety performance of subcontractors during performance. The evaluation will collectively consider the following:

- OSHA Total Recordable Case (TRC) Rate

- OSHA Days Away from Work, Restricted Duty, or Job Transfer (DART) Rate

- Offeror Technical Approach to Safety

(2) OSHA Days Away from Work, Restricted Duty, or Job Transfer (DART) Rate: The Government will evaluate the OSHA DART Rate to determine if the Offeror’s OSHA DART rate is above 3.0 and extenuating circumstances that impact the rates. OSHA DART rates above 3.0, in any of the previous five years, will be considered UNACCEPTABLE, unless an adequate explanation is provided to address the extenuating circumstances that affected the rate.

(3) Technical Approach to Safety:

The Government will evaluate the narrative to determine if subcontractor safety performance will be considered in the qualification, evaluation, selection, of all levels of subcontractors on the upcoming project, and both the plan to monitor the safety of those subcontractors during contract performance, highlighting what specific management practices will be in place for providing deliberate safety program management and mishap prevention support to those sub-contractors whose EMR is greater than 1.0, whose TRC is greater than 4.0 and whose DART rate is greater than 3.0. Offerors must state that they will evaluate the safety performance of subcontractors in the selection process of all levels of subcontractors and monitor the safety of those subcontractors during contract performance or the proposal will be rated UNACCEPTABLE.

(c) Past Performance

(1) Factor 3, Past Performance:

(i) Solicitation Submittal Requirements: IF A COMPLETED CPARS EVALUATION IS AVAILABLE, IT SHALL BE SUBMITTED WITH THE PROPOSAL. IF THERE IS NOT A COMPLETED CPARS EVALUATION, the Past Performance Questionnaire (PPQ) included in the solicitation is provided for the offeror or its team members to submit to the client for each project the offeror includes in its proposal for Factor 1 Construction Experience. AN OFFEROR SHALL NOT SUBMIT A PPQ WHEN A COMPLETED CPARS IS

AVAILABLE.

IF A CPARS EVALUATION IS NOT AVAILABLE, ensure correct phone numbers and email addresses are provided for the client point of contact. Completed PPQs should be submitted with your proposal. If the offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the offeror should complete and submit with the proposal the first page of the PPQ (Attachment G), which will provide contract and client information for the respective project(s). The Government may make reasonable attempts to contact the client noted for that project(s) to obtain the PPQ information. However, Offerors should follow-up with clients/references to ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government's point of contact Amy Keiler at amy.keiler@navy.mil prior to proposal closing date. Offerors shall not incorporate by reference into their proposal PPQs or CPARS previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.

Offerors may provide any information on problems encountered and the corrective actions taken on projects submitted under Factor 1 – Experience. Offerors may also address any adverse past performance issues.

Explanations shall not exceed two (1) double-sided page (or two (2) single-sided pages) in total.

The Government reserves the right to contact references for verification or additional information. The Government’s inability to contact any of the Offeror’s references or the references unwillingness to provide the information requested may affect the Government’s evaluation of this factor. In addition to the above, the Government reserves the right to obtain information for use in the evaluation of past performance from any and all sources including sources outside of the Government. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS) using all CAGE/DUNS numbers of Contractors who are part of a partnership or joint venture identified in the Offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the Offeror.

Performance award or additional information submitted will not be considered.

A copy of the blank Past Performance Questionnaire to be used for requesting client references is included as Attachment G.

(ii) Basis of Evaluation: This evaluation focuses on how well the Offeror performed on the relevant projects submitted under Factor 1 –Experience and past performance on other projects currently documented in known sources

The Government will consider the currency and relevance of the information, the source of the information, context of the data, and general trends in the Contractor’s performance. This evaluation is separate and distinct from the Contracting Officer’s responsibility determination.

In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the Offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in…
