Chapter 1
INTRODUCTION
1.1 Purpose
1.1.1 This instruction establishes a standardized Shipyard
procedure for Hazardous Waste (HW) generators to use in the handling, storage, packaging, marking; and transfer of HW in compliance with Federal, State, and Navy requirements.
1.1.2 It is the responsibility of the Shipyard Commander to
ensure compliance with all Resource Conservation and Recovery Act (RCRA) requirements for the Shipyard and to report to the U.
S. Environmental Prot;:ectionAgency (EPA) or the State, as required, for all installation activities, including tenants.
Implementation of the HW management program mandated,by RCM requires maximum cooperation of all activities on the Shipyard.
1.1.3 Instruction revisions frequently reflect changes in HW
management regulations. Each revision to this instruction will become effective immediately upon distribution.
1.2 Scope
1.2.1 This instruction applies to all generators of Hazardous Waste on the Shipyard. All installation'activities, contractors performing work for the government, individual shipyard operational units, ships'forceand tenartt activities doing business ,on Portsmouth Naval Shipyard are hereafter referred to in this instruction as "Shipyard Facilities" and are affected by these instructions. The individual operational units (gene'rators) on the shipyard are accountable for conducting their activities in accordance with these procedures. Those Shipyard Facilities will provide necessary documentation to the Installation Commander through the Environmental Division, Code 106.3, to apply for permits, to provide the reports required by.
EPA or the State, and to ensure compliance with RCRA regulations and permit requirements at the Shipyard.
1.2.2 This inst.ruction does not apply to operations of the
Hazardous Waste Storage Facility (HWSF).

1 . 3 Background
1.3.1 In 1976 Congress amended the Solid Waste Disposal Act to institute the RCRA. The primary goals of RCRA are to protect human health and the environment from the improper management of Hazardous Waste (HW). The explicit RCRA requirements for waste management are legally enforceable. Federal Facilities are not exempt from the requirements of this law. All Shipyard Facilities are required to manage HW in compliance with the rules.
1.3.2 The Shipyard is subject to state regulations. In 1979, the State of Maine enacted the Maine Hazardous Waste, Septage, and Solid Waste Management Act, directing the issue of .
regulations for safe management and transportation of HWs within the state. These rules are the Maine Hazardous Waste Management Regulations, Chapters .850 through 857. The procedures of this instruction are also designed to address mandatory requirements of those rules. The State of Maine has developed a program to implement RCRA within the State (reference (a» and the U. S.
EPA has delegated RCRA implementation to the State.

Chapter 3
IDENTIFICATION OF HAZARDOUS WASTE
3.1 HW Identification. Identification actually has two
meanings. The first is the initial process of recognizing that a material, product, item,. or liquid is waste. The second is the action of properly containing and marking, providing fo:rmal identification that a waste is hazardous. Shipyard Facilities must provide, for proper control of waste:
3.1.1 Identification as waste
3.1.2 Determination of waste type
3.1.3 Segregation of waste as one of the following:
3.1.3.1 Solid Waste
3.1.3.2 Non-Regulated (Controlled) Waste
3.1.3.3. Hazardous Wast.e (includes Universal Waste).
3.1. 4 Identification of Hazardous Waste by:
3.1.4.1 Packaging HW
3.1.4.2 Marking HW
3.1.5 Control of HW
3.1.6 Inspection of HW
3.1.7 Transfer of controlled waste.
3.2 Identification and Determination of Waste. The Hazardous
Waste Handler (HWH) must be able to determine which wastes received are hazardous so they may be managed, reported, and tracked properly. The following queries·guide the task of.waste determination:
3.2.1 Is the material no longer useful for its intertded
purpose?
3.2.2 Is it an unintended, or unusable byproduct?
3.2.3 Does the shipyard intend to discard, treat, recycle, or dispose of the· material?
3-1
3.2.4 Affirmative answers to any of the .above determine the
material to be waste.
3.~ solid Waste. A solid waste is generally defined as any discarded material (including solids, liquids, containerized gases) that is abandoned, recycled, or considered inherently waste-like as described above. Shipyard facilities are dlrected to properly identify, segregate. and control solid waste by direction of NAVSHIPYD PTSMHINST 5090.6, reference (b). For reference and guidance HWHs shall have a current copy of NAVSHIPYD PTSMHINST 5090.6 at or near the Hazardous Waste Accumulation Area (HWAA) , to properly manage wastes.
3.3.1 Solid waste must be further evaluated to determine
whether it is a HW. A material is a HW if it has not been excluded from regulation and:
3.3.1.1 It has a HW characteristic (e.g., ignitable.
corrosive, reactive, toxic)
3.3.1.2 It is a RCRA listed HW or
3.3.1. 3 It is a mixture of a listed HW ~nd solid waste.
3.3.2 This evaluation can be conducted by either using the
waste generator's knowledge of the hazard characteristics of the waste or by analytical testing.
3.3.3 If the generating Shipyard Facility cannot make a HW
determination, a·request should be made to Code 106.3 for assistance and possible analytical testing. Interpretation of the ;-esults will be used to establish the Waste Profile Number for the wastestream.
3.3.4 IdentifyHW. Wastes determined to be hazardous shall be
identified by waste profile number. Was,te profile numbers are assigned by Code 106.32 according to proper name of the waste.
generating process. and generating Shipyard Facility. HWs are assigned waste profile numbers from 2000 to 7999. Wastes that have been evaluated and determined to be non-regulated as hazardous are assigned waste profile numbers from 8000 to 9999.
3.4 Establishing Waste Profile Numbers
3.4.1 If the appropriate waste profile number is not known, Shipyard Facilities shall contact Code 106.32 at X5241. Be
3-2
CH ---,--Or_i____g DATE 27 NOV 2012 prepared to provide as much of the following as possible about the waste:
3.4.1.1 Process generating the waste
3.4.1.2 Amount of waste
3.4.1.3 Any information from container label
3.4.1. 4 National Stock Number, if known
3.4.1.5 Material Safety Data Sheet
3.4.1.6 Vendor information and part number
3.4.2 Code 106.32 will determine the initial characterization of each new waste based on information provided by the generating shipyard Facility. Tl1ey will determine what sampling may be required of the new waste stream. Revision of the initial characterization may be required based on the sample results.
3.4 ..3 Following characterization, a waste profile number will be assigned to each new waste stream.

Chapter 4
MANAGEMENT RESPONSIBILITIES OF SHIPYARD FACILITIES
4.1 Responsibilities of Shipyard Facilities
4.1.1 Hazardous waste accumulation is forbidden in any area on the Shipyard which is not a designated and permitted HWAA.
4.1.1.1 Items dropped off after business hours at HWAAs, left on Shipyard property in unauthorized locations, discarded in remote locations, or otherwise discarded incorrectly on the Shipyard will be tracked back to the generating Facility.
Compensation for time spent investigating an incident, disposal cost, and funding for additional handling will be sought and recovered from the departments found to be responsible. Items improperly discarded in solid waste dumpsters could result in unacceptable fines and recovery expenses to the Shipyard if they arrive at off-yard disposal facilities undetected.
NOTE: PROPER USE OF THE SYSTEM IS IMPERATIVE FOR ALL
PERSONNEL to ensure safety of Shipyard personnel, contractors, facility workers and the environment.
4.1.2 All HW must be placed in a permitted HWAA. Generators
shall turn HW in to a HWAA not later than the end of the shift on which it is generated. Shipyard facilities and generators are cautioned to be aware that many waste items may be HW or Universal (hazardous) Waste. Responsibility for compliance is upon the generator and Shipyard Facility.
4.1.3 Treatment of Hazardous Waste without a specific RCRA
permit is prohibited. No Shipyard Facility, Hazardous Waste Handler (HWH), or generator is authorized to treat HW.
4.1.4 Shipyard Facilities are required to assign qualified
Hazardous Waste Handlers (HWHs) to a HWAA. At least one HWH must be assigned to each HWAA for each shift that it operates.
Supervisors must ensure that a trained and assigned alternative handler performs HWAA duties in the absence of the primary handler.
NOTE: Notice to All Shipyard Facilities: No person shall perform HWH duties unless they have been trained in compliance with regulatory requirements.
Administrative action shall be taken against
4-1
CH Orig DATE 27 NOV 2012 any Department, Office, or Tenant Activity using personnel to perform such duties who are not trained and qualified.
4.1.5 HWAAs must be permitted. HWAA permitting procedures are described in Appendix 4.2.1.
4.1.5.1 Location of HWAAs must be considered carefully, so
that needed equipment is immediately available to the area, as required by environmental rules, safety,. and fire codes. HWAAs must be equipped with or located immediately nearby the following:
4.1.5.1.1 An internal communications or alarm system
capable of providing immediate emergency instruction (voice or signal) to facility pe~sonnel.
4.1. 5.1. 2 A device f such as a telephone or a hand-held two-way)radio, which is immediately available at the scene of operations, capable of summoning emergency assistance from the fire department or emergency response team.
4.1.5.2 The HWAA must be set up in the configuration
approved on the permit and waste must be stored in the location(s) indicated.
4.1.5.3 Emergency response equipment must be located as·
shown on Permit Application and Permit (telephone, spill kit, fire extinguisher, eyewash).
4.1.5.4 Required emergency response equipment must be
functional and immediately accessible.

DUTIES AND RESPONSIBILITIES OF HWHs
5.1 Duties and Responsibilities of HWHs. A HWH is responsible for accomplishing the following duties arid responsibilities described in Chapter 5. These duties collectively comprise the HWAA HWH Job Description.
5.1.1 HWAA Container Management
5.1.1.1 Package waste in container(s) appropriate for the
waste.
5.1.1.1.1 Use only new or reconditioned containers issued
by Code 106.32. Variance to this requirement is allowed only when specific Code 106.3 authorization has been obtained prior to HW accumulation.
5.1.1.1.2 Containers used for waste must be assigned and
marked with a Tracking Number. Ensure that waste containers have a Tracking Number prior to pickup (if the waste containers were issued by the HWSF a Tracking Number is already on the containers) .
5.1.1.1.3 Call the HWSF, X5241 to request permission to
use original containers and to receive a Tracking Number for each container. Assigned Tracking Numbers must be marked on the.
outside of tubs or boxes containing small original containers, near the bottom of, drums and pails (or similar) and conspicuously marked on unusual containers such as bags and pallets.
5.1.1.1.4 A listing of containers to package HW is
provided in Appendix 5.3.1. The listing consists of types of containers and common examples of wastes that may be placed in them. Containers are assigned by waste profile and volume.
Select the most appropriate based on:
• Compatibility with the waste
• Volume of waste produced
• Containers authorized for use with that waste stream
NOTE: Contact Code 106.32 at X5241 if more waste packaging information is required.
5-1
5.1.1.2 Inspect all containers before use .and daily
thereafter. Ensure that containers used to hold waste are in good condition: no leaks, no excessive rust no excessivedents ll no bulges, and no spillage on exterior. If these conditions are not met l call the HWSF at'X5241 to determine appropriate actions to take. HWSF personnel will not accept containers for pick up that do not meet conditions.
5.1.1.3 Control Containers. Place HW containers in'an
accumulation area.
5.1.1.4 Container Identification. Identify all HW
containers with a HWAM I see Appendix 5.3.2. When accumulation in a container begins apply the Hazardous Waste Accumulation I
Area (HWAM). Mark theHWAM with the following information:
5.1.1.4.1 HWAA Number
5.1.1.4.2 Contents/Waste Profile Number
5.1.1.4.3 Accumulation Start date: In a <90 day areal the
Start date is the date HW was first put into the container. In a Satellite Accumulation Areal the start date remains blank until the container is full. The date the container becomes full is then entered as the start date.
NOTE: The start date in a SAA is needed only when the container is removed to a <90 day accumulation areal or to Bldg 357 1 or when the amount exceeds 55 gallons.
5.1.1.4.4 90 Day Date/Full Date. Using the start date l calculate the calendar date 90 days forward from the start date.
Enter that date.
5.1.1.4.5 Name and phone number of the HWH respopsible for
the HWAA
5.1.1.4.6 HWAMs are stock number 0102-LL-FRM-0027(lF) and
are available in Shop Stores 87 1 Bldg 170.
5.1.1.5 Containers of Universal Waste (UW). See Special
Requirements for UWI Chapter 9 1 and Paragraph 9.1. UW shall be identified using the Universal Waste Marking (UWM) AppendixI
9.6.1, available from the HWSF, Bldg. 357. Standards applicable to HW apply to UW stored in HWAAs. These standards inclu;de
5-2 marking, <90 day storage limit, aisle space, secondary containment, stacking limits, container selection and use.
5.1.1.6 Containers of Non-Regulated, controlled waste (waste
profile #8000-9999) shall be identified using the Non-Regulated Waste Marking, see Appendix.5.3.3, availabie from the HWSF, Bldg. 357. Keep storage of Non-Regulated (controlled) waste in HWAAs to a minimum. Standards applicable to HW apply to non regulated waste stored in HWAAs. These standards include aisle space, secondary containment, stacking limits, container selection, and use.
5.1.1.7 Control of PolyChlorinated Biphenyls (PCBs). PCBs
. have special storage and control requirements. See Chapter 9, Paragraph 9.2 .. PCB storage is limited to 30 days.
5.1.1.8 At all times, containers must be marked
appropriately. Marking must be:
5.1.1.8.1 Hazardous Waste Accumulation Marking, or
5.1.1.8.2 Green Non":'Regulated Waste Marking, or
5.1.1.8.3 Universal Waste Marking, or
5.1.1.8.4 As needed. Empty staged containers must be
marked "EMPTY" or "MT."
5.1.1.9 All required fields on the appropriate marking must
be correctly filled out. HWAMs applied to containers must be visible and the 90-day date must not be exceeded.
5.1.2 HWAA Operation (Accumulation)
5.1.2.1 Keep a current copy of this instruction (Shipyard
Instruction 5090.30) for reference in or·near the HWAA.
5.1.2.2 Ensure compatibility of wastes. Employ segregation
of wastes where needed and as required. Incompatible wastes.
must be separated from other materials by means of!a dike, berm, wall, secondary containment or other device (e.g., stored separately). A guide describing Profile Series and general compatibility rules is provided. See Appendix 5.3.4.

5.1.2.3 Keep all HW containers CLOSED except when adding
waste. While open, the container must be physically attended by the HWH. Containers must be closed by one of the following methods;
5.1.2.3.1 Drums; snap rings in placet funnels removed and
bungs installed
5.1.2.3.2 Other containers: caps on, or covers closed
5.1.2.3.3 Method approved by Code 106.32 before use
5.1.2.4 Place all cont, ainers holding liquid HW in a bermed
area or in a secondary containment. The bermed area or secondary containment, must have a minimum capacity of 110% of the volume of the largest container or 20% of the total volume of all, containers, whichever is greater. Secondary containment must not have any liquid in it nor significant accumulations of drips or debris.
5.1.2.5 Place only one waste profile in each HW container.
Do not mix waste profiles.
5.1.2.6 Do not overfill containers. Ensure that 55-gallon
drums are filled no higher than three inches from the top to allow room for expansion. Use similar allowances for other (e.g., five gallon) containers.
5.1.2.7 Minimize waste drips (especially paint) as much as
possibl,e using drip pads I funnels I or other preventative measures. Clean the area of incidental spills and drips immediately after any spillage. Thorough cleaning of areas surrounding HWAAs should take place no less than once every six months or as advised by Code 106.3.
5.1.2.8 Ensure all containers that were used to carry
material to the HWAA are empty before disposal.
5.1.2.8.1 A container'may be considered "empty"when:
• No free liquids remain, and
• No more than:
One inch of "residue" (free liquids are NOT residue) remains on the bottom of the container or
