Instructions, Conditions, and Notices to Quoters
1.0 GENERAL INSTRUCTION.
This solicitation is to be competed exclusively by 8(a) small businesses and the State Licensing Authority (SLA) under the Randolph Sheppard Act (20 U.S.C. §107, et. seq.). Quotations by other contractors will NOT be considered. The award resulting from this solicitation will be a Firm Fixed Price (FFP) contract type. The contract will consist of a one-year base period with four one-year option periods to be exercised at the discretion of the Government. The Government intends to award to the responsible respondent whose quotation offers the best value to the Government, price and non-price factors considered, as described in this solicitation.
https://www.neco.navy.mil/ https://www.acquisition.gov/far/ http://www.acq.osd.mil/dpap/dars/dfarspgi/current/index.html
To be eligible for award, the quoter must fully comply with this instruction and sufficiently address all solicitation requirements. As such, quotations that take exception to any term or condition of this solicitation, propose any additional term or condition, or omit any required information shall be considered ineligible for award. Alternate quotations are NOT authorized and will be rejected.
The Government intends to award this contract without discussions. Notwithstanding this intent, the Government reserves the right to request additional information from quoters as deemed necessary by the Contracting Officer.
To be considered eligible for award, each respondent must submit a single quotation that contains a complete and accurate response to the requirements of this solicitation. No multiple awards will be made.
Quotations must be submitted via email to jeffrey.geringer@navy.mil and patricia.murakami@navy.mil by 20 December, 2019, 11:00 AM Hawaii Standard Time (HST).
Quoters must comply with the detailed instructions in this solicitation for the format and content of the quotation. Quotations that do not comply shall be considered unacceptable and will render the quoter ineligible for award. Quotations submitted by mail or Fax, unless specifically authorized in advance by the Contracting Officer, will not be accepted.
Each initial quotation should contain the quoter’s best terms from a price and technical standpoint. It is the quoter’s responsibility to ensure that there are no discrepancies presented within the information contained in its quotation. Quoters are hereby notified that in the event there are discrepancies within the information received by the Government, or in comparison to Government information provided in the solicitation, the Government reserves the right to apply its judgment to resolve such discrepancies during the evaluation of the quotation without further communications with the quoter.
A respondent’s quotation is presumed to represent the quoter’s best efforts to comply with the solicitation requirements. Clarity and completeness of the quotation are of the utmost importance.
The quotation must be written in a practical, clear, and concise manner. It must use quantitative terms whenever possible and must avoid qualitative adjectives to the maximum extent possible. Quotation volumes must be internally consistent or the quotation may be considered unrealistic, precluding further consideration for award. The quotation should be complete as submitted and not include references to data or information previously submitted. Data previously submitted to the Navy, if any, will not be incorporated “by reference” into the quotation and will not be considered in the evaluation of the quotation.
The quotation must demonstrate that the quoter understands all solicitation and Performance Work Statement (PWS) requirements and their interrelationships. It must demonstrate the quoter’s familiarity with the detailed aspects of the requirements, and clearly show that the quoter correctly interpreted all of the requirements. Quoters are cautioned against restating PWS requirements in their quotation, particularly with regard to technical requirements and must state how all solicitation and PWS requirements will be met. Statements such as "the quoter understands" and "the quoter shall/can comply," along with responses that paraphrase the solicitation, are inadequate. The use of phrases such as "standard practices" (with a specific government reference or industry reference) does not mailto:jeffrey.geringer@navy.mil indicate that a quoter understands the requirements and will likely result in a diminished evaluation rating. At the Government’s discretion, the Contractor’s quotation may be incorporated into the final contract, either in whole or in part.
A site visit will be scheduled to provide potential contractors the opportunity to examine the equipment and spaces that will be incorporated in the resulting contract – see Section 3.0 below.
All questions related to the solicitation must be submitted via email to jeffrey.geringer@navy.mil and patricia.murakami@navy.mil. Other methods of submitting questions are not authorized and will not be acknowledged or addressed.
All questions must be submitted by 11 December, 2019, 11:00 AM HST.

EVALUATION OF QUOTATIONS AND BASIS OF AWARD
If the quotation of a SLA is determined to be technically acceptable (as determined using Technical Capability criteria described below) and fair and reasonably priced, it will be deemed the presumptive awardee of the contract in accordance with Randolph Sheppard Act (20 U.S.C. §107, et. seq.), conditioned on resolution of:
• Questions regarding the SLA quoter’s technical volume;
• Matters of responsibility, including but not limited to compliance with the subcontracting plans submitted on previous contracts and state and local licensing and credentialing related to food handling, preparation, and service;
• Submission of a final price deemed by the Government to be the best value to the government as well as fair and reasonable in accordance with FAR 13.106(a) and 34 C.F.R. § 395.33.
If such matters cannot be resolved to ensure that the government obtains best value, the Government will remove the SLA from the competition and proceed with evaluation of other quotations as described below.
mailto:Jeffrey.geringer@navy.mil
Evaluation Factors for Award
In accordance with FAR Part 13 Simplified Acquisition Procedures, the Government will award a contract from this solicitation to the responsible quoter on a comparative basis whose quote conforms to the solicitation and represent the best overall value to the government. The Government will conduct a comparative assessment of quoters' responses based upon the evaluation factors and subfactors explained below. The Government will compare quotes against each other in an impartial and simplified manner based on FAR part 13. Source selection techniques described in FAR part 15 will not be used. The Government reserves the right to award to a quoter with other than the lowest price if the quotation offered additional benefits to the Government. The Government will not pay a price premium for a technical capability or past performance record that is not of value to the Government.
The following factors shall be used to evaluate offers:
Factor I - Technical Capability Factor II - Past Performance Factor III - Price
Factor I - Technical Capability Grading Criteria:
TECHNICAL CAPABILITY, Factor I, represents the MINIMUM acceptable criteria. Quoters’ technical information will be used to determine whether the services proposed meet the specifications included in this solicitation. Services offered, as provided in Quoters’ technical information, will be evaluated as Acceptable or Unacceptable. Quotations that received an overall rating of Unacceptable in Factor I will not be eligible for award.
NOTE: The term “technical” as used herein refers to non-price factors other than past performance.
The purpose of the technical factor is to assess whether the quoter’s proposal will satisfy the Government’s minimum requirements. The Government will evaluate quotations against these requirements to determine whether the quotation is acceptable or unacceptable, using the ratings and descriptions outlined in Table 1, below.
Table 1, Technical Acceptable/Unacceptable Ratings Rating Description Acceptable Quotation clearly meets the minimum requirements of the solicitation.
Unacceptable Quotation does not clearly meet the minimum requirements of the solicitation.
Factor I - Technical Capability, will be evaluated based on six (6) sub-factors.
1. Technical Approach
2. Resumes
3. Cleaning and Housekeeping Plan
4. Quality Control Plan
5. Training Plan
6. Phase-In Plan
Each sub-factor will be rated Acceptable or Unacceptable. A rating of Unacceptable in any of the sub-factors will render the Technical Capability factor overall rating to also be Unacceptable.
Factor II - Past Performance Grading Criteria:
Past performance will be rated on an Acceptable or Unacceptable basis using the ratings in Table 2 below:
TABLE 2. Past Performance Evaluation Ratings Rating Definition
Acceptable Based on the Quoter’s performance record, the Government has a reasonable expectation that the quoter will successfully perform the required effort, or the quoter’s performance record is unknown. (See note below.)
Unacceptable Based on the quoter’s performance record, the Government has no reasonable expectation that the quoter will be able to successfully perform the required effort.
Note: In the case of a quoter without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the quoter may not be evaluated favorably or unfavorably on past performance.
Therefore, the quoter shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered Acceptable. An evaluation of Acceptable based on unknown past performance may render the quotation non-competitive when compared with other quotations. Accordingly, the Contracting Officer reserves the right to determine that a higher-priced quotation with an Acceptable rating on Past Performance may be of more value to the Government than a lower-priced quotation that also has an Acceptable rating but without a record of Past Performance. Conversely, the Contracting Officer reserves the right to determine a lower-priced quotation with an Acceptable rating on Past Performance may be of more value to the Government than a higher-priced quotation that also has an Acceptable rating but without a record of Past Performance.
Aspects of Past Performance Evaluation. The past performance evaluation results is an assessment of the quoter’s probability of meeting the minimum past performance solicitation requirements. This assessment is based on the quoter’s record of relevant and recent past performance information that pertain to the products and/or services outlined in the solicitation requirements.
There are two aspects to the past performance evaluation. The first is to evaluate whether the quoter’s present/past performance is relevant or not relevant to the effort to be acquired.
“Relevancy” for this procurement means similar contracts (“similar” defined as approximately equal in value and task requirement – food service attendant services). “Recency” for this procurement means similar contracts completed or being performed within the last three (3) years of the closing date of this solicitation.
The second aspect of the past performance evaluation is to determine how well the contractor performed on the contracts. The past performance evaluation performed in support of a current source selection does not establish, create, or change the existing record and history of the quoter’s past performance on past contracts; rather, the past performance evaluation process gathers information from customers on how well the quoter performed those past contracts.
Sources of Past Performance Information for Evaluation are as follows:
• Past performance information may be provided by the quoter, as solicited.
• Past performance information will be obtained from any other sources available to the
Government, to include, but not limited to, the Contractor Performance Assessment Reporting System (CPARS), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), or other databases; interviews with Program Managers, Contracting Officers, and Fee Determining Officials; and the Defense Contract Management Agency.
The Government will review this past performance information and determine the quality and usefulness as it applies to performance competence assessment.
Factor III – Price
Only quotations that are rated Acceptable in both Factor I - Technical Capability, and Factor II - Past Performance will be evaluated for Factor III - Price.
If competition is not adequate to establish price reasonableness, cost analysis may be performed to establish reasonableness of the otherwise successful quoter’s price.
Quoters are cautioned that, to the extent proposed price appears to be wholly unrealistic, the Government may infer either a lack of understanding of the requirements, increased risk of performance, or lack of credibility on the part of the quoter.
The Government will calculate each quotations total evaluated price for award purposes by adding the total price for all options to the total price for the basic requirement. The total evaluated price will include the price of the FAR 52.217-8 Option to Extend Services, which will be calculated by using the CLIN 4001 unit (monthly) price times 6 months. The Government may determine that a quotation is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
After a quotation has been evaluated the Government may request additional information in order to clarify aspects of the quotation.
System for Award Management (SAM). Quoters must be registered in the SAM database to be considered for award. Registration is free and can be completed on-line at http://www.sam.gov/.
