If there are no planned opportunities for subcontracting in the performance of the contract, you must affirmatively state that no subcontracting possibilities exist and understand that you will be expected to perform 100% of the work involved in the contract if you are the successful awardee. Failure to do so would violate the terms of the contract and potentially put a contractor in breach of contract.

ii) The following are the DoD’s subcontracting goals which vendor should consider and strive to attain when allocating subcontracting efforts. It should be noted that these are not mandatory and each vendor’s subcontracting goals will vary based upon: (1) approach to satisfying solicitation requirements; and, (2) available subcontracting opportunities allowed for in the offeror’s approach.

Small Business (which includes all of the following) 36.0%

Small Disadvantaged Business 5.0%

Women-Owned Small Business 5.0%

Service-Disabled Veteran Owned Small Business 3.0%

HubZone Small Business 3.0%

Note: For requirements containing provisions for option periods, the offeror’s subcontracting plan must contain separate goals for each option period.

iii) The Government will review each plan to assure it is consistent with the provisions of the 52.219-9. Subcontracting plans are subject to negotiations along with the terms and conditions of any contract resulting from this solicitation. Vendors are hereby informed that failure to submit an acceptable subcontracting plan or confirm that there are no planned opportunities for subcontracting in the performance of the contract shall make the vendor ineligible for contract award.

iv) The following requirement will be included in any order resulting from this solicitation that is awarded to other than a small business and for which it is determined that there are opportunities for subcontracting in the performance of the contract :

SECTION M - EVALUATION FACTORS FOR AWARD

52.212-2 Evaluation -- Commercial Items.

(a) The Government will award a contract resulting from this solicitation to the lowest-priced technically acceptable vendor who demonstrates satisfactory past performance. The following factors shall be used to evaluate quotes:

(i) Price. Evaluation of price will be done on a comparative basis without examining the specific cost elements of the vendor’s quote. However, if necessary, the Contracting Officer may use alternate price analysis techniques to make a determination that quoted prices are fair and reasonable.

(ii) Technical Capability. This factor will evaluate the vendor’s ability to:

(1) Provide a techncially acceptable product. Technical acceptability for this factor will be based on the demonstrated ability of the vendor to provide a product that meets the Government’s minimum technical requirements as stated in the Purchase Description/Specification (Section C).

(2) Complete performance within the required schedule (Section F);

(iii) Past Performance. Past performance on other contracts, both private and government may be evaluated based on information provided by the vendor in accordance with the Addendum to FAR 52.212-1 and any other information available to the Government, to include evaluation of the vendor’s past performance history in the Past Performance Information Retrieval System –Statistical Reporting (PPIRS-SR) system. If the contracting officer has knowledge of the vendor’s past performance based upon on-going or previous contracts with the vendor, the government may choose not to obtain and evaluate the past performance information from a vendor’s references. Instead, the Contracting Officer may evaluate the vendor’s Past Performance using any of the methods set forth at FAR 13.106-2(b). If a vendor has no relevant past performance, the vendor must affirmatively state so. A vendor who has no relevant past performance will receive a neutral rating on past performance, which is neither positive nor negative. Vendors that fail to provide relevant past performance information, or that fail to provide the required statement confirming that they possess no relevant past performance history, will receive a past performance rating of unsatisfactory.

(b) All quotes will be evaluated for conformance with the solicitation requirements. QUOTES THAT DO NOT INCLUDE ALL OF THE INFORMATION LISTED IN THE INSTRUCTIONS FOR THE PREPARATION OF QUOTES (SECTION L) MAY BE EXCLUDED FROM EVALUATION. In addition, the Contracting Officer may reject quotes that do not meet all the material terms and conditions set forth in the request for quotes. Further, unreasonably high prices may be rejected and unrealistically low prices may be considered as evidence of the vendor’s lack of understanding of the requirement.

(c) All quotes will be then be evaluated by price. The lowest priced quote will be evaluated for technical acceptability. If the lowest price quote is determined to be technically unacceptable, then the evaluation team will evaluate the next lowest priced quote for technical acceptability and so forth. Once a technically acceptable quote is identified, that vendor’s past performance will be evaluated. If the vendor’s past performance is determined to be satisfactory, and the price is determined fair and reasonable, award will be made to that vendor without further evaluations.

(d) The Government intends to evaluate quotes and award a contract without conversations with vendors. Vendors should not expect requests for clarification or additional information from the government. Therefore, the vendor’s initial quote should contain the vendor’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct conversations with vendors if later determined by the Contracting Officer to be necessary. The Government may reject any or all quotes if such action is in the public interest, and may waive informalities and minor irregularities in quotes received.

(e) Small Business Subcontracting Plan:

i) If you are required to submit a subcontracting plan, your proposed plan must conform to the requirements of FAR Clause 52.219-9, “Small Business Subcontracting Plan,” DFARS 252.219-7003, “Small, Small Disadvantaged and Women-Owned Small Business Subcontracting Plan,” and meet or exceed the DoD subcontracting goals.

ii) Should the vendor fail to submit and acceptable plan, or confirm that there are no planned opportunities for subcontracting in the performance of the contract the vendor will be ineligible for award. (See FAR 19.702 Statutory Requirements (a)(1) regarding failure of the apparent successful offeror to negotiate and submit a plan acceptable to the Contracting Officer.) The successful Vendor’s subcontracting plan will be incorporated as an attachment to the resultant contract.
