About this file

This document is an Addendum to an Invitation to Negotiate (ITN) issued by the Florida Department of Corrections (FDC) for Money Transfer Services. The ITN seeks Responsive Replies from qualified Vendors to provide services including receipt processing for the Inmate Trust Fund and Court-Ordered Payment Fund, deposit services for customers, payment of discharge gratuity funds, providing Inmate Trust Fund balances to inmates, and providing weekly cash draws to inmates housed at Community Release Centers using debit card technology. The Department is also seeking a software solution to replace its current Inmate Trust Fund System. The Addendum provides the Department's answers to Vendor questions, including details on transaction volumes, integration requirements, implementation timelines, and service restrictions.

The ITN requires Vendors to provide one flat fee for all types of transactions through phone, mobile app, and online channels. Value-added services offered by Vendors will become contractual requirements. The Department intends to execute a contract shortly after award, with the Successful Vendor required to begin providing services no later than July 1, 2023. Veteran benefit recipients are exempt from processing fees, and the Department has a centralized banking arrangement with Bank of America for Inmate Trust and Court-Ordered Payment Fund transactions.

Page 19, SECTION 3 – SCOPE OF WORK, 3.2.2, RPS-001

Please provide further detail regarding “Bank Transfers via an authorized draft from a Customer’s checking or savings account”. Is this a FED-WIRE which is guaranteed or an ACH which would be equivalent to accepting personal checks (not guaranteed funds subject to NSF)? If ACH, can the vendor hold these funds until cleared (possibly in excess of 3 days)?

Bank Transfers are currently completed through an Automated Clearing House (ACH) transfer. No, when a sender deposits funds or an offender makes a payment on their COPS obligations via debit/credit card, the funds are deposited into the inmates/offenders account via a File Transfer Protocol (FTP) file transfer. This is typically completed on the same night and available for use the next day. The Department intends to continue this same practice for the Successful Vendor.

4.

Page 20, SECTION 3 – SCOPE OF WORK, 3.2.2, RPS-005

Please provide the quantity and total amount of mail-in checks returned and credit/debit card payments reversed for the past 3 years (2019, 2020, 2021).

The Department does not maintain this information.

5.

Page 20, SECTION 3 – SCOPE OF WORK, 3.2.2, RPS-005

Vendor understands that the Agency requires the vendor to assume all risks for returned checks and credit/debit chargebacks. Since these can be an indication of fraud, is the vendor required to report these to the Agency and if so, in what format? Does the existing vendor report these?

No, the Vendor is not required to report chargebacks, however, to deter fraud, chargebacks for inmates and offenders are reported to the Department, and the Department recoups funds (as available) from inmates and offenders.

6.

Page 20, SECTION 3 – SCOPE OF WORK, 3.2.2, RPS-005

Would the Agency consider working with the vendor to recover reversed funds where possible from the Inmate Trust Fund or Court Ordered Payment Fund (when not already distributed)?

Yes, this process is currently in place.

Addendum #002 4 FDC ITN-22-039

7.

Page 20, SECTION 3 – SCOPE OF WORK, 3.2.3, FDS-001

The requirements states “..and disbursing collected funds to the proper entities.” How many entities? To clarify, are these only State Agency entities or would it include disbursement of funds to victims as well?

This requirement is for the Inmate Trust Fund Software Solution. This would not include disbursements to victims.

8.

General

ATMs are mentioned in the ITN for the conversion of debit cards to cash for inmates. Please confirm that no ATMS, kiosks, or other cash dispensing or receiving hardware is required as part of the response.

ATM’s, kiosks, and other cash dispensing/receiving hardware are not required as part of the response.

9.

The ITN is requesting an Inmate Trust Fund Software System; however, Attachment II – Price Information Sheet does not provide a location to list pricing for the software system.

a. Where should vendors provide the pricing for the Inmate Trust Fund Software System?

b. Will the pricing for the Inmate Trust Fund Software System be a part of the Cost Evaluation Score?

i. If yes, how many points will the software be worth in the evaluation?

The Vendor will provide an Inmate Trust Fund Software System as part of the solution at no cost to the Department.

a. The Department is not requesting pricing for the Trust Fund Software System.

b. No.

10. Should pricing for Value Added services be listed in vendor responses? No. Please see Change No. 3 of this Addendum.

11. If yes, will that pricing be a part of the Cost Evaluation Score?

Please see the Answer to Question No. 10 of this Addendum.

12. How will Value Added services be scored?

Please see Section 4.10, TAB D, Service Area Detailed Solution and Section 4.18, Reply Evaluation and Negotiation Process.

13.

Currently, payment and deposit fees are tiered based on the amount paid/deposited and method of payment/deposit due to different expenses associated with each deposit type and credit card fees for larger deposits.

Attachment II – Price Information Sheet only has a spot to list one flat fee for all deposit/payment amounts and all deposit/payment methods. Will the Department please revise the Price Information Sheet to account for different fees depending on the deposit/payment method and amount of the deposit/payment.

The Department is requesting one fee for all types of transactions, phone, mobile app and on-line. Tiering of the fees may be addressed during the negotiation process.

Addendum #002 5 FDC ITN-22-039

14.

Section 2.6 states “Vendor must have the capability to begin providing services no later than January 1, 2023.” However, the provided timeline lists January 2023 as the date for when the Anticipated Posting of the Intent to Award will be. Will the timeline for the intent to award be moved up in order to provide sufficient time for the new vendor to implement services by January 1, 2023?

Please see Change No. 2 of this Addendum.

15.

PGM-005 states “The Vendor’s solution must identify Verified Veterans and Veteran benefit recipients.” How will this information be provided to the vendor?

The reason for identifying verified veterans is they are not required to pay processing fees in accordance with Rule 33-203.201(1)(a)2., F.A.C. This information is in the OBIS system and should download to the Inmate Trust Fund Solution. For Veteran benefit recipients in accordance with Rule 33-203.201(2)(e), F.A.C., checks are exempt from Departmental Liens.

This would need to be programmed into the Inmate Trust Fund system.

16.

PGM-002 states “The Vendor shall provide Money Transfer Services via a system that interfaces with the Department’s applications, including OBIS and COPS, using transport layer security through file transfer protocol, web services, and application programming interfaces.

a. OBIS interface – Please provide a list of the fields that are required for successful interfacing.

b. COPS interface – Please provide a list of the fields that are required for successful interfacing.

Please see Exhibit C of this Addendum.

17. How is the visitor list provided to the Inmate Trust Account? File Transfer Protocol (FTP).

18. What fields does the Trust Fund need to validate for approved senders? DC number and name of the approved visitor.

Addendum #002 6 FDC ITN-22-039

19.

FDS-001 states “The Vendor shall process disbursements from an Inmate or Offender’s trust account, placing liens and holds on accounts with outstanding obligations (i.e. fees and charges such as court-ordered filing fees, administrative fees, subsistence, savings, etc.), and disbursing collected funds to the proper entities.”

a. How are the obligation collections in the Inmate Trust Account transmitted to COPS?

b. What type of check stock (MICR/Pre-Printed) is used for disbursements out of the Inmate Trust Account?

This Fund Disbursement Service (FDS) requirement is concerning the Inmate Trust Fund software solution.

a. For Inmates who are employed and owe court-ordered obligations, 10% is deducted from their net pay. The Inmate Trust Fund would send a check monthly to COPS listing the inmates and obligations to be paid.

b. Both Inmate Trust Fund and COPS use a software program provided by ACOM check printing service. Blank checks with software adding the MICR information by a laser check printer.

20.

With regards to section 2.4 Resources, one of the links is to current FDC procedures applicable to this ITN. Regarding Exhibit C FDC ITN-22-039- Investment of Excess Inmate Trust Funds, please clarify that the interest earned by the “excess” Trust fund invested by the agency is not to be tracked in the Inmate Trust Account.

This is not tracked in the Inmate Trust Fund Accounts. Excess funds are sent to the Florida Division of Treasury Investment account.

21.

FDS-010 states “The Vendor shall provide a system sending unused funds to the Department of Financial Services as unclaimed property according to Section 717, Florida Statutes and Chapter 69G-20, F.A.C.”

a. Is there any interface between the Inmate Trust Account and the Department of Financial Services?

b. If yes, please provide a list of fields that are required for successful interfacing.

a. Please provide additional context or examples for further clarification for what is required?

b. Would it be possible to provide the auto deduction matrix that defines the priority of obligation collections from funds received by the inmate trust account?

This FDS requirement is concerning the Inmate Trust

Fund software solution.

a. Inmates can spend up to a maximum of $100.00 per week at the canteen. The balances should be adjusted nightly from FTP files sent by the

Canteen Vendor with the list of the inmate’s purchases for the day.

34.

Regarding Customer Outlets, a large population of depositors are unbanked.

Customer Outlets are an important method utilized by these depositors to send funds to incarcerated loved ones. Vendors have different partnerships with third party providers that would/could alleviate issues that have taken place with the incumbent’s Customer Outlets. Will the Department reconsider Customer Outlets for depositors and allow vendors to define their partnerships/workflow?

For Offenders making payments towards their COPS obligations, Customer Outlets are allowed.

For Inmates, in accordance with Rule 33-203.201

F.A.C., Customer Outlets are not allowed at the present time. The Department may consider resuming Customer Outlets in the future.

35.

If not, please explain the concerns of the Department regarding Customer Outlets continued use.

Customer Outlets are prohibited due to fraudulent activity. MoneyGram currently does not require a sender to provide any type of personal identification when sending up to $899.99.
