About this file

This file is an internal email chain from the City of Pasadena, California regarding the FY27 CDBG Street Resurfacing and ADA Improvement Project (IFB 2026-IFB-CIV-0288). The project involves resurfacing two street segments: Los Robles Avenue from Washington Boulevard to Orange Grove Boulevard and Fair Oaks Avenue from Washington Boulevard to Mountain Street. Associated work includes removal and reconstruction of deteriorated concrete curb, gutter, sidewalk, curb ramps, driveway aprons, and cross gutters; adjustment of utility manholes and valve covers to grade; replacement of traffic signal loop detectors; installation of raised pavement markers; and other related work. The contractor must maintain safe and accessible pedestrian pathways and continuous vehicular access to adjacent properties throughout construction, along with implementing all necessary traffic control measures including approved signage, barriers, and flagging personnel. The project operates under a compressed timeline due to CDBG expenditure requirements, necessitating expedited advertisement, award, and construction phases.

The project is partially funded through the Community Development Block Grant (CDBG) Program, a federal funding source. The City completed a union notification process and determined the project is exempt from AB339 notification requirements. The scope of work includes a detailed pricing proposal with individual bid items for various construction elements. The solicitation utilized a standard set of bid items with quantities being finalized by city staff and the Department of Transportation at the time of email correspondence in June 2026. The project was designed to be contracted out due to the need for specialized equipment, staffing, project size complexity, traffic control requirements, and surveying capabilities not available in-house.

Good morning Richard, Thank you. We appreciate the concerns with timing. The Union was notified last week ASAP after we received the Scope of Work from Tiffiny. If the Union raises any questions or asks to formally meet & confer we will let you know.

In the meantime, Lesley Cheung shared last week with the group that you could move forward with your RFP since this project is exempt from the AB339 notification requirements. Once the RFP closes feel free to reach back out to Emma and I. If the Union has not responded, you will be able to just move forward with your award.

Emma and Jaime, This is a highly time sensitive project with a very small window to advertise, award and construct due to the CDBG expenditure timeline.

We appreciate an expedited response so we can accomplish the grant funded project within scope.

Thanks, Richard Yee Assistant City Engineer x-4643

Hi Tiffiny, I do not believe we have any at this time. We sent notice to the union last week but have not received a response just yet. We'll let you know as soon as we do and if we have any follow-up questions needing your help to respond to.

Thanks!

Hello, The OpenGov project intake does ask us this question:

Neither options applied in this case. Full Street Resurfacing has historically been contracted out because of equipment, staffing, and project size. It also involves complex traffic control and surveying, which we do not perform in-house.

Best Regards, From: Arellano, Jaime <jarellano@cityofpasadena.net> Sent: Wednesday, June 17, 2026 11:22 AM To: Monroy, Caroline <cmonroy@cityofpasadena.net>; Alvarez, Erika <ealvarez@cityofpasadena.net>; Chen, Tiffiny <TChen@cityofpasadena.net> Subject: RE: New Comment - 2026-IFB-CIV-0288: FY27 CDBG Street Resurfacing and ADA Improvement Project

Hi, To be clear, Meyers Milias Brown Act requires we meet and confer on ALL contracting out of bargaining unit work. AB339 is specific to the notification process and areas that are exempt from the 45 day notification period. This is why it is urgent to update Open Gov to ask if the RFP is contracting out bargaining unit work and NOT whether or not AB339 compliance is applicable. The AFSCME MOU does not require anything more than the law in this area.

Under AB 339(d)(2), the law does not apply to contracts related to delivery of public works or other infrastructure projects.

I don’t know if there are other meet and confer requirements under AFSCME’s MOU. That would be a question for Jaime and Tiffiny to answer. Here is a snip of section 9 of their MOU. It seems like a continued re-bid of contracted CDBG contract work does not require meet and confer assuming there’s no expansion of work scope or impacts to employees, but that situation also is not clearly addressed in the MOU.

CM Caroline Monroy

Why are there "0"s in the quantities for certain bid items?

TC Tiffiny Chen

I pasted a standard set of bid items, but most are not going to be applicable. I have staff and DOT confirming and finalizing those quantities.

EA Erika Alvarez good morning, do you know if this bid needs HR AB 339 review? and was the pricing tabel finalized?
