About this file

This file is a comprehensive collection of federal compliance forms and certifications required by the City of Pasadena for the FY27 CDBG Street Resurfacing and ADA Improvement Project, which involves resurfacing Fair Oaks Avenue from Washington Boulevard to Mountain Street and Los Robles Avenue from Washington Boulevard to Orange Grove Boulevard, along with associated concrete and utility improvements, traffic signal upgrades, and pavement marker installation. Bids are due July 21, 2026 at 2:00 p.m., with questions due by July 14, 2026. The project term is 40 working days from the Notice to Proceed, with work to commence within 15 calendar days of award. Bidders must possess a valid California State Contractor's License, Class A at time of award, and must submit five completed projects demonstrating relevant experience on similar municipal infrastructure work.

The project is partially funded with federal Community Development Block Grant (CDBG) Program funds exceeding $250,000, triggering extensive federal compliance requirements including Build America, Buy America (BABA) certification requiring all iron, steel, manufactured products, and construction materials be produced in the United States unless exempted by specific waivers. Bidders must comply with prevailing wage requirements under California Labor Code sections 1770-1777, apprenticeship requirements under Labor Code Section 1777.5, Davis-Bacon wage determinations, Section 3 economic opportunity requirements, worker's compensation certification, federal lobbyist certification, non-segregated facilities certification, and Equal Employment Opportunity regulations. A 5 percent bid security (electronic surety bond) and 3 percent performance security deposit (not to exceed $30,000) are required. Liquidated damages are $1,000 per calendar day for contract delays, $1,200 per day for missed transit notifications, and $250 per transition per day for failure to maintain temporary pavement transitions. Asphalt Rubber Hot Mix with crumb rubber manufactured in California is specified, and contractors must submit engineered traffic control plans, Best Management Practices plans for stormwater pollution control, and Construction and Demolition Waste Management Plans requiring 75 percent waste diversion.

Required for federally funded infrastructure contracts subject to Build America, Buy America (BABA)

Project Information

Contractor /Company Name

Bid or RFP Number

Project Name

Federal Funding Source(s)

This “Buy America Preference Certification” is used to certify that, as required by the Build America, Buy America (BABA) Act, all of the iron, steel, manufactured products, and construction materials incorporated into an infrastructure project are produced in the United States, unless exempted by a HUD general waiver or a project-/product-specific waiver approved by the Made in America Office (MIAO) at the Office of Management and Budget (OMB). This certification must be completed and submitted with your bid or proposal if the scope includes construction, alteration, maintenance, or repair of infrastructure and is federally funded with $250,000 or more. The City reserves the right to request updated certification during project implementation.

For covered materials not otherwise exempted from the Buy America Preference (BAP), the undersigned certifies the following:

• All iron and steel used in the project are produced in the United States. This means all manufacturing processes, from the initial melting stage through the application of coatings, occurred in the United States;

• All manufactured products used in the project are produced in the United States. This means the manufactured product was manufactured in the United States, and the cost of the components of the manufactured product that are mined, produced, or manufactured in the United States is greater than 55 percent of the total cost of all components of the manufactured product, unless another standard that meets or exceeds this standard has been established under applicable law or regulation for determining the minimum amount of domestic content of the manufactured product;

• All construction materials used in the project are manufactured in the United States. This means that all manufacturing processes for the construction material occurred in the United States.

By signing this form, the contractor affirms that they will maintain documentation verifying compliance with the Buy America Preference for all covered materials. Acceptable supporting documentation includes (but is not limited to):

- Manufacturer certifications showing country of origin

- Invoices identifying U.S. production

- Material cut sheets or product data

- Bills of lading or shipping documentation

- Photos or site logs verifying installation of compliant materials

These records must be retained for five (5) years and provided to the City of Pasadena or HUD upon request. Noncompliance may result in withheld payments, disallowed costs, or termination for cause.

I certify that all iron, steel, manufactured products, and construction materials incorporated into the project will be produced in the United States in compliance with the Buy America Preference, or that an applicable waiver (including general waivers) applies. I agree to retain documentation supporting this certification and to submit it to the City of Pasadena or HUD upon request.

Rev. Dec. 2008

Rev. Dec. 2008

While completion of Form WH-347 is optional, it is mandatory for covered contractors and subcontractors performing work on Federally financed or assisted construction contracts to respond to the information collection contained in 29 C.F.R. §§ 3.3, 5.5(a). The Copeland Act (40 U.S.C. § 3145) contractors and subcontractors performing work on Federally financed or assisted construction contracts to "furnish weekly a statement with respect to the wages paid each employee during the preceding week." U.S. Department of Labor (DOL) regulations at 29 C.F.R. § 5.5(a)(3)(ii) require contractors to submit weekly a copy of all payrolls to the Federal agency contracting for or financing the construction project, accompanied by a signed "Statement of Compliance" indicating that the payrolls are correct and complete and that each laborer or mechanic has been paid not less than the proper Davis-Bacon prevailing wage rate for the work performed. DOL and federal contracting agencies receiving this information review the information to determine that employees have received legally required wages and fringe benefits.

OMB Approval No. 2501-0011 (Exp. 08/31/2022)

Instructions for HUD-4230A (8-19) PREVIOUS EDITION IS OBSOLETE

Public reporting burden for this collection of information is estimated to average 1 hour per response, including the time for reviewing instructions, searching existing data sources, gathering and maintaining data needed, and completing and reviewing the collection of information. The information is considered non-sensitive and does not require special protection. This information is required to obtain benefits.

This agency may not collect this information, and you are not required to complete this form, unless it displays a currently valid OMB control number.

Employers engaged on HUD-assisted construction projects subject to Davis-Bacon wage requirements must pay no less than the wages determined to be prevailing by the Secretary of Labor to all laborers and mechanics engaged on the construction work. On occasion, the applicable Davis-Bacon wage decision does not contain all of the work classifications and wage rates needed to complete the construction work.

This information collection facilitates the addition of needed work classifications and wage rates for the construction work involved. This form is used by HUD and local agencies administering HUD programs to report employer request(s) for additional classification and wage rates so that an appropriate wage rate can be approved by the Department of Labor for the construction work. This information collection is required by Department of Labor regulations at 29 CFR 5.5. While no assurances of confidentiality are pledged to respondents, HUD generally discloses these data only in response to a Freedom of Information request.
