B. In any case where these technical specifications conflict with the Federal Acquisition Regulations (FAR), FAR requirements will take precedence. In any case where FAR requirements are more strict or impose a higher standard than these technical specifications, FAR requirements will take precedence.

1.2 RELATED DOCUMENTS & PROVISIONS

Other related documents describing the requirements for the Work to be performed include the construction drawings entitled “2008 North Banker Floodway Levee Improvements Project (IWO No. 3) (Sta. 93+53 to 253+06)”, Dannebaum Engineering Corporation, November 7, 2008, the technical specifications, and the associated provisions included in the Contract.

1.3 PROVISIONS FOR MEASUREMENT AND PAYMENT

For Work performed by the Contractor under this Contract, the identified technical specifications (as shown in paragraph 1.1 herein) are those under which payment is to be made to the Contractor.

Measurement and payment of work shall be in accordance with SPECIFICATION 01 27 00 of this Contract.

1.4 SPECIFICATION / BID ITEM FORMAT AND CONVENTIONS

A. Specification Format. The technical specifications are organized into Divisions, and identified in Level 3 title format, using the Construction Specifications Institute’s (CSI) numbering system.

B. Bid Item Format. Bid Items under this Contract have been derived from the governing specifications identified in paragraph 1.1 herein. All Bid Items are identified in Section B of the Contract Provisions.

1.5 SPECIAL PROVISIONS

A. Any references to “Owner” (except for utility owner or property owner) in the technical

1.1 RELATED DOCUMENTS

The following may not include all related documents, contract clauses, & technical specifications, and does not relieve the Contractor of the responsibility of performing work associated with this specification in accordance with all terms of the Contract herein.

1.2 WORK COVERED BY THE CONTRACT DOCUMENTS

A. Project Identification. The Project to be constructed under this Contract is identified as follows:

(1) Name of Project –

International Boundary & Water Commission – United States Section

(2) Location of Project - Hidalgo County, Texas.

B. General Description of Work. The Work consists of the rehabilitation improvements of the levee known as North Banker Floodway, from South Bentsen Road (Sta 167+00) to Spur 115 (Sta 253+06). The following items are listed to illustrate the overall nature of the project. By no means is this listing to be considered complete. For a complete description of the project, see the Contract Drawings and Technical Specifications:

(1) Preparation of right-of-way for levee improvements:

a. Removal and stockpiling, if suitable for re-use, of gravel;

b. Removal and stockpiling, if suitable for re-use, of topsoil;

c. Removal and stockpiling, if suitable for re-use, of concrete riprap;

d. Removal of existing pavements, road appurtenances, and structures;

e. Clearing and grubbing;

f. Salvage and stockpile, if suitable for re-use, of caliche.

(2) Installation and maintenance of erosion control measures:

a. Silt fencing; and,

b. Construction entrances and exits.

(3) Raising of levee:

a. Benched excavation;

b. Placement of embankment;

c. Placement of topsoil;

d. Placement of riprap; and,

e. Seeding and re-vegetation of disturbed areas.

(4) Raising of gatewells.

(5) Construction of maintenance road:

a. Placement of flexible base; and,

b. Installation of guardrails.

1.3 SEQUENCE OF WORK / TIME FOR COMPLETION OF WORK

A. The general Work sequence will be the responsibility of the Contractor using good construction practices.

B. The Work under this Contract shall be completed within the calendar days specified under Section

F, Clause 52.211-10.

1.4 WORK UNDER OTHER CONTRACTS

No work is anticipated to be performed at the Project site, under separate contract with other contractors, USIBWC Contract No.: IBM09B0002 Page 01.19.00 - 3 during the Contractor’s performance under this Contract.

1.5 MATERIALS AND EQUIPMENT

A. Materials Ordered in Advance. The Government has not negotiated any purchase orders in advance for suppliers of materials and equipment to be incorporated into the Work.

B. Other Government-Furnished Materials. The Government will not provide any materials for the

Work.

C. Materials and Equipment to be Furnished by the Contractor.

(1) The Contractor shall provide all materials and equipment required to execute the Project.

(2) All materials provided by the Contractor for the Project shall be new or recycled, high grade, free from defects, meeting the specifications herein. Quality of the Work shall be in accordance with the specifications herein. The COR will ensure that materials, equipment, and Work quality strictly adhere to the requirements of the Contract documents.

(3) Materials, equipment, and work quality not conforming to the requirements of these specifications shall be considered defective and will be subject to rejection. Defective Work material, whether in place or not, or equipment shall be removed immediately from the site by the Contractor, at its expense, when so directed by the CO.

(4) If the Contractor fails to replace any defective or damaged work, materials or equipment after receiving notice, the CO may cause such work or materials to be replaced by other forces.

The replacement expense shall be deducted from the amount to be paid to the Contractor.

Defective equipment will not be allowed in the performance of any work.

1.6 STAGING AREA / STORAGE OF MATERIALS AND EQUIPMENT

A. The Contractor shall not use Government’s right-of-way for Staging Area.

B. The Contractor may make arrangements, at Contractor's cost, for temporary use of private properties, in which case Contractor and Contractor's surety shall indemnify and hold harmless the Government against claims or demands arising from such use of properties outside of rights-of-way.

C. The Contractor shall restrict total length which materials may be distributed along the route of the construction at any one time to 1,000 linear feet unless otherwise approved in writing by the

COR.

1.7 USE OF GOVERNMENT’S RIGHT-OF-WAY

The Contractor shall limit use of the right-of-way to that which is indicated in the Contract Drawings, so as to allow for the Government’s use and occupancy. Contractor operations shall be confined to the

Project site and other areas permitted and identified by the construction drawings. Portions of the site beyond areas on which the work is to be performed are not to be disturbed. Roads serving the facility, and identified as such, shall be clear and available to the Government as indicated in the construction drawings.

Locate and protect private lawn sprinkler systems which may exist on rights-of-ways within the site.

Repair or replace damaged systems to condition equal to or better than that existing at start of Work at no separate payment.

Perform daily clean-up of dirt outside the construction zone, and debris, scrap materials, and other disposable items. Keep streets, driveways, and sidewalks clean of dirt, debris and scrap materials. Do not leave building, roads, streets or other construction areas unclean overnight.

1.8 OCCUPANCY OF GOVERNMENT’S RIGHT-OF-WAY

A. Partial Government Occupancy. The Government may need to occupy the right-of-way during the entire construction period, with the exception of areas under construction. The Contractor shall cooperate with the Government during construction operations to minimize conflicts and facilitate Government access. The Contractor needs to maintain existing access to the facility, unless otherwise indicated in the construction drawings. The Contractor shall provide not less than seventy-two (72) hours notice to the Government of construction activities that will affect any Government activities.

B. Government Occupancy of Completed Areas of Construction. The Government reserves the right to occupy and to place and install equipment in completed areas of the facility, before Substantial Completion, provided such occupancy does not interfere with completion of the Work. Such placement of equipment and partial occupancy shall not constitute acceptance of the total Work.

1.9 WORK RESTRICTIONS

A. On-Site Work Hours. The Contractor’s attention is directed to Section H.11 of the Contract Provisions.

B. Irrigation Pipe – N/A.

C. Cutting the Levee for Structure Improvements. In some instances, the work may require cutting the levee. This Work may not be performed during hurricane season.

1.10 PROPERTIES OUTSIDE OF GOVERNMENT RIGHT-OF-WAY

A. Altering the condition of properties adjacent to and along rights-of-way will not be permitted.

B. Means, methods, techniques, sequences, or procedures which will result in damage to properties or improvements in the vicinity outside of rights-of-way will not be permitted.

C. Any damage to properties outside of rights-of-ways shall be repaired or replaced to the satisfaction of the property owner and at no cost to the Government.

D. Maintain access for emergency vehicles including access to fire hydrants.

E. Avoid obstructing drainage ditches or inlets; when obstruction is unavoidable due to requirements of the Work, provide grading and temporary drainage structures to maintain unimpeded flow.

1.11 NOTIFICATION TO ADJACENT OCCUPANTS

A. Notify individual occupants in areas to be effected by the Work of the proposed construction and time schedule. Notification shall be not less than 72 hours or more than 2 weeks prior to work being performed within 200 feet of the homes or businesses.

B. Include in notification names and telephone numbers of two company representatives for resident contact, who will be available on 24-hour call. Include precautions which will be taken to protect private property and identify potential access or utility inconvenience or disruption.

C. Consideration shall be given to the ethnicity of the neighborhood where English is not the dominant language. Notice shall be in an understandable language.

1.12 PUBLIC, TEMPORARY, AND CONSTRUCTION ROADS AND RAMPS

A. Construct and maintain temporary detours, ramps, and roads to provide for normal public traffic flow when use of public roads or streets is closed by necessities of the Work.

B. Provide mats or other means to prevent overloading or damage to existing roadways from tracked equipment or large or heavy trucks or equipment.

C. Avoid needless hindering or inconveniencing public travel on a street or any intersecting alley or street for more than two blocks at any one time.

D. Remove surplus materials and debris and open each block for public use as work in that block is complete.

E. Acceptance of any portion of the Work will not be based on return of street to public use.

F. Avoid obstructing driveways or entrances to private property.

G. Provide temporary crossing or complete the excavation and backfill in one continuous operation to minimize the duration of obstruction when excavation is required across drives or entrances.

H. Any damage to public roadways outside of rights-of-ways shall be repaired or replaced to the satisfaction of the roadway owner and at no cost to the Government.

I. Obtain approvals of governing authorities prior to impeding or closing public roads or streets. Do not close more than two consecutive intersections at one time.

J. Notify COR and governing entity at least 48 hours prior to closing a street for a street crossing.

Permission for street closures is required in advance and is the responsibility of the Contractor.

K. Maintain access for emergency vehicles including access to fire hydrants.

L. Avoid obstructing drainage ditches or inlets; when obstruction is unavoidable due to requirements of the Work, provide grading and temporary drainage structures to maintain unimpeded flow.

1.13 TRAFFIC CONTROL

Contractor shall provide traffic control plan, traffic control, flagmen, signals, control devices, lights, traffic signals, barricades and signs in accordance with the State of Texas Manual on Uniform Traffic Control Devices.

1.14 PROJECT SITE RESTORATION

Contractor shall restore project site to condition existing before construction to satisfaction of Government.

1.15 CHANGES IN SCOPE OF WORK

Contractor shall restore project site to condition existing before construction to satisfaction of Government.

A. Request for Modification to the Scope of Work.

(1) The Contracting Officer may issue a request for proposal for changes in scope of work, which will include a detailed description of a proposed change with supplementary or revised Contract Drawings and Technical Specifications. The Contracting Officer may also request a proposal in the response to a Request for Information. Contractor shall prepare and submit a proposal within 7 days or as specified in the request.

(2) The Contractor may propose an unsolicited change by submitting a proposal to the

Contracting Officer describing the proposed change and its full effect on the Work, with a statement describing the reason for the change and the effect on the Contract Price and Contract Time including full documentation.

B. Proposal Requirements for Change Orders.

(1) The Contractor shall provide full information required for identification and evaluation of proposed changes, and to substantiate costs of changes in the Work.

(2) The Contractor shall document each proposal for a change in cost or time with sufficient data to allow evaluation of the proposal by the Contracting Officer.

(3) Proposals developed by the Contractor shall include, as a minimum, the following information as applicable:

(a) Original Bid Items with Changes in Quantities - additions, reductions, deletions, and substitutions.

(b) When Work items were not included in the Original Bid Items, the Contractor shall provide unit prices for the new items, with supporting information as required by the Contracting Officer.

(c) Justification for any change in time for completion of work, supported with a project schedule reflecting impacts, if any, to the Contract completion date.

(d) Additional data upon request.

C. Review and Negotiation of Change Orders. Any proposal, if reviewed and compliance-confirmed as a change in scope of work by the Contracting Officer, will be executed by the Contracting Officer as a Change Orders and Contract Modifications in accordance with Section H

– Special Contract Requirements, paragraph H.15.

D. Correlation of Contractor Submittals. The Contractor shall incorporate changes to the scope of work of executed Change Orders into the Progress Schedule and any other related submittals.

This specification identifies administrative and procedural requirements for measurement of the work and payment to the Contractor for Work performed, and includes the following:

1.2 MEASUREMENT OF QUANTITIES

The Government or COR will measure all completed work using US standard measures. The method of measurement for each Bid Item is identified under the applicable technical specifications and is in general as follows:

A. Measurement by Weight: Reinforcing steel, rolled or formed steel or other metal shapes will be measured by CRSI or AISC Manual of Steel Construction weights. Welded assemblies will be measured by CRSI or AISC Manual of Steel Construction or scale weights.

B. Measurement by Volume:

(1) Stockpiles: Measured by cubic dimension using mean length, width, and height or thickness.

(2) Excavation and Embankment Materials: Measured by cubic dimension using the average end area method.

C. Measurement by Area: Measured by square dimension using mean length and width or radius.

D. Linear Measurement: Measured by linear dimension, at the item centerline.

E. Other: (Including but not limited to, each and lump sum). Items measured by weight, volume, area, or lineal means or combination, as appropriate, as a completed item or unit of the Work.

1.3 SCOPE OF PAYMENT

Payment to the Contractor shall be at the Unit Price for each Bid Item, and shall, in general, be considered full compensation for all materials, equipment, labor, tools, supplies, and incidentals necessary to complete the Bid Items and the Work under the Contract. The method of payment for each Bid Item is further identified under the applicable technical specifications and the Unit Price set forth in the Bid Schedule of the Contract Documents. Payment of the Unit Price for each Bid Item will be payment in full for this Contract. All costs and expenses for which no specific Unit Price is set forth in the Bid Schedule shall be considered subsidiary, and included in the Unit Prices that are applicable and specifically set forth in the Bid Schedule, and no additional payment will be made therefore.

1.4 MEASUREMENT AND PAYMENT FOR CHANGES IN WORK

Measurement and payment to the Contractor for extra work directed and incorporated by Construction Change Directive, performed by the Contractor, and accepted by the Government or COR, will be made in accordance with the provisions of the Contract.

PART 1 – GENERAL

The following may not include all related documents, contract clauses, & technical specifications, and does not relieve the Contractor of the responsibility of performing work associated with this specification

1.2 COORDINATION

In general, construction operations shall be coordinated to ensure efficient and orderly installation of each part of the work. In addition to a Project Superintendent, the Contractor shall provide other administrative and supervisory personnel as required for proper coordination and administration of the work. The Contractor’s Project Superintendent shall be available to the Government during business hours, as well as emergency contact. Other coordination responsibilities and activities required to be provided by the Contractor includes the following:

A. The Contractor shall be responsible for ascertaining the nature and extent of any simultaneous, collateral, and essential work by others. The Government, its workers and contractors, and others, shall have the right to operate within or adjacent to the Construction site to perform such work.

B. In accordance with the provisions and time frames stated in SPECIFICATION 01 32 00, the

Contractor shall submit to the COR a proposed Schedule of Work. This Schedule of Work shall be in the form as described in SPECIFICATION 01 32 00, and shall reflect all coordination efforts of the Work under this Contract.

1.3 PROJECT MEETINGS

All meetings, unless otherwise directed shall be scheduled and conducted at the Project site. The COR shall inform participants and others involved, and individuals whose presence is required, of date and time of each meeting. The COR shall prepare the meeting agenda, and distribute to all invited attendees.

The COR shall record significant discussions and agreements achieved, and distribute the meeting minutes to everyone concerned, within seven (7) calendar days of the meeting. The following meetings are anticipated, and the Contractor shall identify them in the Schedule of Work:

A. Preconstruction Conference. A preconstruction conference shall be scheduled by the COR prior to the start of construction, but no later than fifteen (15) calendar days after Government receipt of acceptable payment and performance bonds and proof of insurance. The preconstruction conference will be held at the USIBWC – Mercedes Office at 325 Golf Course Road in Mercedes, Texas. The purpose of the meeting is to introduce project personnel and review responsibilities and procedures. The Contractor shall provide a copy of his Draft Schedule of Work as specified under SPECIFICATION 01 32 00, Construction Progress and Documentation.

(1) Attendees - Authorized representatives of the Government (including the COR), the Engineer, the Contractor’s Superintendent, major subcontractors, suppliers; and other concerned parties shall attend the conference. All participants at the conference shall be familiar with Project and authorized to conclude matters relating to the Work.

(2) Agenda – Discussion of items of significance that could affect the Work and project, including the following: introduction / designation of key personnel and their duties; review of the Draft Schedule of Work, phasing, critical work sequencing and long-lead items; review of procedures for handling and processing field decisions, Change Orders, RFIs, testing and inspection, applications for payment, and submittals; preparation of record documents; use of right-of-way; work restrictions; USIBWC and others occupancy requirements; responsibilities for temporary facilities and controls; construction waste management and recycling; field office, parking, Work, and storage areas; equipment and materials deliveries and priorities;

safety and first aid; security; maintenance of project site; and working hours.

(3) Meeting Minutes – The COR will record the discussions of the meeting, and distribute the minutes.

B. Progress Meetings. The COR will arrange and conduct weekly progress meetings. The meetings shall include the Government, and the Contractor’s Project Manager, Field Superintendents, and Quality Control Manager. The purpose of these meetings shall be to analyze the progress of the work of the Contractor, resolve conflicts, and in general, coordinate the operation of all organizations active at the project site. Minutes of the meetings will be kept and distributed by the Government. The Government may call other meetings on an "as needed" basis. All meetings will be held at the USIBWC – Mercedes Office at 325 Golf Course Road in Mercedes, Texas or other mutually agreed upon location.

1.4 REQUESTS FOR INFORMATION (RFI)

Immediately on discovery of the need for interpretation of the Contract Documents, and if not possible to request interpretation at Project meeting, the Contractor shall prepare and submit an RFI in the form specified.

A. Content of the RFI. The RFI shall include a detailed, legible description of item needing interpretation and the following:

(1) Project name.

(2) Date.

(3) Name of Contractor.

(4) RFI number, numbered sequentially.

(5) Specification number, title and related paragraphs, as appropriate.

(6) Drawing number and detail references, as appropriate.

(7) Field dimensions and conditions, as appropriate.

(8) Contractor's suggested solution(s). If Contractor's solution(s) impact the Contract Time or the Contract Sum, Contractor shall state impact in the RFI.

(9) Contractor's signature.

(10) Attachments: Include drawings, descriptions, measurements, photos, Product Data, Shop Drawings, and other information necessary to fully describe items needing interpretation.

Supplementary drawings prepared by Contractor shall include dimensions, thicknesses, structural grid references, and details of affected materials, assemblies, and attachments.

B. Government Action. The COR will review each RFI, determine action required, and return a response to the Contractor within five (5) calendar days. RFIs received after 1:00 p.m. will be considered as received the following calendar day.

C. RFI Log. The Contractor shall prepare and maintain a tabular RFI log organized by RFI number to be submitted to the COR on Friday. The RFI log will contain, at a minimum, the following:

(1) Project name.

(2) Name and address of Contractor.

(3) RFI number including RFIs that were dropped and not submitted.

(4) RFI description.

(5) Date the RFI was submitted.

(6) Date Government response was received.

(7) Identification of related Construction Change Directive, Change Order, and Proposal Request, as appropriate.

PART 4 – MEASUREMENT AND PAYMENT

The Work performed by the Contractor under this specification shall not be paid for directly, but shall be

1.2 DESCRIPTION / PURPOSE

Pursuant to the Contract Clause H.10 entitled "Construction Program," the Contractor shall prepare a Progress Schedule (PS) of construction which shall reflect completion of all work under this Contract, and shall include allotted time for related construction activities by other agencies, within the allotted construction period. This schedule shall be prepared using the Critical Path Method (CPM). The PS is required to assure adequate planning and execution of the work and to assist the Government in appraising the reasonableness of the proposed schedule and evaluating progress of the Work both before and during construction. Jobsite mobilization will not be permitted to take place by the Contractor until the PS is compliance confirmed by the Government.

1.3 PROGRESS SCHEDULE:

The PS shall include all planned work activities and sequences and show Contract completion within the number of calendar days specified. Incorporate major material procurements, known utility relocations, USIBWC Contract No.: IBM09B0002 Page 01.32.00 - 2 and other activities (submittals, review confirmation of submittals, anticipated weather delays as defined in Section J, etc.) that may affect the completion of the Contract in the PS. Show a beginning date, ending date, and duration in number of calendar days for each activity. Do not use activities exceeding 20 calendar days, except for agreed upon activities. Show an estimated production rate per calendar day for each work activity. The CPM schedule shall be created and maintained using Microsoft Project computer software. Ensure all work sequences are logical and show a coordinated plan of the work.

Show a predecessor and successor for each activity. Clearly and accurately identify the critical path.

Provide a legend for all abbreviations.

Describe each activity on the schedule using:

• A logical activity number utilizing an alphanumeric designation system tied to the sequence of work and traffic control plans;

• A concise description of the work represented by the activity; and

• An activity duration in whole calendar days.

Code the activities so that organized plots of the PS may be produced. Calculate activity durations by dividing the quantity of work for each individual activity by the estimated production rate.

1.4 SUBMITTAL PROCEDURES FOR PROGRESS SCHEDULE

The Contractor shall prepare and submit the PS as follows:

A. The complete PS for the full duration of the Contract, consisting of the CPM, schedule of anticipated monthly earnings shall be submitted within seven (7) calendar days after the Notice to Proceed is issued. The Government will review the PS and submit comments and required revisions within fourteen (14) calendar days of receipt.

B. The Contractor shall participate in a review and evaluation of the proposed PS by the

Government, if requested by the Government. Any revisions necessary as a result of this review shall be submitted for compliance-confirmation by the Government within seven (7) calendar days after the review. The compliance-confirmed PS shall then be the baseline schedule to be used by the Contractor for planning, organizing and directing the Work and for reporting progress and requesting payment for the Work accomplished. If the Contractor thereafter desires to make changes in the method of operating and scheduling, the Contractor shall notify the Government in writing stating the reasons for the change.

C. If the Government considers these changes to be major, the Government shall require the

Contractor to revise and submit for compliance-confirmation, without additional cost to the Government, all of the affected portion of the PS, to show the effect of the entire project. A change may be considered major if the time estimated to be required or actually used for an activity or the logic of sequence of activities is varied from the original plan to a degree that there is a reasonable doubt, in the opinion of the Government, as to the effect upon the contract completion date or dates. Changes which affect activities with adequate float time shall be considered minor changes, except that an accumulation of minor changes shall be considered a major change when their cumulative effect, affects the contract completion date. The effect of minor changes on the logic shall be shown on the monthly update and described fully in the

D. Initial submittal network diagram for review purposes shall be submitted on two (2) full-size copies, signed by an individual authorized to bind the firm and one electronic backup copy of the PS (saved on compact disc). The final compliance-confirmed PS shall be submitted on two (2) full-size copies, two (2) half-size copies and one (1) full-size reproducible each signed by an individual authorized to bind the firm and one electronic backup copy of the project schedule (saved on compact disc).

E. When submitting a proposal in response to a letter request for proposal (RFP) for accomplishing revised Work, the Contractor shall include in that proposal a PS for determining the effect of the proposed change on the contract time or schedule. When changes in the Work are found to necessitate issuance of a Notice to Proceed (issued under a unilateral modification) prior to cost proposal submission and/or settlement to avoid delay and additional expense, the Contractor shall furnish the Government suggested changes to the schedule logic and/or duration time estimates of all activities affected by the modification within ten (10) calendar days from the Notice to Proceed. These revisions will be submitted for concurrence of the Government prior to inclusion in the schedule. In the event the Contractor does not furnish the suggested schedule logic changes or an agreement cannot be reached, the Government will direct the Contractor as to the specific schedule logic changes and/or duration time estimate changes to be entered into the schedule logic and used in all subsequent progress reports until such time that the time has been settled or until actual dates supersede the estimated dates. Inclusion in the network and use of revised logic and/or duration time estimates for updating, whether furnished by the Contractor or the Government, will not be construed as extensions of time to the dates required in the contract.

F. The above-mentioned changes are for the purpose of keeping the PS up to date to reflect the

Work to be accomplished and to include the best time estimates for Work yet to be done. If it becomes necessary for the Government to furnish the suggested logic and/or duration time revisions because of the Contractor’s failure to furnish acceptable data on time, and if the Contractor has any objections to the data furnished by the Government, the Contractor shall advise the Government promptly, in writing, of such objections fully supported by the Contractor’s own counter-plan. However, the Contractor will continue to use the revisions suggested by the Government for progress reports until such time as the Government may approve alternate data. If the Contractor fails to submit, in writing, the objections to the revisions along with supporting data and counter-plan within fourteen (14) calendar days after the date such suggested revisions were furnished by the Government, the Contractor will be deemed to have concurred with the Government’s suggested logic/duration time changes. The changes then will be the basis for equitable adjustment of the time for performance of the work.

G. Revisions and additions to the PS shall be submitted on two (2) full-size copies, two (2) half-size copies, one (1) full-size reproducible, and one electronic copy.

H. The Contractor shall submit, as part of the monthly request for payment, a report of the actual construction progress by updating PS. Entering of updating information into the PS will be subject to compliance-confirmation by the Government. The Contractor shall, indicate on the PS

Updates causing changes in the detailed schedule diagram shall be noted on the summary schedule diagram, and a revised issue of the affected portions of the detailed schedule diagram shall be furnished along with the PS. The date to be used for calculating progress shall be the first work day of the month following the progress month, with remaining project Work scheduled.

I. The progress report shall show the activities or portion of activities completed during the reporting period and their total value as basis for the Contractor’s periodic request for payment.

The progress report shall state the percentage of the Work actually completed and scheduled as of the report date and the progress along the critical path in terms of days ahead or behind the contract completion dates. If the project is behind schedule, progress along other paths with total float equal to or less than the number of days that the project is behind schedule shall also be reported. The Contractor shall also submit a narrative report with the updated PS which shall include, but not be limited to, a description of the current and anticipated problem areas; delaying factors and their impact; a list of those activity numbers that were added, updated or revised; and an explanation of the corrective actions taken or proposed.

J. Monthly progress reports and schedule analysis shall be submitted in three (3) full size copies and two (2) half-size copies.

K. Sheet size of diagrams for full size copies shall be thirty (30) inches x forty-two (42) inches.

Each update copy shall show the date of the latest revision.

The work performed by the Contractor under this specification shall not be paid for directly, but shall be

1.2 DEFINITION OF “SUBMITTALS”

The word "Submittals" shall be interpreted to include shop drawings, data, manuals, certifications, samples, color chips or charts, brochures, schedules, photographs, and other items furnished by the Contractor for review, information, and other purposes. Specific Submittal requirements are identified in each technical specification, if required for that specification.

1.3 SUBMITTAL PACKAGE REQUIREMENTS

A. The Contractor shall provide all materials and perform all work required for furnishing Submittals to the Government, in accordance with the contract clause Section I entitled "Specifications and Drawings for Construction" and the requirements in these Contract Documents.

B. The Contractor shall submit five (5) complete sets of each required Submittal together with five

(5) copies of the Transmittal Document (IBWC Form 146) to the COR for review. The original set of the Submittal shall be considered as one of the complete sets required to be submitted. The transmittal document shall contain the following:

(1) The date the transmittal was submitted;

(2) The name of the Project;

(3) The number of complete sets;

(4) The Contract number;

(5) The transmittal number;

(6) The specification number and paragraph number;

(7) The name of the Contractor;

(8) A description of items submitted including numbers and titles;

(9) Identification as either a new Submittal or a re-submittal;

(10) A written statement of any variation and requests for compliance-confirmation of any departures from the Contract Documents; and,

(11) The Contractor’s Representative’s name and signature certifying that the Contractor has reviewed the Submittal and coordinated the work of all trades involved and that the item of work is in strict conformance with the Contract Documents. The Contractor’s signature of certification shall constitute a representation that all quantities, dimensions, construction criteria, materials, performance criteria, and similar data have been verified and that the Submittal fully meets the requirements of the Contract Documents.

C. Each Submittal shall be numbered consecutively with a transmittal number, and shall accurately and distinctly present the following:

(1) All working and erection dimensions;

(2) Arrangements and sectional views;

(3) Necessary details, including complete information for making connections between work outside the project or to be performed by others, and work under these Contract Documents;

(4) Kinds of materials and finishes; and,

(5) Parts lists and description thereof.

D. Each drawing or page shall include:

(1) Submittal date, revision dates, and transmittal number;

(2) Project name and USIBWC contract number and Project title;

(3) Detailed Contract Document section number and paragraph number;

(4) Name of Contractor and Subcontractor;

(5) Name of supplier and manufacturer;

(6) Relation to adjacent structure or material;

(7) Field dimensions, clearly identified;

(8) Standard, code, test, or Contract Document references;

(9) Identification of deviations from the Contract Documents;

(10) Contractor’s stamp, initialed or signed, dated and certifying to review of Submittal, certification of field measurements and compliance with Contract Documents;

(11) Location at which the equipment or material is to be installed; location shall mean both physical location and location relative to other connected or attached material;

(12) Contractor’s or Supplier's title; and,

(13) Drawing Number.

E. The Contractor shall submit only complete sets of material/information for review unless otherwise advised by the COR. The Contractor shall check and approve all Submittals prior to transmitting them to the COR to determine if they comply with requirements of the Contract Documents. Submittals that are incomplete or are not in compliance with the Contract Documents will not be accepted for processing by the COR.

F. Manufacturer's data for commercial products or equipment, such as catalog cut sheets, shall be clearly marked to indicate the item(s) to be furnished. The data shall be sufficiently comprehensive to identify the manufacturer's name, type, model, size, and characteristics of the product or equipment, and fully demonstrate that the product or equipment meets the requirements of the Contract Documents.

G. Stock or standard drawings will not be accepted for review unless full identification and supplementary information is shown thereon in ink or typewritten form.

H. Material Certifications. Submittals for each type of material mentioned for each specification shall include test results performed on that material for this Contract, along with a letter certifying compliance with the Contract Documents.

1.4 SUBMITTAL REVIEW AND PROCEDURES

A. The COR will return unchecked any Submittal which does not contain complete data on the work and full information on related matters. The time required for review of Submittals furnished as specified herein will begin after Notice to Proceed and the date after the COR receives complete sets of the Submittal. Submittals that require changes or revisions shall be revised and

USIBWC Contract No.: IBM09B0002 Page 01.33.00 - 4 resubmitted for review, and shall indicate changes and revisions made. All requirements specified for the initial Submittal shall apply to any re-submittals required. Unless otherwise specified, the Contractor shall submit all re-submittals within fourteen (14) calendar days after the Contractor has received the COR’s comments.

B. Except as otherwise provided in these Contract Documents for specific Submittals, the

Government will require fourteen (14) calendar days for review of each Submittal or re- Submittals. This review period will begin the date after the Submittal(s) are received by the COR and will extend through the date of return mailing to the Contractor. This review period will apply to each separate Submittal or re-submittal whether compliance is confirmed or the Submittal or re-submittal is returned for revision.

C. If the COR uses time in excess of the above stated number of calendar days for review of any

Submittal or re-submittal, additional time, not to exceed the excess time, will be added to the time allowed the Contractor for completion of the work affected by such excess time, to the extent it is demonstrated that the excess time caused delay. If the COR’s review of two or more separate Submittals or re-submittals is late and results in concurrent calendar days of excess time, such days will be counted only once in computing an extension of the completion date. Further, if the Contractor fails to make Submittals in the sequence within the time period specified in these Contract Documents, and thus precludes the COR from reviewing such Submittals within the foregoing fourteen (14) calendar day period, then the Contractor shall not be entitled to an extension of time allowed for completion of the work.
