2) Paragraph C of the provision is revised to read as follows: “Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 90 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

Relevant experience may include work with Federal, State and Local Governments as well as commercial customers.

Submitted information shall not include projects performed outside of five (5) years preceding the closing date of the RFP. For each project identified that has a period of performance within three years from the date of this solicitation, offerors shall provide reference information required by the Past Performance Factor. Offerors shall also forward the Past Performance Questionnaire to references as directed by Factor B. For each project identified under this Factor, offerors shall provide the following information:

Contracts provided may include those entered into by the Federal Government, agencies of state and local Governments and commercial customers. Each reference should include the current name, email address, mailing address, and telephone and fax numbers for the Administrative Contracting Officer and Technical Representative (or equivalent for commercial contracts).

Additionally, offerors shall forward the Past Performance Questionnaire to the reference provided to complete the Questionnaire and return it to the designated Government point of contact by the proposal due date. 52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

All offers received timely and in accordance with Federal Acquisition Regulation (FAR) 52.212-1 will be evaluated.

This acquisition will use trade-off analysis to make a best value award decision. Source selection will incorporate trade-off techniques and will be made based on an integrated assessment of each offeror’s proposal. As such, the Government may award to an offeror who has not offered the lowest price or the highest rated technical offer.

The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government. Offers will be evaluated based on the stated evaluation factors.

Adjectival ratings will be used to rate all technical factors. Each of the evaluation rating terms is further defined below.

Experience, Past Performance, and Sample Menus are of equal importance. Service Levels is less important than any of the other three technical factors. When combined, the technical factors are significantly more important than price.

Factor A – Experience

The Government will evaluate the depth, recency and relevancy of the offeror’s (or major subcontractor’s) experience as compared to the services required by this solicitation. Relevant experience includes contracts operating in similar working environments and contracts involving services that are considered to be similar in scope, magnitude, and complexity when compared to the requirements described in this solicitation (e.g., coordinating food service delivery in a European environment and providing full-service dining facility services to international patrons on a U.S. Government installation in Europe).

Factor B – Past Performance

The Government will evaluate the recency, relevancy, source of the information, context of the data, and general trends in the offeror’s (and major subcontractor’s) past performance. “Recent past performance under this requirement is defined as contracts that have a period of performance occurring within the last three years from the date of issuance of this solicitation. Past performance information that is found to be neither current nor recent will be rated neutral. Relevant past performance under this requirement is defined as performance under firm fixed price contracts operating in similar working environments and contracts involving services that are considered to be similar in scope, magnitude and complexity when compared to the requirements described in this solicitation. This evaluation is separate and distinct from the Contracting Officer’s responsibility determination. The assessment of the offeror’s past performance will be used to evaluate how well he/she has performed similar services in the past.

Offerors lacking relevant past performance history will not be evaluated favorably or unfavorably for past performance.

Factor C – Sample Menus

The Government will evaluate the quality of the meal services being offered to determine the extent to which proposed menus are considered appetizing and varied from week to week. Appetizing meals are defined as meals that conform to the general guidelines in Technical Exhibit TE-2 and appeal to the regional tastes of the Marshall Center guest/patron population.

Factor D – Service Levels

The Government will evaluate the extent to which the proposed service levels add value to the Marshall Center dining experience. Offerors who do not submit any service levels or offer service levels deemed to be of no value will not be evaluated favorably or unfavorably for this Factor and will receive a neutral rating.

Factor E - Price

All prices, including options, will be evaluated for reasonableness. All proposals shall be stated in US dollars.

Technical Exhibit 7 of the solicitation includes not-to-exceed prices for each line item in the pricing schedule. The not-to-exceed values of this contract represent the maximum price the Government is willing to pay for all services and quality features required under the contract, to include all desired service levels identified in Technical Exhibit 8 and/or otherwise proposed by the offeror. Proposals that exceed the not-to-exceed prices stated in the solicitation for each line item in the pricing schedule will not be considered.
