QUESTIONS AND ANSWERS
Germany and Belgium School Maintenance Program (GBSMP)
DoDDS-Europe Solicitation: HE1280-14-R-0008 (Amendment 3)
PPI#01: Reference Government’s answers to questions 16 and 34. No details were added for the Belgium Tax Relief process. We understand that a Prime’s subcontractors and other such lower tier companies are not relieved from the Belgium VAT. Please provide details as to what will the Government process be exactly in regards to the relief of the Belgium VAT tax for the Prime contractor and its lower tier subcontractors and suppliers.
Answer: The DFAR’s Clause 252.229-7001, “Tax Relief (June 1997) – Alternate I (June 1997)”, specifically states, “Prices set forth in this contract are exclusive of all taxes and duties from which the United States Government is exempt by virtue of tax agreements between the United States Government and the Contractor’s government. The following taxes or duties have been excluded from the contract price…German – Mehrwertsteuer Rate 19%...Belgium – TVA Rate 21%”. The government recommends offerors coordinate with the Belgium tax authorities on what documentation is required and acceptable for purposes of receiving tax relief while performing under contract for the United States Government.
PPI#02: Reference Attachment 9, Labor_Category_&_Material_Handling_Rate_Pricing_Schedule__(Updated_28_Aug), Labor Categories 10 and 14. These two categories have the same title. Does the Government intend Category 14 to be “Project Manager”? Please clarify.
Answer: The second occurrence of the labor category “Site Manager” has been changed to read “Program manager”. Offerors are again advised that ALL labor rates regardless of labor category shall be fully burdened incorporating all costs and profit associated with the work to be provided.
PPI#03: The Questions and Answers published on 29 August 2014 are under a title called “Amendment 3”. Is there an Amendment 2?
Answer: The 2nd official SF-30 Amendment to the solicitation is now included. Please note that FBO automatically assigns Amendment numbers to each action/update, which do not align with the official SF-30 amendments to the solicitation. The first amendment on FBO was to include the Exhibits in a secured format. Therefore the first official amendment (SF-30) actually shows as the 2nd amendment to the FBO announcement.
