DTRIAC Questions and Answers, 24 Mar 2014
Q1: We have reviewed the Q&A for the DTRIAC RFP and are still confused about the actual process and requirements associated with L.2.7 and understand that DTRA is not trying to limit competition. The DTRA response indicates the Offeror must be complaint with the requirements of the contract DD254 by the projected award date. According to our Defense Security Service (DSS) representative, procurement agencies should not discriminate against companies without an active facility clearance. We are proposing a newly formed LLC with two established and highly capable parents both possessing TS Facility Clearances; and our DSS representative has indicated that a TS Facility Clearance could be awarded to the newly formed entity in a short period of time – even a few weeks. According to our DSS representative Offerors need to be sponsored so they may submit their facility and FOCI information for a Facility Clearance eligibility review. Developing focused business entities such as an LLC or JV is allowed in the FAR and SBA guidance and is becoming a widely accepted solution for agencies to receive focused attention while only paying for the corporate infrastructure actually required to support a given program. We are experienced with implementing this business model for the benefit of our customers and can offer an example of how other agencies handle this situation. We have experienced a process where an agency will require submission of our eFOCI with/at the time of our proposal that the agency will process if we are the apparent successful Offeror. As the GCA, will you submit, upon receipt of the bids, requests to the DSS Facility Clearance Branch to sponsor currently uncleared Offerors for a Facility Clearance?
A2: DTRA does not submit requests to the DSS Facility Clearance Branch to sponsor currently un-cleared offerors based upon receipt of proposals. The prime business entity (Company, Corporation, Limited Liability Company, Joint Venture, etc.) is eligible for the prime award only if it is compliant with the requirements of the contract DD254 by the projected award date as stated in M.3.2.1. If a newly formed LLC does not have the required clearance, then it is not eligible for award.
Note that L.2.7 will be amended to revise the first sentence to delete the phrase “or acquire prior to award of a contract” and insert the phrase “or acquire by the projected contract award date”.
Additionally, the statement that “DTRA will not sponsor offerors for DSS facility clearances” will be added to L.2.7.
Q2: Section L.2.7 of the subject RFP requires the offeror to input the necessary information in Block 6 of the DD 254 and to include in Vol I of the proposal. RFP Amendment P0001 Revises the DD 254;
however, the DD 254 was not included in the subject modification. Absent a copy of the Revised DD 254, the document being included in our proposal will not be the current DD 254.
A2: The DD254 was posted under RFP Amendment 0001 document packages. Please search FBO “DTRIAC RFP Amendment 0001, Contract Security Classification Specification (DD254)” for the DD254, dated 28 Feb 2014. Since Amendment 0002 will be posted for revisions as stated in Q&A 1, the revised DD254 will be fully incorporated in the FBO posting of Amendment 0002.
