About this file
This is a Form 6 SBE/DVBE Regular Dealer-Distributor Affirmation form used by Metro (a transportation authority) to evaluate Small Business Enterprise (SBE) and Disabled Veteran Business Enterprise (DVBE) participation in contract opportunities. The form establishes the framework for preliminary counting determinations to assess whether listed SBE/DVBE firms qualify as regular dealers or distributors and the corresponding credit percentages they may receive for materials and supplies provided under contract. The form requires SBE/DVBE firms to answer a series of questions regarding their capacity to perform as dealers or distributors, including whether items will be provided from on-hand inventory, whether bulk or specialty items will be delivered using company-owned or leased equipment, and whether purchase orders or bills of lading transfer responsibility and risk to the SBE/DVBE at the point of origin.
The form establishes a tiered credit structure where SBE/DVBE regular dealers may receive 60 percent credit for items provided from maintained inventory, while distributors may receive 40 percent credit for items including drop-shipped materials. The determination is made on a contract-by-contract basis. If an SBE/DVBE provides less than 51 percent of items from inventory, only the value of items sold or leased from inventory qualifies for 60 percent credit, with other items potentially eligible for 40 percent distributor credit. If neither regular dealer nor distributor requirements are met, participation counting is limited to reasonable fees, commissions, and transportation costs, with material costs excluded. The form requires signatures from both the SBE/DVBE owner or authorized representative affirming the accuracy of provided information and commitment to independently negotiate price, order quantities, pay for items, and assume responsibility for quality. The prime bidder is responsible for verifying the SBE/DVBE information and accuracy of participation counting, with any shortfalls in counting responsibility falling on the bidder.

FORM 6
SBE/DVBE Regular Dealer/ Distributor Affirmation Form
Metro will make a preliminary counting determination for each SBE/DVBE listed as a regular dealer or distributor to assess its eligibility for 60 or 40 percent credit, respectively, of the cost of materials and supplies based on its demonstrated capacity and intent to perform as a regular dealer or distributor, as defined in the Instructions to Bidders/Proposers of the solicitation and in the Contract Compliance Manual, under the Contract at issue. An SBE/DVBE regular dealer is a firm that owns (or leases) and-operates, a store, warehouse, or other establishment in which the materials, supplies, articles, or equipment of the general character described by the specifications and required under the contract are bought, kept in sufficient quantities, and regularly sold or leased to the public in the usual course of business. Items kept and regularly sold by the SBE or DVBE are of the ‘‘general character’’ when they share the same material characteristics and application as the items specified by the contract. A SBE distributor is an established business that engages in the regular sale or lease of the items specified by the contract. An SBE/DVBE distributor assumes responsibility for the items it purchases once they leave the point of origin (e.g., a manufacturer’s facility), making it liable for any loss or damage not covered by the carrier’s insurance. An SBE/DVBE distributor may receive 40% credit for drop-shipped items. The amount of SBE or DVBE credit will be made on a contract-by-contract basis. A copy of the bidder's quote, commitment, contract, or purchase order showing the materials the SBE or DVBE regular dealer or distributor is supplying must be attached to this form.
