About this file

This document is an Exhibit N form issued by the Texas Department of Agriculture regarding confidential or proprietary information handling under the Texas Public Information Act (PIA). The exhibit establishes the procedures respondents must follow when submitting proposals that contain confidential or proprietary information to this procurement opportunity. Respondents are required to select one of three checkboxes indicating their submission status: that the proposal is exempt from PIA disclosure and clearly marked as containing confidential or proprietary information; that the proposal contains confidential or proprietary information and a separate Public Information Act Copy has been submitted; or that the proposal contains no confidential or proprietary information and no separate copy is being submitted. The form requires authorized company representatives to provide their printed name, signature, and date of certification.

The document emphasizes that blanket assertions of confidentiality or proprietary designation are insufficient and may result in an adverse ruling from the Office of the Texas Attorney General. This exhibit must be completed and submitted as part of all proposal responses to ensure compliance with Texas PIA requirements and to provide proper notice to TDA regarding the confidential status of any submitted information. The form serves as the respondent's certification of their chosen confidentiality designation for their proposal submission.
