About this file
This document is an Estate to Be Appraised exhibit for a West Virginia conservation easement appraisal project involving the 1,844.12-acre Cross Knob Sportsman Club, Inc. property located in Hardy County. The appraisal is intended to establish the fair market value of the property's "as is" rights, title, and interests as of the effective date of valuation. The subject property is encumbered by multiple easements and rights, including a right-of-way easement for Jack R. Ours and George R. Ours, Jr. (recorded 1971), non-exclusive access easements benefitting the Cross Knob Sportsman Club, Inc., utility easements for Potomac Edison overhead electric distribution lines, and shareholder rights associated with 100 individual lots within four designated improvement areas. The property's vesting documentation is supported by deed book recordings in Hardy County Clerk's Office and a survey plat recorded in Deed Book 131, Page 543.
The appraisal must account for the complex ownership structure involving shareholder rights within Designated Improvement Areas 1, 2, 3, and 4, with specific direction that Federal Forest Legacy Program funds will not be used to acquire portions of the conservation easement area within these designated improvement areas. Consequently, the value allocable to these improvement areas must be separately calculated and excluded from the conservation easement acquisition value. The document references an Appraisal Task Assignment Map depicting the approximate locations of the various easements and rights affecting the property. Title evidence includes a Certificate of Vested Title and Title Report, establishing the legal foundation for the appraisal and ensuring all outstanding rights, reservations, and encumbrances are properly identified and valued.
